YEAH, IT SEEMS THAT WAY. AND USUALLY WE'RE EATING SOME DELICIOUS FOOD AT A RIBBON CUTTING.

AND WE DID HAVE ANOTHER GOOD ONE TODAY.

WE DID. WELL, IT'S GOOD TO BE HERE WITH ALL OF YOU.

THIS HAPPENS TO BE MY LAST MONTH AS CHAIR.

YOU KNOW, WE ARE NOW BEGINNING TO START A NEW FISCAL YEAR AS OF JULY 1ST.

AND COMING UP HERE FIRST.

THEY'LL BE INTRODUCED TO OUR BOARD, ALTHOUGH THEY KNOW WHO THEY ARE AT THIS NEXT BOARD MEETING.

AND THEN THE BOARD WILL HAVE THEIR ANNUAL PLANNING RETREAT AT THE END OF JULY.

NEW MEMBERS 51 AND RIBBON CUTTINGS 22.

THIS IS ABOUT ON PAR WITH SORT OF WHAT'S NORMAL ABOUT THIS TIME OF YEAR.

WE ANTICIPATE RIBBON CUTTINGS TO POSSIBLY SET A RECORD, SO THAT'S A REALLY GOOD THING WHEN WE'RE HAVING SO MANY NEW BUSINESSES THAT ARE OPENING UP, OR AT LEAST FOR THE FIRST TIME, HAVING A RIBBON CUTTING OR GRAND OPENING, THAT SORT OF THING.

MAY WAS PACKED.

IT WAS AT LEAST ROUGHLY ABOUT TWO PER WEEK.

AND HERE WE ARE WITH OUR MAY MEMBER OF THE MONTH, NONE WITH PEACE, LOVE AND A LITTLE DONUTS.

AND SHE IS ALL OF THAT.

SHE'S A REALLY VIVACIOUS YOUNG LADY.

SPEAKING OF LUNCHEONS, WE HAD A SURVEY THAT WE CONDUCTED IN THE EARLY PART OF THE YEAR.

AND THE RESULT OF THAT SURVEY, WE HAD 2 OR 3 SEPARATE PANELS WHERE WE INVITED VARIOUS CHAMBER MEMBERS TO PARTICIPATE TO GIVE US FEEDBACK ON OUR LUNCHEONS, WHAT WAS MEANINGFUL, WHAT WASN'T, WHAT NEEDED TO BE TWEAKED.

WE GOT SOME REALLY GOOD FEEDBACK FROM THAT AND WE HAVE MADE A FEW ADJUSTMENTS WHERE THE LUNCHEONS ARE HOPEFULLY EVEN MORE MEANINGFUL TO THE CHAMBER MEMBERS.

AND HERE WE ARE WITH OUR RELATIONAL NETWORK GROUP.

WE MADE A SWITCH TO THIS.

THIS IS UNDER THE LEADERSHIP OF BOB SIFFERMANN WITH SCORE.

WE ARE NOW ONCE A MONTH RATHER THAN TWICE.

THIS IS ON THE THIRD TUESDAY OF EACH MONTH AT THE CAMBRIA.

THERE WERE A GREAT HOST WE ARE APPROACHING AND BEEN RIGHT AT 50 PEOPLE THE LAST FEW TIMES.

SO IT IS REALLY GROWING.

COMING OUT OF COVID. IT WAS A REAL STRUGGLE TO GET IT GOING.

BREAKFAST IS PROVIDED A REAL, MEANINGFUL TIME.

SO THROUGH MEETING WITH OUR CITIZENS AND LISTENING TO YOUR LEADERSHIP AND VISION, YOU KNOW, MANY NEW INITIATIVES HAVE BEEN ADDED AND WE ADDED SOME IN 2021 AND EVEN MORE IN 2022. YOU KNOW, TO GO OVER SOME OF THOSE THE YELLOW RIBBONS THAT WE PUT UP IN FAMILY PARK, LIGHTING THE FOUNTAIN, RED, WHITE AND BLUE, LIGHTING THE TOP FLOOR OF TOWN HALL, RED, WHITE AND BLUE, THE BANNER THAT WE HANG ON TOP OF TOWN HALL, THE MILITARY BRANCH FLAGS THAT WE DISPLAY OUT THERE, ALL OF THOSE HAVE BEEN ADDED.

HIS SUMMER PROJECT WAS PARKS AND RECREATION MONTH.

OH VERY GOOD. AND SO A LOT OF WHAT YOU'RE GOING TO SEE TONIGHT, A LOT OF WHAT YOU'LL SEE THROUGHOUT THE MONTH OF JULY, IS FRUIT OF HIS LABOR.

SO WANTED TO MAKE SURE HE WAS RECOGNIZED AS WELL.

SO REAL QUICK, I'LL INTRODUCE TO YOU FIRST, WE HAVE TERRY LEE TO MY LEFT.

TERRY HAS BEEN WITH THE CITY FOR OVER 20 YEARS, WORKING IN OUR PARKS DEPARTMENT.

HE'S CURRENTLY THE SUPERVISOR OVERSEEING BOB JONES PARK, NORTH PARK.

HE HAS A GREAT CREW. HE LEADS A GROUP OF INDIVIDUALS WHO JUST DO A FANTASTIC JOB KEEPING THAT PARK BEAUTIFUL.

TERRY'S ALSO A CO-LEADER OF ONE OF OUR MATRIX TEAMS, OUR SAFETY AND TRAINING TEAM.

SO HE WORKS TO MAKE SURE THAT OUR EMPLOYEES ARE SAFE AND THAT TRAINING IS WHERE IT NEEDS TO BE FOR ALL OF OUR EMPLOYEES SO THAT THEY CAN DO A GREAT JOB.

THE DEVELOPMENT ALONG JONES BRANCH HAS THAT ADDED TO THE EXCESSIVE RUNOFF IN 1980S? GRAPEVINE HAD A HOUSING BOOM ON THE EAST SIDE OF THE BANK ALL THE WAY TO PARK LANE, IN THE 90S.

SOUTHLAKE HAD 114 AND 709 CONSTRUCTIONS.

AND BUSINESS DEVELOPMENT 2000 THROUGH 2023.

ADDITIONAL BUSINESS DEVELOPMENT ALL THE WAY SOUTH DOWN TO ALMOST DRAGON STADIUM.

SO IN 40 YEARS, THE JONES BRANCH HAD A SLOPED CREEK BED THAT WENT TO TODAY'S LAND EATING MONSTER.

NEITHER SOUTHLAKE NOR GRAPEVINE HAD A CAPACITY STUDY AS HOW MUCH WATER THE JONES BRANCH COULD CARRY.

EVERY PLAN FOR DEVELOPMENT DID AN INDIVIDUAL STUDY AS TO WHAT EFFECT THE NEWLY CREATED RUNOFF WOULD HAVE, AND EACH HAD AN ENGINEERING STAMP AFFIXED.

THERE WAS NO ACCUMULATION OF THE EFFECTS, SO EACH PLAN WAS APPROVED BY SOUTHLAKE WITHOUT REGARD TO CAPACITY OF JONES RANCH.

THE EXISTING DETENTION DEVICES ARE NOT CONTROLLING THE RUNOFF SURGES.

FOR 40 YEARS I HAD A CHAIN LINK FENCE ON THE BACK OF THAT BRANCH, THEIR PROPERTY FENCE.

AND THIS LAST YEAR THE JONES BRANCH HAS EXCEEDED THE BANKS AND PUSHED MY FENCE OVER.

IN 1997, THEY CONSTRUCTED THIS EXISTING SEWER SANITARY SEWER THAT NEEDS REWORK.

IT REMAINS SAFE UNTIL RECENT EROSION THREATENED TO EXPOSE AND DAMAGE IT.

THE CITY HAD NO IDEA OF THE EROSION OR ITS POTENTIAL EFFECT ON THE SEWER LINE UNTIL A MANHOLE ON MR. BAUER'S PROPERTY WAS FOUND TO BE IN DANGER.

A PLAN WAS STARTED TO ADDRESS THE MANHOLE, AND THE SURVEYING TEAM FOUND ADDITIONAL LOCATIONS ALONG THE PIPE WERE ALSO IN DANGER.

SEVERAL OPTIONS TO ADDRESS THE DANGERS WERE PRESENTED TO THE CITY.

THE LEAST EXPENSIVE OPTION WAS TO MOVE THE PIPE FURTHER AWAY FROM THE RIVERBED.

THE OTHER OPTIONS WERE DEEMED TOO EXPENSIVE AND WERE NOT PURSUED.

MOVING THE PIPES ADDED ADDITIONAL COST TO THE ADJACENT LANDOWNERS, CREATING NEW EASEMENT THAT TRAVERSES THE PROPERTY AWAY FROM THE BOUNDARIES OR BORDERS, REDUCES THE

USAGE OF THE LAND FOR CONSTRUCTION, LOWERS THE DESIRABILITY OF THE PROPERTY FOR RESALE, AND DOES NOTHING TO ADDRESS THE CONTINUED EROSION.

I'M SORRY. ABANDONING THE EXISTING PIPE AND MOVING THE MANHOLES WILL REDUCE THE INTEGRITY OF THE EXISTING EMBANKMENT AND PROMOTE ADDITIONAL EROSION.

TWO EMPLOYEES FROM THE SURVEY TEAM THAT YOU GUYS ELECTED SAID THAT MOVING THE PIPE IS JUST GOING TO BE A TEMPORARY FIX.

IT'LL BE A BAND-AID FIX.

IN A FEW YEARS THE CITY WOULD BE NEEDING TO ADDRESS THE NEW CONSTRUCTION SEWER LINE FOR THE SAME EROSION.

MOVING THE PIPE NOW AND RE ADDRESSING THE EROSION IN A FEW YEARS WOULD FAR EXCEED THE COST OF THE EROSION CONTROL TODAY.

WHAT'S CHANGED? UNCONTROLLED PROGRESS.

RANCH LANDS WITH GRASS TREES, SMALL STREAMS AND PONDS THAT ABSORBED AND SLOWLY DISPERSED THE RAINFALL WERE REPLACED WITH PAVEMENT, CONCRETE ROOFS AND LARGE DRAIN PIPES THAT DIDN'T ABSORB BUT ACCUMULATED AND ACCELERATED THE RUNOFF DUMPING INTO JONES BRANCH.

IN THE 70S, I BUILT A FENCE ACCORDING ADJACENT TO THE CORE PROPERTY WITH A GATE ACROSS THE CREEK.

NOW PART OF MY FENCE IS HANGING ACROSS THE CREEK.

IN 1999, THE CITY PUT IN A SEWER LINE ON MY PROPERTY ADJACENT TO THE FENCE.

NOW THE SEWER LINE IS VERY CLOSE TO BEING EXPOSED.

IN 2020 THE MANHOLE IS A SEWER LINE MY NEIGHBOR, FRED BAUER, WAS EXPOSED.

THE CITY IS NOW PROPOSING MOVING THE SEWER LINE AND MANHOLE 20FT FURTHER INTO MY PROPERTY, AWAY FROM THE EXISTING LINE, WHICH FURTHER DECREASES THE VALUE OF MY PROPERTY.

MY MAIN CONCERNS AND COMPLAINTS ARE THE OLD DEVELOPMENT PLANS WERE FLAWED, AS EVIDENCED BY THE EROSION COINCIDING THE DEVELOPMENTS.

WHEN THE SEWER WAS INSTALLED, THERE WAS NO FOLLOW UP OR SURVEILLANCE, AS MR. BAUER HAD TO NOTIFY THE CITY THAT THE MANHOLE AND THE SEWER ARE FALLING IN THE CREEK.

DECISIONS ON THE SEWER SYSTEMS ARE MADE IN THE OFFICE AS NO ONE IN AUTHORITY HAS PHYSICALLY BEEN SEEN OR ON MY CAMERA.

IT IS OBVIOUS THAT THE CITY HAS NO LONG RANGE PLANS MOVING THE SEWER 20FT WITHOUT ADDRESSING THE EROSION.

IT'LL BUY YOU MAYBE 15 YEARS.

SOUTHLAKE, GRAPEVINE, THE CORPS OF ENGINEERS ALL HAVE BEEN REMISS AND RESPONSIBLE FOR THE DEGRADATION OF JONES BRANCH, WHICH IN THE LAST 30 YEARS HAS TRANSFORMED FROM A BRANCH TO A CREEK TO A STREAM TO A RAGING RIVER WHEN IT RAINS.

THIS SITUATION EQUATES TO A CITY SLICKER WHO GOT IN A HOG BUSINESS AND NEVER SET FOOT ON HIS HOG FARM.

ONE DAY THE HOGS TORE A HOLE IN HIS FENCE AND GOT OUT.

THE SLICKER TOLD THE HIRED HAND, CATCH THE HOGS AND PUT THEM BACK IN THE PEN, BUT NEVER BOTHERED TO FIX THE FENCE.

YES, SIR. SO WE NORMALLY SURVEY OUR INFRASTRUCTURE.

AND ONE EFFORT THAT WE STARTED DOING WAS IDENTIFYING AREAS THAT ARE UNDERMINED DUE TO EROSION.

AND SO ONE OF THE AREAS THAT WE IDENTIFIED WAS ALONG JONES CREEK OR JONES BRANCH.

AND THEN WE BASICALLY HIRED A CONSULTANT FOR CONCEPTUAL THOUGHTS OR IDEAS TO DO SOME INITIAL SITE INVESTIGATION.

THEY PROVIDED A REPORT THAT SAID, YES, THERE ARE SIGNIFICANT EROSION THAT IS ONGOING AND THAT THE EXPOSURE OF THE INFRASTRUCTURE IS SEVERE, THAT IT WOULD BE UNDERMINED AND COMPROMISED. SO IN JUNE OF THIS PAST YEAR, WE WENT AHEAD AND I'M SORRY IN JUNE OF LAST YEAR, WE HIRED A CONSULTANT TO DO FURTHER INVESTIGATION AS WELL AS COME UP WITH ALTERNATIVES TO NOT ONLY ARREST AND REVERSE, BUT ALSO TO PROTECT THE INFRASTRUCTURE MOVING FORWARD.

ONE AREA THAT WE COULD NEVER DO THAT WE LOOKED AT WAS ANY TYPE OF IMPROVEMENTS TO PRIVATE PROPERTY OR TO PROTECT PRIVATE PROPERTY.

THE MAIN REASON WHY IS BECAUSE THE EXTENSIVE WORK WOULD IMPACT DOWNSTREAM PROPERTIES.

IT WAS ALSO JURISDICTIONAL WATERS, WHICH WOULD REQUIRE US ARMY CORPS OF ENGINEER APPROVAL.

AND SO THAT WAS ONE OF THE REASONS WHY.

THE OTHER REASON THAT WE LOOKED AT WAS THE GRADES.

AND OBVIOUSLY, AS YOU KNOW, WITH SANITARY SEWER, YOU HAVE TO HAVE CERTAIN ELEVATIONS.

PART OF THE EFFORTS AND THE OPTIONS THAT WE LOOKED AT WERE THIS THIS ACTUALLY THE PICTURE HERE SHOWS KIND OF LIKE THE EROSION THAT WE'RE TALKING ABOUT.

AND YOU CAN KIND OF SEE THE WATER FLOW THAT WAS ON THE SCREEN AS WELL.

AND SO THE OPTIONS THAT WE'RE LOOKING AT, THIS IS OPTION ONE.

THIS IS CONSIDERED THE MOST ECONOMICAL OPTION, AS YOU WOULD SEE, IS THE RELOCATION OF THE LINE TO THE WEST.

THE REASON WHY THIS OPTION WAS CHOSEN WAS FOR SEVERAL REASONS.

THE OTHER TWO OPTIONS WE LOOKED AT REQUIRED THE INSTALLATION OF LIFT STATIONS, EXTRA INFRASTRUCTURE, AND IT ALSO REQUIRED ADDITIONAL BANK STABILIZATION THAT WOULD HAVE ADVERSE IMPACTS DOWNSTREAM.

SO WHEN WE TALK ABOUT THE MOST ECONOMICAL REPAIR OR OPTION, WE WERE LOOKING AT IT FROM MULTIPLE ASPECTS AND MULTIPLE PERSPECTIVES, KNOWING THAT NONE OF THE OPTIONS THAT WE LOOKED AT WOULD DO ANYTHING TO PROTECT PRIVATE PROPERTY.

THE ONLY BANK STABILIZATION PROJECT THAT WE LOOKED AT WOULD COVER ONLY ABOUT A THIRD OF THE AREA WAS IN IN EXCESS OF $2.2 MILLION DOLLARS.

AND STILL THAT WAS NOT GUARANTEED TO PROTECT THE LINE.

SO THOSE ARE SOME OF THE CHALLENGES THAT WE'RE FACING.

THIS IS THE OPTION THAT LOOKS LIKE THAT WE'RE GOING TO BE PROCEEDING WITH, MAINLY BECAUSE OF THE CONSTRAINTS THAT I ALLUDED TO EARLIER.

SO I MEAN, THE BIG ISSUE HERE IS THAT JONES BRANCH HAS BEEN ERODING.

I MEAN, THAT'S VERY CLEAR.

THAT'S WHY WE'RE DOING THIS PROJECT.

IN GENERAL, WHOSE RESPONSIBILITY IS THAT? SO TYPICALLY WE JUST LET THAT'S NATURAL MIGRATION.

AND SO FOR CONSULTING WITH THE CITY ATTORNEY ON MULTIPLE OCCASIONS, THAT'S NOT SOMETHING THAT WE NORMALLY NOR DO WE WANT TO TOUCH, BECAUSE ONCE WE START CHANGING THE DIRECTION OF THE NORMAL MIGRATION OF THE WATERWAYS, THEN THE CITY BECOMES LIABLE AND RESPONSIBLE FOR EVERYTHING DOWNSTREAM.

YES, SIR. AND IT'S A VIOLATION OF THE TEXAS ADMINISTRATIVE CODE.

SURE. AND SO THOSE ARE MAIN REASONS WHY IT'S NOT THAT WE DO NOT WANT TO, EXCEPT THE LAW SAYS THAT WE CANNOT CHANGE THE WATER FLOW DIRECTION.

SO IS IT THE STATE'S RESPONSIBILITY? IS IT THE ARMY CORPS? LIKE WHERE DOES THE RESPONSIBILITY LIE IN GENERAL, OR IS THAT JUST CONSIDERED PART OF, YOU KNOW, JUST NORMAL EROSION? PART OF I MEAN, I DON'T KNOW.

YES, SIR. REGRETFULLY, THE NORMAL MIGRATION OF CREEKS AND RIVERS HAPPENS NATURALLY.

SO THERE'S NO ENFORCEMENT OF KEEPING IT FROM PRIVATE PROPERTY OR PUBLIC PROPERTY OR REFRAINING FROM KEEPING IT FROM PUBLIC INFRASTRUCTURE.

THAT'S WHY WE'RE EMBARKING ON THIS PROJECT.

BUT REGRETFULLY, BECAUSE OF THAT AND THE NON-REGULATORY ASPECT OF LETTING THE WATER MIGRATE AS IT NATURALLY DOES, WE UNFORTUNATELY

SO YOU'RE SAYING WE SEE EROSION LIKE THIS OTHER PLACES IN THE CITY? YES, SIR. SO WHAT KIND OF COMMUNICATIONS ARE YOU GUYS ENGAGING IN AS FAR AS THE PROJECT GOES? ARE YOU TALKING TO EVERYBODY WHO'S AFFECTED ALL THE PROPERTY OWNERS? TALK TO US A LITTLE BIT ABOUT THAT.

YES, SIR. SO WHEN THE SURVEY TEAMS SO WHENEVER IT COMES TO PRIVATE PROPERTY, WE WILL ALWAYS REQUEST PERMISSION TO ACCESS PRIVATE PROPERTY.

WE WILL NEVER GO ON OUR OWN.

THE SURVEY TEAMS ARE REQUIRED TO NOTIFY THE RESIDENTS.

WE ALSO HAD SOME COMMUNICATIONS OUT NOTIFYING RESIDENTS AS WELL.

WE UNDERSTAND THAT SOME OF THE RESIDENTS EITHER WERE NOT AWARE OF IT, AND THAT'S SOMETHING THAT WE'RE LEARNING TO CLOSE THE GAP ON.

BUT TYPICALLY IN OUR NORMAL PATTERN IS TO INFORM RESIDENTS VIA COMMUNICATIONS, BY HANDOUTS, FLIERS IF WE CAN, VIA EMAILS OR OTHER MEANS OF COMMUNICATION TO LET FOLKS KNOW WHAT WE'RE DOING, WHY WE'RE DOING IT, AND ALSO HAVE AN HONEST AND FORTHRIGHT CONVERSATION.

THE DIFFICULTY IN THE PART OF THAT IS THAT WHEN IT BECOMES PRIVATE PROPERTY, THAT'S A TOTALLY DIFFERENT DISCUSSION AND THAT'S NEVER SOMETHING THAT WE CAN EXPEND PUBLIC FUNDS TO IMPROVE.

I GUESS MY ASK WOULD BE TO MAKE SURE THAT YOU GUYS, BEFORE YOU START THE PROJECT, REDOUBLE YOUR EFFORTS IN COMMUNICATING AND COMMUNICATING THE IMPACT TO THE PROPERTY OWNERS AS FAR AS THE SCHEDULE GOES AND THE TIME FRAME.

AND THERE'S GOING TO BE A LOT OF MOVING PARTS, OBVIOUSLY, AND JUST MAKE SURE THAT YOU'RE IN GOOD COMMUNICATION WITH THEM.

THE SECOND REASON, AND TO ANSWER YOUR QUESTION, SIR, IS IT IS THE MOST ECONOMICAL BASED ON WHAT WE'RE SEEING IN THE AGGRESSIVENESS OF THE EROSION.

NOW, THERE ARE OPTIONS ALSO THAT WE'RE LOOKING AT RELOCATING IT AND ALSO DOING SOME STABILIZATION IN AREAS THAT ARE MOST EFFECTIVE.

SO WE'RE LOOKING AT RELOCATING IT.

AND THEN WHEN THERE ARE AREAS THAT ARE THAT CAN BE APPROVED WITHOUT ADVERSELY IMPACT DOWNSTREAM PROPERTIES.

AND THAT ARE NOT ON PRIVATE PROPERTY.

THERE ARE SOME IMPROVEMENTS THAT WILL EXTEND THE LIFE OF THIS REPAIR.

JUST LIKE ANYTHING, THOUGH, IS THAT NO MATTER WHERE WE MOVE THE LINE WHEN WE HAVE TO LOOK AT ELEVATIONS.

SO TWO THAT, WE HAVE TO LOOK AT THE IMPACTS BECAUSE LIFT STATIONS WOULD BE GOING INTO PRIVATE PROPERTY AND ONTO PEOPLE'S YARDS AND INTO THEIR RESIDENTS AND THAT'S SOMETHING THAT WE DETERMINE IS JUST NOT SOMETHING THAT WE WANT TO DO.

ONE OF THE VARIANCES ASSOCIATED WITH THE SITE PLAN IS TO DEFER BUFFER YARDS THAT WOULD ADDRESS THE ENTIRE PERIMETER OF THEIR PLATTED LOT BOUNDARY.

GIVEN THE HOUSE BILL APPROVED IN THE 86TH LEGISLATURE, OUR ORDINANCE WOULD REQUIRE MASONRY ON ANY FACADE THAT HAS FRONTAGE ON A STREET AND THIS IS 100% METAL BUILDING HERE.

WE CANNOT IMPOSE THE MASONRY ORDINANCE DUE TO THAT HOUSE BILL PREEMPTION.
