I HAVE NONE OTHER THAN EVERYBODY HAVE A GOOD CHRISTMAS.

ITEM NUMBER FIVE IS APPROVAL OF THE MINUTES PLANNING ZONING COMMISSION MEETING HELD ON NOVEMBER 17TH, 2022.

IF THERE'S NO COMMENTS OR CHANGES, BE WILLING TO ENTERTAIN A MOTION.

AND WE HEARD QUITE A BIT AT THIS OF THIS AT OUR LAST MEETING.

SO UNLESS YOU GUYS HAVE ANY SPECIFIC QUESTIONS FOR DIRECTOR KILLOUGH, I THINK WE'LL TAKE A PASS ON HEARING THE THE CITY'S PRESENTATION AGAIN, ANY QUESTIONS? ALL RIGHT THAT'S GREAT FANTASTIC.

IS THE APPLICANT HERE? DO YOU ALL HAVE ANYTHING YOU WANT TO ADD FROM THE LAST MEETING THAT WE HAD WITH YOU ALL? OKAY, VERY GOOD.

ANYBODY HAVE ANY QUESTIONS FOR THE APPLICANT THAT THEY WANT TO GET CLARIFIED? I'M TRYING TO RECALL THE DISCUSSION OF THE ENCROACHMENT AGREEMENT AND WHAT WOULD HAPPEN IF THIS WERE TO NOT BE A RESTAURANT ANY LONGER AND HOW THE CITY RECAPTURES OR TURNS THAT BACK INTO A SIDEWALK WHOSE RESPONSIBILITY THAT IS.

THAT WOULD FALL BACK TO, OF COURSE, THE CITY COULD RETURN IT AT OUR EXPENSE SHOULD WE WANT TO OR HAVE THE NEED TO.

HOWEVER, IT WOULD FALL BACK TO THE PROPERTY OWNER ULTIMATELY AS TO WHAT THEY WISH TO DO WITH IT.

A SIMILAR SCENARIO THAT TOOK PLACE WAS WITH THE MACY'S MARKET AND THEIR OUTDOOR PATIO.

THERE WAS SOME DISCUSSION ABOUT HOW THAT WOULD OCCUR AND I THINK AT THAT POINT THEY WERE WILLING TO JUST TO LEAVE IT AT THE DISCRETION OF RPAI AND HAVE THEM CONTINUE TO MAINTAIN MAINTAIN IT, SINCE THERE IS GENERALLY A DESIRE TO HAVE, WHERE APPROPRIATE, SOME OUTDOOR SEATING SPACE FOR PEOPLE TO UTILIZE AS THEY'RE DOING THEIR SHOPPING.

SO I DON'T THINK WE HAVE TO INCLUDE ANYTHING IN A MOTION AT ALL FOR THAT, CORRECT? I DON'T THINK SO. DO YOU THINK WE'RE GOOD DIRECTOR KILLOUGH? IT CERTAINLY TO THE COMMISSION, IF YOU WOULD LIKE COUNCIL TO CONSIDER THAT AND PUT SOMETHING TO THAT IN EFFECT AND YOUR RECOMMENDATION IF IF NOT IT'S UP TO YOU.

I WOULD EXPECT THE COUNCIL TO ADDRESS THE SAME CONCERN.

WHERE THEY HAVE WHERE THEY'RE SHOWING THE POTENTIAL MURALS, FUTURE MURALS.

THEY WOULD HAVE TO COME BACK TO THE SIGNBOARD FOR THAT, RIGHT? THAT IS CORRECT. ALL OF THE SIGNAGE WILL NEED TO CONFORM WITH THE TOWN SQUARE MASTER SIGN PLAN AND THE SOUTHLAKE, THE CITY OF SOUTH LAKE SIGN ORDINANCE AND IN TOWN SQUARE FOR MURALS.

IT DOES REQUIRE COUNCIL APPROVAL AND THE POLICY THAT HAS BEEN ESTABLISHED WITH THE MOST RECENT ONE THAT'S COME THROUGH IS WE WOULD HAVE THAT GO TO OUR ART COUNCIL FOR A RECOMMENDATION PRIOR TO COMING TO SIGN BOARD AND THEN SIGN BOARDS RECOMMENDATION ALONG WITH ART COUNCIL WOULD BE FORWARDED TO COUNCIL FOR FINAL CONSIDERATION ON MURALS.

CHAIRMAN, I MOVE THAT WE APPROVE ITEM NUMBER ZA22-0056 SITE PLAN FOR POSTINO SOUTHLAKE SUBJECT TO THE STAFF REPORT DATED DECEMBER 2ND, 2022 AND THE SITE PLAN REVIEW SUMMARY NUMBER TWO DATED NOVEMBER 11TH, 2022 AND NOTING THAT OUR DISCUSSION RELATING TO RESTORATION OF SIDEWALK FALLS TO RPAI AT THIS POINT IN TIME, I BELIEVE SUBJECT TO REVIEW BY COUNCIL, AND ALSO NOTING THAT THE MURALS WOULD REQUIRE REVIEW BY THE ART COUNCIL PRIOR TO COMING BACK TO THE SIGN BOARD FOR APPROVAL.
