WHILE THEY'RE NOT NEW TO SOUTHLAKE, THEY RECENTLY OPENED UP A NEW SPACE AT GATEWAY PLAZA.

SO HOPEFULLY THAT'LL HELP IN KIND OF LIVENING UP THAT NORTH SIDE OF THAT CENTER.

SO WITH THAT, HERE'S EPICENTER FOR THE ARTS.

HI THERE, I'M MICHELLE BROGAN, THE DIRECTOR OF THE EPICENTER FOR THE AARTS HERE IN SOUTH TEXAS. WE ARE IN OUR BRAND NEW FACILITY THAT WE JUST MOVED INTO HERE OFF OF 114 AND GATEWAY PLAZA.

WE ARE SO EXCITED ABOUT WHAT IS HAPPENING HERE AT THE EPICENTER.

WE OFFER CLASSES FOR DANCERS, ACTORS, MUSICIANS OF ALL AGES.

WE EVEN DO PROFESSIONAL GROUPS DURING THE DAY.

WE HAVE SO MUCH SPACE HERE AS WE'RE GROWING AND MOVING FORWARD HERE IN THIS TIME, WE WOULD LOVE FOR YOU TO COME SEE US.

WE HAVE SO MUCH CAPACITY HERE, ESPECIALLY IN THE SEASON.

WE NEED THAT CAPACITY TO BE ABLE TO SPREAD OUT FAMILIES AND STUDENTS.

WE ARE A FAITH BASED DANCE STUDIO AND MUSICIANS AND ACTING THAT'S HAPPENING HERE WE GO OFF AT REALLY THE HEART.

AND SO FOR US, WE BELIEVE THAT IF YOU TRAIN THE HEART, THE GIFT MAKES ROOM FOR ITSELF.

SO HERE WE MAKE SURE THAT WE'RE TRAINING OUR STUDENTS IN THE HEART AND CHARACTER, IN EXCELLENCE AND IN MINISTRY AND EVERYTHING THEY DO.

I'D LIKE TO GO AHEAD AND TAKE A FEW MOMENTS AND SHARE SOME THOUGHTS ABOUT THE RECENT CONTROVERSY THAT IS CAUSING TREMENDOUS HEARTACHE IN OUR CITY AND FOR MANY THAT LIVE HERE.

THE CURRENT CONTROVERSY HAPPENED IN LARGE PART BECAUSE THE CARROLL ISD EFFORT TO CREATE A CULTURAL COMPETENCE ACTION PLAN RESULTED IN A PROCESS THAT LACKED TRANSPARENCY.

IT'S TELLING THAT A TRIAL COURT HAS GRANTED AND AN APPELLATE COURT HAS SUSTAINED A RESTRAINING ORDER THAT IS BASED IN PART ON THE QUESTION OF WHETHER THE CARROLL ISD SCHOOL BOARD VIOLATED THE TEXAS OPEN MEETINGS ACT.

THE CURRENT CONTROVERSY ALSO DOES NOT REFLECT THE VERY PROMINENT ROLE THAT MINORITY CITIZENS HAVE PLAYED IN OUR COMMUNITY FOR DECADES AND CONTINUE TO PLAY TODAY.

THERE ARE NUMEROUS EXAMPLES OF WORK WE HAVE INITIATED TO ADDRESS OUR COMMUNITIES CHALLENGES. COFFEE AND CONVERSATIONS.

DADS AND BREWS HAVE BEEN DESIGNED TO BRING PEOPLE TOGETHER FOR OPEN, HONEST AND SOMETIMES DIFFICULT CONVERSATIONS.

TOWN HALLS AND STUDENT PROGRAMS WITH OUR POLICE OFFICERS HAVE BEEN METHODS WE HAVE USED TO HELP US INTERACT AND TO UNDERSTAND ONE ANOTHER.

AND I'M ESPECIALLY PROUD OF THE FORMATION OF THE MAYORS ALLIANCE FOR UNITY AND CULTURE, WHICH HAS PUT TOGETHER DOZENS OF VALUABLE PROGRAMS THAT DEMONSTRATE OUR COMMITMENT TO MAKING SOUTHLAKE AN EXCELLENT COMMUNITY FOR EVERY SINGLE RESIDENT.

WHILE THE PROCESS WAS FLAWED, THE ISSUES THE PLAN ADDRESSES ARE NOT BEING SWEPT UNDER THE RUG. WE OWE IT TO OUR CHILDREN TO DRAW THE LINE THAT RACISM AND DISCRIMINATION IN ANY FORM IS UNACCEPTABLE AND CAN AND WILL LEAD TO HARSH CONSEQUENCES NOW AND AS THEY ENTER COLLEGE OR BEGIN THEIR CAREERS.

WE OWE IT TO EVERY PERSON WHO LIVES, WORKS AND VISITS SOUTHLAKE TO ENJOY A HIGH QUALITY OF LIFE OR EXPERIENCE THAT IT BE FREE OF HARASSMENT AND FEAR.

THAT'S WHY THE SCHOOL BOARD MUST PARTNER WITH THE CITY TO FIX THE PROCESS, REENGAGE AND EARN BACK OUR CITIZENS CONFIDENCE IN THE COMING DAYS AND MONTHS.

I KNOW THERE WILL BE MANY MORE DIFFICULT CONVERSATIONS AND PEOPLE WILL DISAGREE WITH ONE ANOTHER. BUT I BELIEVE THAT WE CAN GET THROUGH THIS IF WE COMMIT TO TRANSPARENCY AND HAVE RESPECT FOR DIFFERENT POINTS OF VIEW.

I KNOW THAT I AM READY.

I'M REACHING OUT TODAY TO SHARE MY HEARTACHE AND DISAPPOINTMENT THAT'S COME FROM A GROWING DIVIDE OVER THE LAST EIGHT MONTHS AND THE LACK OF LEADERSHIP STEPPING FORWARD TO INITIATE HONEST AND EMPATHETIC DIALOG VIA LIVE CONVERSATIONS, NOT SOCIAL MEDIA FOR ALL OF ITS CITIZENS. AFTER AFTER READING YESTERDAY'S JANUARY 22ND NBC NEWS STORY AND THEN WATCHING THE VIDEO OF THE ALLEN'S WEST ADDRESS IN SOUTHLAKE, I'M COMPLETELY DISHEARTENED BY WHAT I SAW.

TO SEE THREE ACTIVE CITY COUNCIL MEMBERS STANDING AND APPLAUDING FOR AN EXCLUSIVE BELIEF THAT PEOPLE SHOULD GO BACK TO WHERE THEY CAME FROM.

IF THEY DON'T SHARE IN THE SAME VALUE SYSTEM IS NOT ONLY CONTRADICTORY TO THE MAYOR'S ALLIANCE FOR UNITY AND CULTURE MISSION, BUT ALSO DISHEARTENING, UNAPOLOGETIC AND MSS REPRESENTATIVE OF THE CORE VALUES ADOPTED BY OUR CITY IN 2005 AND ENTRUSTED IN ALL OF YOU AS COUNCIL MEMBERS BY ALL OF OUR CITIZENS.

AS A LONG TIME SOUTHLAKE RESIDENT MOTHER OF TWO CARROLL ISD STUDENTS, BUSINESS OWNER, COMMUNITY VOLUNTEER AND CHAMPION OF ALL THINGS SOUTHLAKE SINCE 2004, I HAVE PERSONALLY STRUGGLED FOR MONTHS ON HOW TO BEST ADDRESS MY CONCERNS FOR THE ONGOING DIVIDE IN OUR CITY, OUR CITY, IN A WAY THAT WOULD INITIATE TRUE AND MEANINGFUL CONVERSATION AND

POSITIVE CHANGE. I'M HOPEFUL THAT BY ADDRESSING YOU ALL IN THIS FORMAT THAT WE CAN BEGIN TO GET BACK TO THE SHARED VALUES OF OUR CITY AS A COMMUNITY.

AND WHAT MADE US ALL FALL IN LOVE WITH SOUTHLAKE WHEN WE CAME.

IN ORDER TO MOVE FORWARD, WE MUST, AS A COMMUNITY, BE HONEST AND RECOGNIZE THAT RACISM AND EXCLUSION DOES EXIST.

WE MUST GET COMFORTABLE DISCUSSING WHEN AND HOW IT EXISTS AND BEING OPEN MINDED IN EXPLORING AND TAKING ACTIONS NEEDED TO OVERCOME IT.

TO LABEL SOUTHLAKE AS A WHOLE IS RACIST, AS RACIST IS NOT OK.

AND IT'S AN ABSOLUTE FALSE ACCUSATION THAT I TAKE VERY PERSONALLY.

BUT TO SAY RACISM DOESN'T EXIST IS NOT OK EITHER.

WE ALL MUST COME TOGETHER AND DO BETTER.

I THINK THEY'RE I DON'T THINK THERE'S ANYONE WHO HAS FOLLOWED WHAT THE CITY HAS DONE WHO WOULD EVER SAY THAT THE CITY DOESN'T BELIEVE THAT RACISM DOES NOT EXIST IN OUR COMMUNITY. I KNOW THAT YOUR BUSINESS IS SOMETHING THAT I'VE ALWAYS LOOKED AT THAT TELLS THE GOOD STORY ABOUT SOUTHLAKE LIKE THE POSITIVE THING ABOUT OUR PEOPLE WHO THEY REALLY ARE AT THE HEART.

AND I THINK YOU KNOW BETTER THAN ANYONE, BECAUSE YOU'VE TOLD THOSE STORIES FOR SO MANY YEARS AND YOU'VE TOLD THEM SO BEAUTIFULLY THAT THIS IS AN INCREDIBLE COMMUNITY, WE NEED TO DO BETTER, BUT WE'VE SAID WE NEED TO DO BETTER.

I HOPE MY STATEMENT THAT I READ TONIGHT AND MY STATEMENT THAT I CONTINUE TO READ TO EVERYONE, WHETHER THEY LIKE IT OR NOT, WHETHER IT'S ON SOCIAL MEDIA OR NOT, IT'S EXACTLY HOW I FEEL AND I STAND BEHIND HOW I FEEL.

BUT I'VE ALSO TAKEN THE TIME AND ENERGY WITH THE HELP OF THE CITY STAFF TO PUT TOGETHER MEANINGFUL EVENTS, WHETHER IT WAS THE ZOOM CALL WITH OUR POLICE CHIEF AFTER THE GEORGE FLOYD MURDER, WHETHER IT WAS BRINGING OUR TEENS TOGETHER AND TO TELL IT JUST TO SHOW TO SHOW OUR TEENS OF EVERY COLOR HOW TO ACT, HOW TO RESPOND IF THEY'RE STOPPED BY THE POLICE. WE HAD CLOSE TO 100 STUDENTS ATTEND THAT EVENT DURING COVID.

WE WERE GETTING READY TO DO CELEBRATE SOUTHLAKE IN A ZOOM FORMAT UNFORTUNATELY, I GUESS YOU CALL VIRTUAL THIS YEAR.

YOU CAN SEE WHITE CHAPEL UNDER CONSTRUCTION, ALONG WHITE CHAPEL THERE IS A PRETTY SIGNIFICANT TREE COVER.

THESE ARE, FOR THE MOST PART, EVERGREEN SPECIES LOCATED IN THIS AREA.

SO THERE IS A DECIDUOUS TREE AT THE FRONT OF THE PROPERTY.

THIS IS THE PROPERTY OWNER RESPONSES PER OUR ORDINANCE.

WE DO NOTIFY 200 FEET FROM THE SUBJECT PROPERTY, BUT OUR ORDINANCE ALSO REQUIRES NOTIFICATION IN THE PLANNED SUBDIVISION FOR CHAPEL DOWNS.

GREEN INDICATES RESPONSES IN FAVOR AND THEN THE RED DOTS INDICATE RESPONSES OPPOSED TO THE APPLICATION. THIS IS A HISTORY OF YOUR APPROVAL'S GENERALLY OVER THE LAST THREE YEARS.

THOSE INCLUDE THE TWO APPROVALS EARLIER THIS YEAR IN JANUARY.

THAT PROVIDES SOLAR PANELS, SQUARE FOOTAGE AND THE KILOWATT SYSTEMS. THE P&Z RECOMMENDED DENIAL OF THIS REQUEST 4-0 BUT THEY DID SUGGEST THAT THE APPLICANT COME FORWARD AND THEY TAKE A LOOK AT THE PLACEMENT AND THE QUANTITY THAT'S LESS INTRUSIVE OR POTENTIALLY LESS INTRUSIVE TO THE NEIGHBORS AND TO THE NORTH WHITE CHAPEL THOROUGHFARE. THERE WERE NO CHANGES MADE TO THE APPLICATION SITE PLAN.

ACCORDING TO MY STAFF, THE APPLICANT WOULD LIKE THE COUNCIL TO CONSIDER THE PROPOSAL THAT WAS PRESENTED TO THE PLANNING AND ZONING COMMISSION.

WITH THAT, THAT CONCLUDES MY PRESENTATION.

SO THE BOTTOM LINE IS IT'S NOT IN KEEPING WITH OUR ORDINANCE.

I DID JUST THAT. I DID SPEAK TO EVERYBODY, SEVEN HOMES THAT'S IN THE CUL DE SAC AREA THAT HAVE EVEN A SLIVER VISIBILITY OF THE SOLAR SYSTEM, THE SOLAR PANELS IN THE FRONT OF THE HOUSE OR EVEN THE SIDE.

I'VE ASKED THEM ALL IF THEY WOULD BE OK AND IN FAVOR OF THE SOLAR PANELS BEING IN KEEPING WITH THIS DESIGN. FIVE OUT OF THE SEVEN SAID THEY HAVE NO ISSUES.

THEY DID SIGN DOCUMENTS SAYING THAT THEY HAVE NO ISSUES WITH THAT WHATSOEVER, ONE I COULD NOT GET IN TOUCH WITH, WHICH IS IMMEDIATELY NEXT DOOR TO THE HOMEOWNER.

AND THE THIRD THE THE SEVENTH ONE, I SHOULD SAY, WHO'S DIRECTLY ACROSS THE STREET.

HE WASN'T WILLING TO SIGN ANY DOCUMENTS, BUT HE SAID HE WASN'T OPPOSED TO ANYBODY GOING SOLAR. SO I DO HAVE THOSE DOCUMENTATIONS RIGHT HERE.

THAT'S THE REASON WHY WE KEPT THE DESIGN THINKING IF THE PEOPLE IN THAT CUL DE SAC AREA AREA DON'T SEE THAT AS AN OFFENSIVE SIGHT, THAT PERHAPS YOU GUYS WILL TAKE THAT INTO CONSIDERATION. THE DESIGN OF THESE PANELS TOO JUST WANT TO KIND OF POINTED OUT PANELS.

YOU'VE SEEN DIFFERENT TYPES OF PANELS, DIFFERENT STYLES OF PANELS, DIFFERENT COLORS WITH STRIPES GOING VERTICALLY AND HORIZONTALLY.

I'M NOT A PARTICULAR FAN OF THOSE MYSELF, BUT THESE PARTICULAR PANELS ARE MATTED.

THEY'RE BLACK PANELS COMPLETELY.

THERE IS NO LINES ON THEM.

SO IT LOOKS LIKE BLACK GLASS ON TOP OF A DARK SHINGLED ROOF.

AND I JUST WANT TO POINT THAT OUT, TOO, SO IT DOESN'T IT DOESN'T POP OUT, DOESN'T STAND OUT IN AN AWFUL MANNER.

SO WHY NOT PUT THEM ON THE SORT OF THE BACK SIDE OF THE HOUSE, IF YOU WILL, WHICH, YOU KNOW, WOULD BE LOOKS LIKE THERE'S SOME ROOF AREA THAT YOU COULD USE, MAYBE NOT GET ALL THE SIXTY NINE PANELS, WHICH IS A LOT, BUT LOOKS LIKE THERE'S SOME OTHER OPPORTUNITIES ON THE BACK SIDE OF THE HOME.

AND ALSO THERE'S LIKE A PERGOLA AWNING AT THE BACK ALSO COULD BE USED.

IT COULD BE.

THAT'S CORRECT. WE CAN UTILIZE THAT AS WELL.

THE PRODUCTION DOES GET INJURED IF WE PLACE THOSE PANELS ON THE BACK SIDE BECAUSE IT IS FACING SORT OF THE NORTH WESTERN DIRECTION.

YOU TYPICALLY WANT PANELS FACING SOUTHEAST, SOUTH OR SOUTHWEST.

THE HOMEOWNERS NOT OPPOSED TO MAKING THAT CHANGE.

BUT WE WERE TRYING BEST EFFORT TO SEE IF WE CAN MAINTAIN THAT, BECAUSE ULTIMATELY, WITH SOLAR, CONTRARY TO POPULAR BELIEF, IT'S NOT AN EXPENSIVE SYSTEM TO PUT ON YOUR HOUSE WHEN COMPARING IT TO WHAT YOU PAY WITH THE ELECTRIC COMPANY.

IT'S ACTUALLY CHEAPER IN MOST CASES.

NOT ALL DEPENDS ON THE ORIENTATION OF THE HOUSE, THE ROOF LAYING, THE REAL ESTATE SPACE THAT WE HAVE ON THERE. IN HIS PARTICULAR CASE, WHERE WE'RE PLACING THE PANELS CURRENTLY TODAY, HE GETS A HUGE ADVANTAGE.

HE SAVES ABOUT ONE HUNDRED DOLLARS PER MONTH ROUGHLY ON HIS ELECTRIC EXPENSE JUST BECAUSE OF WHERE THE DESIGN OF THE PANELS ARE.

SO THAT'S THAT'S ONE OF THE REASONS WHY WE TRY TO SHOOT BEST EFFORT TO SEE IF WE CAN MAINTAIN THOSE PANELS AT THE FRONT.

HOWEVER, IF THAT'S SOMETHING THAT WON'T BE ENTERTAINED HERE, LIKE I SAID, THE CLIENT IS OPEN TO CHANGING THAT IF NECESSARY.

I JUST WANT TO GIVE YOU SOME BACKGROUND ON THE REGULATIONS IN PLACE AND JUST SOME GENERAL INFORMATION ON THE SOLAR ENERGY INDUSTRY.

CURRENTLY, ANY TYPE OF ENERGY SYSTEMS, WHETHER IT BE ROOF OR GROUND MOUNTED, NO MATTER HOW LARGE OR SMALL, REQUIRES THAT CITY COUNCIL APPROVE A SPECIFIC USE PERMIT FOLLOWING A RECOMMENDATION FROM THE PLANNING ZONING COMMISSION.

TYPICALLY, THIS PROCESS TAKES ABOUT TWO AND A HALF TO THREE MONTHS TO COMPLETE.

THIS IS OUR CURRENT REGULATIONS THAT WE HAVE IN PLACE.

I KNOW THAT YOU'RE ALL FAMILIAR WITH THIS.

THERE ARE REGULATIONS FOR GROUND MOUNTED SYSTEMS, ROOF MOUNT SYSTEMS AND THEN SYSTEMS IN NONRESIDENTIAL AREAS.

IN TERMS OF WHY WE'RE BRINGING THIS FORWARD TO COUNCIL AS AN AMENDMENT AT THIS TIME.

A COUPLE OF REASONS.

ONE, WE WERE BOTH INQUIRIES WERE MADE BY THE CITY COUNCIL AND THE P&Z TO LOOK AT MODIFYING THE SOLAR PANEL ORDINANCE.

IN ADDITION, YOUR 2030 SUSTAINABILITY PLAN MAKES RECOMMENDATION TO MODIFY THE SOLAR ENERGY ORDINANCE TO ALLOW SOLAR PANELS BY RIGHT UNDER CERTAIN CIRCUMSTANCES.

THIS SLIDE IS JUST VERY BUSY, BUT BASICALLY WHAT IT'S ATTEMPTING TO SHOW, NO MATTER WHAT THE TYPE OF SYSTEM THAT YOU'RE LOOKING AT, TYPE OF SOLAR ENERGY SYSTEM, THE TRAJECTORY IS UP, THE CURVE IS UP IN TERMS OF EFFICIENCY, THE PRICE OF SOLAR ENERGY SYSTEMS HAVE DECLINED IN RECENT YEARS.

THE AVERAGE INSTALLER COSTS FOR RESIDENTIAL SOLAR PANELS IS DROPPING.

MOST OF THIS IS A RESULT OF FALLING EQUIPMENT PRICES, WITH THE LABOR REMAINING CONSTANT OR RISING IN SMALL INCREMENTS.

BUT OVER TIME, THESE SYSTEMS CONTINUE TO IMPROVE.

ALSO, YOU HAVE THE TAX CREDITS, INCENTIVES AND THEN TRYING TO OFFSET THE RISING ENERGY COST IN THE REGION.

I SHOWED THIS SLIDE ON THE PREVIOUS APPLICATION, BUT THIS IS A JUST A SUMMARY OF THE LAST THREE YEARS OF THE SUPS THAT YOU APPROVED.

AND THIS WAS THE BASIS FOR BEGINNING WITH THE 600 SQUARE FOOT IS KIND OF THE THRESHOLD TO TO ALLOW FOR ADMINISTRATIVE APPROVAL.

THE UPPER THRESHOLD, BASICALLY THE METHODOLOGIES WE THREW OUT THE HARBOR COURT, WHICH IS THE 116 PANELS, THE TWENTY NINE HUNDRED SQUARE FOOT ROOF SYSTEM, AND TOOK AN AVERAGE OF WHAT WAS APPROVED AND WE'RE JUST RIGHT UNDER 600 FEET.

SO WHEN YOU SEE THE PROPOSED REGULATIONS, THAT'S HOW STAFF CAME UP WITH THE 600 FEET.

INITIALLY OF COURSE, COUNCIL CAN LOOK AT MODIFYING THAT NUMBER IF YOU SO CHOOSE.

THIS IS A SUMMARY OF THE CASES THAT HAVE BEEN APPROVED SINCE 2010, AND IT'S PRETTY BARREN FROM ABOUT 2010 UNTIL 2018.

BUT THE LAST THREE YEARS, WE'RE SEEING AN INCREASE IN THE APPLICATIONS AND EXPECT MORE WITH THE MORE EFFICIENT SYSTEMS AND THE RISING ENERGY COSTS THAT WE'RE SEEING.

THE NEXT POSSIBLE AMENDMENT IS FOR FLAT ROOF STRUCTURES THAT EXTEND FROM THE MAIN RESIDENCE. THIS WOULD BE GENERALLY PATIO'S OR IF THERE WAS A IN THE ARCHITECTURE, THERE MAY BE A FLAT ROOF STRUCTURE SUCH THAT IT'S NOT VISIBLE FROM THE PUBLIC RIGHT AWAY.

AND AGAIN, THE TOTAL SOLAR ARRAY IS LESS THAN 600 SQUARE FEET.

IN TERMS OF NONRESIDENTIAL DISTRICTS.

WHAT WE'RE PROPOSING IS THAT ON THESE COMMERCIAL DISTRICTS, SUCH AS THE CISD MIDDLE SCHOOL, YOU MAY KNOW THERE'S A LARGE SOLAR ARRAY ON THAT FLAT RESTRUCTURE.

IT'S NOT VISIBLE. YOU CAN'T SEE IT.

WE'RE PROPOSING THAT IF IT'S NOT VISIBLE FROM THE PUBLIC RIGHT AWAY, ANY OF THESE STRUCTURES ON THESE COMMERCIAL BUILDINGS AND NOT VISIBLE FROM ANY LAND USE OR ZONED PROPERTY, RESIDENTIAL PROPERTY WITHIN 300 FEET, THEN THOSE COULD BE APPROVED ADMINISTRATIVELY.
