[3. Sister Cities Tome Exchange Update]
ALL RIGHT. SO WE'LL GET STARTED WITH OUR WORK SESSION.THANK YOU GUYS FOR BEING HERE.
GOOD EVENING. HONORABLE MAYOR AND CITY COUNCILMEMBERS.
IT'S AN HONOR FOR ME TO INTRODUCE THE SISTER CITIES IN THE TOME DELEGATION.
THEY'RE JUST GOING TO REPORT ABOUT THE WONDERFUL TRIP THAT WE JUST HAD BACK IN JUNE.
AND FIRST OF ALL, I JUST WANT TO THANK YOU FOR THIS GREAT OPPORTUNITY.
WE HAD A VERY UNIQUE, YOU KNOW, CULTURAL AND EDUCATIONAL EXPERIENCE.
YOU KNOW, THAT I CAN SAY TOO MUCH DETAILS.
BUT WITHOUT FURTHER ADO, I'M JUST GOING TO, YOU KNOW, INTRODUCE YOUTH AMBASSADOR ALLISON BEDWELL AND YOUTH AMBASSADOR KATE PONZO, AND THEY'RE GOING TO TELL THE STORY ABOUT THIS WONDERFUL TRIP.
THANK YOU. ALL RIGHT, ALLISON, TAKE IT AWAY.
OKAY. OH, I THINK THAT WAS SUPPOSED TO BE LAST SLIDE.
OKAY, SO THE FIRST THING KIND OF THAT WE'RE TOUCHING ON IS THE FOOD.
AND WE HAD SO MUCH GOOD FOOD OVER THERE, THEY FED US VERY WELL.
WE ALWAYS HAD FOOD OFFERED TO US.
SO SOME OF THE HIGHLIGHTS ARE THE MISO ICE CREAM YOU CAN SEE ON THE BOTTOM RIGHT.
AND THEN ALSO ON THE TOP RIGHT IS WE HAD A VERY LARGE SUSHI ROLL PROVIDED TO US BY A SUSHI CHEF THAT WE GOT TO MAKE AT OUR WELCOME PARTY. THAT WHOLE THING IS A SUSHI ROLL? THAT'S A VERY LONG SUSHI ROLL.
AND IT WAS NOT ONLY DELICIOUS, BUT ALSO REALLY FUN EXPERIENCE.
AND THEN ANOTHER BIG THING IS WE DID NOT USE FORKS OR WE DID USE SPOONS.
SO ONE OF THE THINGS THAT I REALLY WANTED TO TOUCH ON IS THE PEOPLE LIKE EVERYONE WAS ABSOLUTELY LOVELY, LIKE VERY GENEROUS AND VERY ATTENTIVE TO BASICALLY EVERYTHING THAT WE NEEDED, ESPECIALLY THE HOST FAMILY.
I KNOW ALLISON BROUGHT THIS, LIKE, HUGE SUITCASE WITH HER.
WE WERE VERY WORRIED THAT IT WOULD NOT GET FILLED.
SO YEAH, IT WAS VERY, VERY COOL.
WE DID A LOT OF DIFFERENT EVENTS WHEN WE WERE THERE.
THE FIRST THING YOU SEE ON THE LEFT IS A PICTURE OF US AT THE CITY HALL.
AND A THING THAT WAS REALLY INTERESTING ABOUT THE CULTURE THERE IS ALL THE JAPANESE PEOPLE REALLY LOVED IT WHEN WE GAVE SPEECHES, SO WE GAVE MULTIPLE SPEECHES EITHER IN JAPANESE OR WITH A TRANSLATOR, WHICH WAS VERY FUN.
[00:05:04]
WE DID, I DON'T KNOW, MAYBE 3 OR 4 THROUGHOUT THE WHOLE TRIP.IT WAS A LOT. AND THEN THE MIDDLE PICTURE IS US IN THE SCHOOL.
THAT WAS DEFINITELY A HIGHLIGHT OF OUR TRIP.
THE KIDS WERE SO NICE AND THEY WERE REALLY FUNNY AND REALLY NICE TO KNOW AND IT WAS REALLY FUN.
AND LIKE ALLISON SAID, WE ACTUALLY ENDED UP GIVING A FEW SPEECHES IN JAPANESE, WHICH WAS A BIT INTIMIDATING, ESPECIALLY WITH LIKE THE MAYOR, WHICH IT WAS, IT WAS SOMETHING. BUT THEY WERE VERY HAPPY TO SEE US ENGAGING IN THEIR CULTURE, ESPECIALLY WITH ALL THE ACTIVITIES WE ENDED UP DOING.
WE DID A LOT OF CALLIGRAPHY AT A CERTAIN POINT, AND I GUESS I WAS LUCKY IN THAT I HAD SOME EXPERIENCE ALREADY WITH CHINESE, AND THAT WAS VERY INTERESTING BECAUSE I WAS ABLE TO SORT OF RELATE A LOT OF THEIR MORE HISTORICAL CULTURAL INFORMATION WITH CHINESE HISTORY, LIKE WE ENDED UP DRAWING THE CHARACTER SHUI, WHICH IS WATER.
AND AGAIN, I WAS VERY LUCKY THAT I HAD A BIT OF AN EDGE OVER ALLISON.
[LAUGHTER] BUT YEAH, AND WE GOT TO VISIT SO MANY DIFFERENT CULTURAL SITES AND TEMPLES AND THERE WAS JUST SO MUCH NATURE WHICH SEEMS LIKE A REALLY IMPORTANT PART OF THEIR SORT OF CULTURE OR SPIRITUALITY TYPE INTERESTS, WHICH I THOUGHT WAS AN INTERESTING CONTRAST BETWEEN US AND THEIR CULTURE.
AND SO. QUESTION WHERE DID YOU GUYS LEARN JAPANESE? DID YOU STUDY IT FOR THE TRIP OR DID YOU ALREADY KNOW IT BEFORE YOU WENT OR? WE PRACTICED A LITTLE BIT BEFOREHAND.
IT WAS VERY LIKE LEARNING AS WE WENT IN TERMS OF WHAT TO SAY.
LIKE OBVIOUSLY, LIKE, THANK YOU FOR HAVING US.
LIKE WE'RE SO GLAD TO BE HERE IN JAPAN.
LIKE IT'S SO FUN AND EXCITING TO LIKE, YOU KNOW, BE ABLE TO VISIT.
YEAH, MORE JAPANESE THAN ANY OF US SPEAK.
I GUARANTEE YOU THAT. PROBABLY.
THEY WERE VERY IMPRESSED WITH EVERYTHING WE DID.
LIKE WE GOT COMPLIMENTED ON USING CHOPSTICKS.
OH, YEAH. AND THEN WE WANTED TO PRESENT A GIFT FROM THE MAYOR OF TOME, AND IT'S RIGHT HERE.
THANKS. WHAT IS THE MAYOR'S NAME? SO I'M SHALL I OPEN THIS NOW OR SHOULD I WAIT? I DON'T KNOW. I KIND OF WANT TO OPEN IT NOW.
IS THIS GOING TO BE AWKWARD? OKAY.
THIS IS LIKE WATCHING SOMEBODY ELSE [INAUDIBLE].
[INAUDIBLE] EXACTLY HOW TO DO THIS.
WHAT IS IT? WHAT IS THIS? IS THIS DECORATION? BUT WHAT IS IT? YEAH. THAT'S AMAZING.
THAT'S BEAUTIFUL. WELL, VERY GOOD.
WE'LL HAVE TO SEND THEM SOMETHING IN RETURN.
THANK YOU GUYS VERY MUCH FOR THIS.
COUNCIL WAIT BEFORE YOU GUYS LEAVE? COUNCIL, ANY QUESTIONS OR COMMENTS ABOUT.
WELL, THANK YOU GUYS FOR REPRESENTING SOUTHLAKE SO WELL.
I WAS JUST WONDERING IF IF YOU WANTED TO SPEAK TO WHAT'S COMING UP.
SAY A FEW WORDS. LET EVERYBODY KNOW.
IT'S PRETTY EXCITING. OKAY, SO WE HAVE DELEGATES FROM TOME CITY COMING HERE ON OCTOBER 31ST.
SO WE'RE ACTUALLY GETTING TO HOST SOME OF THE PEOPLE THAT WE GOT TO SEE OVER THERE.
I'M ACTUALLY GETTING TO HOST WHO I STAYED WITH, WHICH IS REALLY INCREDIBLE.
SO WE'RE GOING TO HAVE A GREAT TIME.
WELL, HOPE YOU GUYS GOT A LOT OUT OF THE EXPERIENCE.
AND THANK YOU FOR PARTICIPATING AND THANK YOU FOR REPRESENTING SOUTHLAKE SO WELL.
[4. Southlake Chamber of Commerce Update]

ALL RIGHT. WE'LL SEE YOU IN A MONTH AT OKTOBERFEST.
[5. Discuss all items on tonight's agenda. No action will be taken and each item will be considered during the Regular Session.]
WITH THAT, WE'LL MOVE ON TO WORK SESSION AGENDA ITEM NUMBER FIVE, WHICH IS THE CONSENT AGENDA.[00:15:02]
COUNCIL MEETING. ITEM 4C CANCEL THE NOVEMBER 21ST, 2023 REGULAR CITY COUNCIL MEETING AS THAT IS THE WEEK OF THANKSGIVING.ITEM 4E APPROVE ANNUAL CONTRACT RENEWAL FOR DISASTER DEBRIS REMOVAL AND DISPOSAL SERVICES FOR D&J ENTERPRISES PRIMARY AWARD AND DRC EMERGENCY SERVICES AND TFR ENTERPRISES AS SECONDARY AWARDS.
ITEM 4F APPROVE CONTRACT AWARD FOR EMERGENCY BULK DRINKING WATER SERVICES TO LIPSEY TRUCKING.
ITEM 4G RESOLUTION NUMBER 23-021 ANNUAL REVIEW OF INVESTMENT POLICY AND INVESTMENT STRATEGIES.
ITEM 4J. ORDINANCE NUMBER 480-807 ZA 23-0048 FIRST READING ZONING CHANGE AND CONCEPT PLAN FOR 1548 RANDALL MILL AVENUE. ITEM 4K EXCUSE COMMISSIONER MICHAEL SPRINGER FROM THE SEPTEMBER 7TH, 2023 REGULAR MEETING.
ITEM 4M ORDINANCE NUMBER 1278 FIRST READING DEDICATING A SANITARY SEWER EASEMENT AND A TEMPORARY CONSTRUCTION EASEMENT TO TRINITY RIVER AUTHORITY ON LOT 30, BLOCK ONE, KIRKWOOD HOLLOW EDITION.
AND ITEM 4N RESOLUTION NUMBER 23-018 AMENDING THE FEE SCHEDULE.
OKAY, COUNCIL. ANYTHING ELSE WE WANT TO PUT ON CONSENT? YES, MAYOR AND COUNCIL. I'D LIKE TO RECOMMEND PUTTING ON CONSENT RESOLUTION NUMBER 2 3-022, AUTHORIZING PURCHASES FOR THE 2024 FISCAL YEAR AND AUTHORIZING THE CITY MANAGER TO ENTER CONTRACTS NECESSARY TO EFFECTUATE SAID PURCHASES.
OKAY. SHANA YOU WANT TO GIVE US JUST A 30 SECOND RUNDOWN OF THAT ONE? YES, MAYOR, MEMBERS OF THE COUNCIL, THIS IS A CONCEPT THAT REALLY IS A PROCESS IMPROVEMENT.
IT'S DESIGNED TO INCREASE EFFICIENCY.
YOU HAVE APPROVED ON FIRST READING AND WILL CONSIDER SECOND READING OF THE BUDGET THIS EVENING, WHICH DETAILS THESE PURCHASES AND AUTHORIZES THOSE TO BE INCLUDED IN THE BUDGET.
AND SO WITH THE APPROVAL OF RESOLUTION NUMBER 23-022, YOU WILL BE PRE AUTHORIZING THE CITY MANAGER TO APPROVE THE EXPENSES THAT YOU HAVE INCLUDED IN THE BUDGET.
I'LL BE HAPPY TO ANSWER ANY QUESTIONS.
AND SO THIS IS IN LIEU OF US READING THESE VERY, VERY LENGTHY CONSENT AGENDA ITEMS IN OCTOBER AND NOVEMBER WHEN WE'RE BASICALLY DOING WHAT BASICALLY WE'RE TRYING TO MAKE A REDUNDANT PROCESS A LITTLE BIT MORE EFFICIENT WITHOUT GIVING UP THE CHECKS AND BALANCES.
PERFECT. ANY QUESTIONS ABOUT THAT COUNCIL? SO THAT'S ITEM 6E THAT'S GOING ON CONSENT.
AND THEN ALAN, MR. TAYLOR. WE HAVE A, THAT'S ITEM 6E IS THE SECOND READING OF CARILLON PARC.
THE ZONING. YES, WHICH WE DENIED ON FIRST READING.
CAN YOU JUST EXPLAIN WHY THIS IS BACK ON THE AGENDA AND WHETHER WE CAN PUT THIS ON CONSENT FOR.
YES. MR. MAYOR, AS YOU AND I HAVE DISCUSSED PREVIOUSLY, AND UNDER THE SOUTHLAKE ZONING ORDINANCE, EACH PARTICULAR REZONING REQUEST IS PRESENTED FOR TWO READINGS BY THE CITY COUNCIL.
CHAPTER 211 OF THE TEXAS LOCAL GOVERNMENT CODE REQUIRES THAT AS AN ELEMENT OF ZONING APPROVAL, THAT AN APPLICANT BE AFFORDED A PUBLIC HEARING IN ORDER TO SEE IF THERE ARE CITIZENS WHO SUPPORT OR WHO OPPOSE THE REQUEST AND WOULD PRESENT INFORMATION, EVIDENCE OR ARGUMENT RELATING TO THE CASE. IN THE CITY OF SOUTHLAKE, WE HOLD AN INITIAL FIRST READING WITHOUT A STATUTORY PUBLIC HEARING.
WE DO NOT ADVERTISE THAT WE ARE SOLICITING CITIZEN COMMENTS ON THESE ITEMS. THE IDEA OF FIRST READING IS TO GIVE THE APPLICANT AN OPPORTUNITY TO LAY OUT THEIR GENERAL PLAN.
THE CITY COUNCIL ASKS QUESTIONS, MAKE SUGGESTIONS, INDICATES THINGS THEY ARE UNCOMFORTABLE WITH, AND THE APPLICANT FREQUENTLY COMES BACK ON SECOND READING WITH REVISIONS TO THEIR PROPOSED ZONING CHANGE TO RESPOND TO THE COUNCIL'S CONCERNS.
AND THEN A PUBLIC HEARING IS HELD.
IN THIS INSTANCE IN THE CARILLON CASE ON FIRST READING, THE COUNCIL VOTED TO DENY THE REQUEST AND ON THAT BASIS, NORMALLY YOU WOULD THINK THE CASE DIES.
[00:20:02]
BUT BECAUSE THE STATE LAW MANDATES THAT A PUBLIC HEARING MUST BE HELD ONCE WE'VE INITIATED THE PROCESS UNLESS THE APPLICANT OR THE PERSONS SPONSORING THE REQUEST WITHDRAWS THE REQUEST IT IS PLACED ON OUR AGENDA.AS I'VE PREVIOUSLY ADVISED, THE CITY COUNCIL DEVELOPMENT REGULATIONS ARE SORT OF UNUSUAL.
THEY HAVE THEIR OWN RITUAL FORM THAT HAS TO BE FOLLOWED FOR EACH TYPE OF REGULATION.
IF THE OWNER WITHDRAWS THE PLAT, THE MATTER IS DEAD BECAUSE THE CITY NO LONGER HAS JURISDICTION.
IN A ZONING CASE HOWEVER, THE PROPERTY OWNER CAN MAKE THE REQUEST OR A CITY CAN COME FORWARD WITH A PROPOSAL TO REZONE PROPERTY. AND EITHER PARTY CAN ADVANCE THE REQUEST.
IN THIS PARTICULAR CASE INVOLVING CARILLON, THE CASE WAS PRESENTED ON FIRST READING AND NOTICE WAS PUBLISHED OF A PUBLIC HEARING TO BE HELD AT SECOND READING. THE CASE WAS VOTED FOR DENIAL IN FIRST READING, BUT WE ALREADY HAD THE SCHEDULED PUBLIC HEARING.
THEY NO LONGER WISH TO PURSUE IT.
AT THIS POINT, THE ONLY THING REMAINING IS FOR THE ONLY OTHER POSSIBLE APPLICANT, THE CITY COUNCIL, TO DETERMINE IF THEY WANTED TO PROCEED WITH A ZONING CHANGE.
AND IT'S NOT NECESSARY TO HOLD THE PUBLIC HEARING.
BUT JUST TO BE CLEAR, YOU'RE TALKING ABOUT A THEORETICAL APPLICANT.
OBVIOUSLY, NOTHING WE'VE DONE AS A CITY HAS ADVANCED THIS CASE.
THAT IS CORRECT. YEAH. SO WHAT YOU'RE SAYING IS WE CAN PUT IT ON CONSENT.
IS THERE ANYBODY WHO OBJECTS TO PUTTING THIS ON CONSENT FOR THE SECOND READING TONIGHT? OKAY, LET'S GO AHEAD AND PUT THE DENIAL ON CONSENT THEN.
OKAY. MAYOR AND COUNCIL, I RECOMMEND WE MOVE ORDINANCE NUMBER 480-564 F ZA 23-0045 SECOND READING ZONING CHANGE AND DEVELOPMENT PLAN FOR CARILLON PARC.
ANYTHING ELSE COUNCIL? ALL RIGHT.
[1. Call to order]
[ 2.A. Executive Session]
AND FIRST THINGS FIRST, WE WILL GO INTO EXECUTIVE SESSION.SO AS MAYOR, I HEREBY ADVISE YOU THAT WE ARE GOING INTO THE EXECUTIVE SESSION PURSUANT TO THE TEXAS GOVERNMENT CODE, SECTION 551.071 TO SEEK LEGAL ADVICE FROM THE CITY ATTORNEY AND SECTION 551.072 TO DELIBERATE REGARDING REAL PROPERTY MATTERS AND SECTION 551.087 TO DELIBERATE REGARDING ECONOMIC DEVELOPMENT NEGOTIATIONS.
I'LL CALL THIS REGULAR SESSION BACK TO ORDER.
IS THERE ANY ACTION NEEDED OUT OF EXECUTIVE SESSION? NO, MAYOR. GREAT.
MOVING ON TO ITEM 3A THEN MAYOR'S REPORT.
[3.A. Mayor's Report]
JUST A QUICK NOTE ABOUT MAYOR'S REPORT.MISS PILAR, IF YOU COULD PUT THAT GRAPHIC ON THE SCREEN.
SO I WANT TO INVITE EVERYBODY SINCE THERE ARE A LOT OF PEOPLE IN THE AUDIENCE AND I HAVE A CAPTIVE AUDIENCE TO COME ON OUT ON THURSDAY TO THE MARQ FOR OUR SECOND ANNUAL STATE OF THE CITY ADDRESS.
WE'LL BE GOING FOR ABOUT AN HOUR STARTING AT 5:30.
SO HIGHLY ENCOURAGE IF YOU'VE GOT A MINUTE TO COME ON OUT, IT'LL ALSO BE BROADCAST SO YOU CAN WATCH IT LIVE AND IT'LL BE RECORDED SO YOU CAN DOWNLOAD IT AND LISTEN TO IT ON THE WAY TO WORK OR WHATEVER. BUT WE WANT TO CONTINUE TO MAKE SURE THAT WE ARE COMMUNICATING WITH YOU GUYS HOWEVER WE CAN AND IN THE MOST EFFECTIVE AND EFFICIENT WAY POSSIBLE.
SO IF YOU ARE FREE ON THURSDAY NIGHT, WE'D LOVE TO SEE YOU AT 5:30 AT THE MARQ.
ALL RIGHT. WELL, THAT'S THE MAYOR'S REPORT.
I'LL MOVE ON TO THE CITY MANAGER'S REPORT.
[ 3.B. City Manager's Report]
ITEM 3B, MS. YELVERTON.YES, MAYOR, MEMBERS OF THE COUNCIL.
IT'S A BITTERSWEET EVENING FOR US BECAUSE CHRIS TRIBBLE HAS ANNOUNCED THAT HE INTENDS TO RETIRE EFFECTIVE OCTOBER 1ST, AND WE WANT TO HONOR HIM TONIGHT FOR HIS SERVICE WITH THE CITY OF SOUTHLAKE SPANS 17 YEARS.
AND I DON'T KNOW HOW MANY PEOPLE IN THE COMMUNITY THAT HAVE WORKED WITH HIM KNOW THAT BY THE TIME HE GOT TO SOUTHLAKE, HE ALREADY HAD 20 YEARS OF PARK AND RECREATION LEADERSHIP EXPERIENCE.
HE STARTED HIS WORK BACK IN 1985 WITH THE CITY OF MESQUITE.
[00:25:10]
PROGRAMS THAT ARE ASSOCIATED WITH THAT DEPARTMENT.SO JUST A COUPLE OF STATISTICS.
WE CURRENTLY OFFER MORE THAN 1,200 RECREATION PROGRAMS PER YEAR.
WE HAVE SEVEN ATHLETIC ORGANIZATIONS THAT HE AND HIS TEAM WORK WITH.
WE HOST AN AVERAGE OF 300 EVENTS AT LEGENDS HALL ANNUALLY, AND HE MANAGES THE NEEDS OF 12,500 MEMBERS OF CHAMPIONS CLUB. WE ALSO HAVE A NATURE CENTER, A SENIOR CENTER, AND WE MAINTAIN OVER 1100 ACRES OF PARK LAND.
AND I THOUGHT THAT BEFORE WE ASK HIM TO COME UP AND MAKE SOME COMMENTS THIS EVENING, MAYBE WE COULD OPEN IT UP TO COUNCIL TO RECOGNIZE CHRIS AND THANK HIM FOR HIS SERVICE. YEAH, THANK YOU SO MUCH, SHANA.
WELL, I'LL GO FIRST. CHRIS, IT'S BEEN AN ABSOLUTE PLEASURE WORKING WITH YOU.
IT'S BEEN EIGHT, EIGHT AND A HALF YEARS.
AND YOU KNOW WHAT I LOVE ABOUT YOUR SERVICE PARTICULARLY, AND I IMAGINE YOU FIND IS REALLY MEANINGFUL, IS THE FACT THAT YOUR FINGERPRINTS ARE EVERYWHERE, LIKE SHANA SAID, YOU KNOW, FROM THE PARKS TO THE MANAGEMENT OF THE RECREATION FACILITIES TO THE CONSTRUCTION OF THESE AMAZING BUILDINGS.
I MEAN, A LOT OF WHAT THE CITIZENS VIEW AS REALLY GREAT PIECES OF OUR QUALITY OF LIFE YOU'VE EITHER DEVELOPED OR IMPROVED OR YOU MAINTAIN OR ALL THE ABOVE. AND YOU KNOW, YOU ALSO ARE ON THE FRONT LINES OF SO MUCH CUSTOMER SERVICE INTERACTING WITH OUR CUSTOMERS IN SO MANY DIFFERENT WAYS, AND WE JUST CAN'T THANK YOU ENOUGH FOR YOUR SERVICE.
WE'RE GOING TO MISS YOU AROUND HERE MIGHTILY.
I KNOW IT'S NOT GOODBYE YET. WE GOT ANOTHER PARTY, I THINK, COMING UP, WHICH WE'RE EXCITED ABOUT.
BUT FROM THE BOTTOM OF MY HEART, THANK YOU SO MUCH FOR EVERYTHING YOU'VE GIVEN TO THIS CITY.
AND YOUR LEGACY WILL CONTINUE FOR YEARS AND YEARS TO COME.
I JUST WANT TO THANK YOU FOR ALL YOUR YEARS OF SERVICE.
BUT I ALSO FEEL BLESSED, SO IT'S BEEN GREAT TO WORK WITH YOU.
IT'S PRETTY EXCITING FOR OUR RESIDENTS.
AND JUST DURING MY TIME ON COUNCIL, JUST ALL THE TIMES I'VE BEEN ABLE TO CALL YOU, ASK QUESTIONS, YOU HAVE SOLUTIONS AND ANSWERS AND YOU'VE JUST BEEN GREAT TO WORK WITH AND OUR CITY IS VERY BLESSED TO HAVE HAD YOU ALL THIS TIME.
I STILL FEEL LIKE YOU MUST BE, YOU KNOW, 35 YEARS OLD.
AND FOR WHOEVER OR WITH WHOEVER, THEY'RE VERY LUCKY TO HAVE YOU.
BUT I WILL SAY I'VE LOVED ALL MY INTERACTIONS WITH YOU.
YOU'VE ALWAYS GOT A SMILE ON YOUR FACE.
IT'S JUST ALWAYS BEEN A JOY TO HAVE ANY TIME, AND ANYTIME I HAD A QUESTION, YOU WERE ALWAYS THERE WITH AN ANSWER, AND IF YOU DIDN'T HAVE IT, YOU WENT AND FOUND IT VERY, VERY QUICKLY. YOU KNOW, WE SHARE SOME COMMON FRIENDS.
MISS FRANCIS BACK THERE IS A HUGE TRIBBLE FAN.
SO THAT MAKES ME A HUGE TREBLE FAN BECAUSE I'M A BIG FRANCIS FAN.
SO ANYBODY SHE LIKES, YOU'VE GOT A PRETTY HIGH BAR.
SO SUPER GLAD FOR YOU, EXCITED FOR WHAT YOU'VE GOT NEXT.
WELL, OF COURSE, I REMEMBER LIKE IT WAS YESTERDAY.
I THINK WE HAD OUR FIRST MEETING.
I THINK JOHN AND I WERE NEWLY ELECTED AS COUNCIL MEMBERS AND WE GOT PART OF THIS KIDS SPORTS LEAGUES TASK FORCE DEALING WITH THE FACILITY, USE AGREEMENTS AND SCHEDULING ALL THE TEAMS ON THE FIELDS.
AND I REMEMBER MY HEAD WAS SPINNING.
I DON'T KNOW HOW JOHN WAS HANDLING IT, BUT YOU WERE JUST YOU WERE JUST GREAT AT JUST GUIDING US AS NEW COUNCILMEMBERS ON THE HISTORY, THE BACKGROUND OF WHY WE DID THINGS THAT WAY AND THE LOGIC BEHIND IT.
I APPRECIATE YOU WORKING WITH ME AND HELPING ME AS A NEW COUNCIL MEMBER ALL THE WAY THROUGH PRESENT.
SO I WISH YOU ALL THE BEST AND PLEASE STAY IN TOUCH AND YOUR SERVICE IS MUCH APPRECIATED.
WELL, THIS WILL BE A VERY SELF-SERVING GOODBYE.
MANY PEOPLE MAY NOT KNOW THIS.
WHEN I WAS RUNNING FOR OFFICE, I WOULD PUT THESE POSTS UP OCCASIONALLY.
[00:30:03]
ABOUT A VOTE FOR ME MEANS A VOTE FOR A BASS IN EVERY LAKE IN SOUTHLAKE.I DIDN'T KNOW WE HAD THAT MANY PARKS AND MANY OF WHICH HAD BASS IN THEM.
WHAT'S BEEN I WAS ENJOYING INTERACTING WITH SENIOR LEADERSHIP BECAUSE I ALWAYS SAY AND I SAID THIS TODAY TO A GROUP OF PARENTS, YOU KNOW, WE GET TO SIT ON THE DAIS AND LOOK OUT PRETTY WELL MAYBE THE EXCEPTION TO ME, BUT AND TAKE ALL THE CREDIT.
BUT IT'S THE STAFF THAT REALLY IS THE ENGINE THAT MAKES THIS THING GO.
AND SO I'VE ALWAYS ENJOYED OUR INTERACTIONS.
BUT EVERY MORNING I TAKE OUR DOG TO BOB JONES PARK, AND EVERY EVENING I TAKE HIM TO BOB JONES PARK AND I GET TO INTERACT WITH THE STAFF AND SEE JUST HOW GREAT OF THE JOB THAT THEY'RE DOING. AND I JUST THINK THAT'S EMBLEMATIC OF THE LEADER THAT THEY HAVE IN YOU.
GETTING TO KNOW CHRIS AND WORKING WITH YOU THROUGH ALL THAT TIME AND NOW TEN YEARS ON CITY COUNCIL.
WE'VE WORKED VERY CLOSELY TOGETHER PARKS, SOUTHLAKE, PARKS DEVELOPMENT CORPORATION AND OF COURSE COUNCIL, MANY GROUNDBREAKINGS, MANY RIBBON CUTTINGS. IT'S REALLY BEEN IT'S REALLY BEEN SPECIAL.
AND ONE OF THE THINGS I MENTIONED WAS ALL OF OUR DIRECTORS ARE CERTAINLY UNDER THE MICROSCOPE OF THE COMMUNITY, BUT I CAN'T THINK OF A POSITION THAT'S ANY MORE UNDER THE MICROSCOPE OR SPOTLIGHT THAN THAN YOUR POSITION, BECAUSE THERE'S NOT A PERSON IN THE AUDIENCE OR A PERSON IN THE CITY WHO DOESN'T INTERACT WITH OUR PARKS SYSTEM OR WITH OUR COMMUNITY SERVICES SYSTEM OR THE CHAMPIONS CLUB, OR WHOSE CHILDREN OR GRANDCHILDREN, NIECES AND NEPHEWS HAVEN'T BEEN A PART OF A SPORTS ORGANIZATION THAT THE CITY IS PUTTING ON.
SO YOU'RE CONSTANTLY UNDER THE SPOTLIGHT AND YOU'VE REALLY DONE A FANTASTIC JOB.
I THINK PEOPLE CAN LOOK AROUND OUR CITY, AT OUR PARK SYSTEM AND OUR SERVICES THAT YOUR DEPARTMENT BRINGS FORWARD AND SEE THE QUALITY ALL OVER IT AND YOUR FINGERPRINTS ARE ON THAT. AND THAT WAS UNDER YOUR LEADERSHIP.
SO WE APPRECIATE THAT, BUT I APPRECIATE OUR FRIENDSHIP AND I HOPE THAT CONTINUES.
LOOKING FORWARD TO SEEING WHAT THAT IS AND LOOK FORWARD TO SEEING YOU EXCEL.
CHRIS, WOULD YOU LIKE TO STEP FORWARD? BEFORE I GET STARTED I JUST WANT TO VERIFY THAT NO FISH WERE HARMED WHEN WE DID THAT. I MAKE SURE THAT'S VERY CLEAR TO ANYONE.
I WAS WONDERING, IS THAT IS THAT LEGAL OR DO WE NEED TO ASK CHIEF OR.
IT WAS A POPULATION STUDY THAT WE DID.
A POPULATION STUDY OKAY. THEY WERE NOT HARMED IN ANY WAY, SHAPE OR FORM.
SO MAYOR AND COUNCIL AND SHANA, I REALLY APPRECIATE YOUR KIND WORDS.
TREMENDOUS BOARD MEMBERS FROM PARKS AND RECREATION TO PUBLIC ART PLANNING AND ZONING.
AND WE REALLY APPRECIATE EVERYTHING THAT YOU DO AND BEING ABLE TO WORK HAND IN HAND.
SHANA THANK YOU FOR THE OPPORTUNITY THAT YOU'VE GIVEN ME.
I'VE SAID BEFORE THIS WAS KIND OF A DREAM JOB.
I'VE TOLD YOU THAT I'VE REALLY ENJOYED IT.
MY KIDS GREW UP WHEN I WAS IN THIS ROLE.
AND SO THAT WAS THAT WAS ALWAYS A PRIDE MOMENT FOR ME AS WELL.
BUT I JUST WANT TO REALLY SAY THANK YOU, THANK YOU TO MY FELLOW EXECUTIVE LEADERSHIP TEAM.
[00:35:04]
I REALLY APPRECIATE YOUR FRIENDSHIP, YOUR GUIDANCE, YOUR LEADERSHIP.IT'S JUST REALLY BEEN A REALLY WONDERFUL OPPORTUNITY FOR ME HERE.
VICKY SCHEIBER OUR LEADERSHIP, MALINKA MY ASSISTANT.
THE FOLKS THAT YOU HAVE WORKING IN ALL OF THESE DIFFERENT AREAS WITHIN OUR DEPARTMENT AND ACROSS OTHER DEPARTMENTS TAKE A LOT OF PRIDE IN WHAT THEY DO, AND THAT'S WHY THEY'RE SO GOOD AT WHAT THEY DO. AND SO THAT COMES FROM YOUR LEADERSHIP, YOUR GUIDANCE, THE WAY WE MOVE FORWARD WITH METHODICALLY UNDERSTANDING WHAT OUR COMMUNITY WANTS AND HOW WE GO ABOUT DELIVERING THAT.
THANK YOU. ABSOLUTELY. [APPLAUSE] CHRIS, CAN WE GET A PICTURE WITH YOU BEFORE YOU SIT DOWN? ALL RIGHT. COUNCIL COME ON OVER.
ALL RIGHT. MS. YELVERTON IS THAT IT FOR CITY MANAGERS REPORT?.
OKAY. WITH THAT, WE'LL MOVE ON TO OUR CONSENT AGENDA.
[CONSENT AGENDA]
COUNCIL HAS PREVIOUSLY REVIEWED THE ITEMS ON THE CONSENT AGENDA.COUNCIL IS THERE ANY MORE DISCUSSION OR QUESTIONS BEFORE WE HAVE A MOTION? IF NOT, I WILL TAKE A MOTION.
YES, MAYOR AND COUNCIL. I'LL MAKE A MOTION ITEMS 4A THROUGH 4N NOTING THAT WITH RESPECT TO ITEM 6E ORDINANCE NUMBER 480-564F CASE NUMBER ZA23-0045 SECOND READING ZONING CHANGE AND DEVELOPMENT PLAN FOR CARILLON PARC.
THE APPLICANT HAS REQUESTED THAT THIS ITEM BE WITHDRAWN.
WE ARE MOVING ITEM SIX E FROM OUR REGULAR AGENDA TO OUR CONSENT AGENDA AND DENYING ITEM 6 E ALSO NOTING THAT WE ARE MOVING ITEM 6C FROM OUR REGULAR AGENDA TO OUR CONSENT AGENDA AND APPROVING ITEM 6C ITEM SIX C IS RESOLUTION NUMBER 23-022 AUTHORIZING THE PURCHASES FOR THE FISCAL YEAR 2024 AND AUTHORIZING THE CITY MANAGER TO ENTER INTO CONTRACTS NECESSARY TO EFFECTUATE SAID PURCHASES.
WE HAVE A MOTION. IS THERE A SECOND? SECOND, PLEASE CAST YOUR VOTE.
OKAY. CONSENT AGENDA PASSES SIX ZERO.
WITH THAT, WE'LL MOVE ON TO PUBLIC FORUMS. SO PUBLIC FORUM IS THE OPPORTUNITY FOR THE CITIZENS TO ADDRESS COUNCIL ON SOMETHING NOT RELATED TO THE AGENDA.
I KNOW A LOT OF YOU GUYS ARE HERE ON A FEW PARTICULAR AGENDA ITEMS, SO WE'LL GET TO THOSE WHEN WE CALL THOSE AGENDA ITEMS. BUT IF THERE IS ANYONE WISHING TO ADDRESS COUNCIL ON SOMETHING THAT'S NOT ON THE AGENDA, I'LL OPEN UP PUBLIC FORUM.
[5. Public Forum]
YES, MA'AM. COME ON DOWN.AND IF YOU COULD JUST STATE YOUR NAME AND ADDRESS FOR THE RECORD.
OKAY. PATTY MINDER 223 EASTWOOD DRIVE SOUTHLAKE 40 YEAR RESIDENT OF SOUTHLAKE.
I WOULD ASK, HAVE WE MOVED ANY FURTHER ON THE STOPLIGHT WITH THE LEFT TURN SIGNAL AT VILLAGE CENTER DRIVE AND 1709 NOW THAT THE PARENTS ARE USING THE PARKING LOT BEHIND THE SHOPPING CENTER, THEY'RE NOW USING OUR STOPLIGHT TO COME OUT AT 3:30 IN THE AFTERNOON.
AND SOMETIMES WE HAVE 15 TO 20 CARS BACKED UP AT THE LIGHT NOW.
SO I WAS WONDERING, I CALLED TXDOT AND THEY SAID SINCE IT'S A SIDE STREET THAT IT'S THE CITY COUNCIL'S RESPONSIBILITY TO ASK FOR A LEFT HAND TURN. SO I DON'T KNOW WHO'S TELLING ME THE TRUTH.
[00:40:02]
SO HAVE WE GOT ANY FURTHER ON THAT? THIS IS SEVEN YEARS AND MY NEIGHBORS ARE ALL HERE WITH ME.WHAT CAN WE EXPECT? WELL, I'LL TELL YOU WHAT, BECAUSE THIS IS NOT A DISCUSSION ITEM.
WE CAN'T TALK ABOUT IT OR DELIBERATE.
WHY DON'T I HAVE STAFF FOLLOW UP WITH THAT WITH YOU ON THAT PARTICULAR ISSUE? CAN I DO THAT? OKAY. SOUNDS GREAT.
MISS SHANA, WILL YOU ROUTE THAT REQUEST TOO`.
OKAY. THANK YOU. THANK YOU SO MUCH.
IS THERE ANYONE ELSE WISHING TO SPEAK AT PUBLIC FORUM? OKAY. SEEING NONE, I'LL CLOSE THE PUBLIC FORUM AND WE WILL MOVE ON TO ITEM 6A AND 6B, 6C WAS PREVIOUSLY PUT ON CONSENT AND PASSED.
[Items 6.A & 6.B]
SO 6A IS ORDINANCE NUMBER 1277 SECOND READING TAX LEVY ORDINANCE 6B IS ORDINANCE NUMBER 1276 SECOND READING APPROVING AND ADOPTING THE ANNUAL BUDGET FOR FISCAL YEAR 2024. THESE ARE BOTH PUBLIC HEARINGS, SO WE WILL TAKE STAFF PRESENTATION ON ALL OF THEM AND THEN WE'LL DO SEPARATE PUBLIC HEARINGS.AS PREVIOUSLY MENTIONED, THERE ARE THREE AGENDA ITEMS 6A APPROVING THE TAX RATE.
6B ADOPTING THE BUDGET AND 6C HAS ALREADY BEEN DISCUSSED AND WAS MOVED APPROVED ON CONSENT.
FIRST, STARTING WITH THE PROPERTY TAX RATE REDUCTION.
WE'RE ALSO MAINTAINING THE HOMESTEAD EXEMPTION AT 20%, WHICH IS THE MAXIMUM ALLOWED BASED ON STATE STATUTE, WHICH REDUCES THE TAXABLE VALUE JUST OVER 200,000 BASED ON THE AVERAGE APPRAISED HOME HERE IN SOUTHLAKE.
AND WITH THIS HOMESTEAD EXEMPTION, GIVES AN ADDITIONAL TAX RATE EQUIVALENT REDUCTION OF 6.4 CENTS, WHICH GIVES A TAX RATE EQUIVALENT RATE OF 25.5 PER $100.
ON THIS SLIDE IS TO GIVE YOU A GREAT DEPICTION OF THE TAX RATE INCENTIVES.
THE TAX RELIEF INCENTIVES THAT WE'VE GIVEN OVER THE YEARS WITH THE TOP GRAPH, IT'S A REFLECTION OF THE APPRAISED VALUE OF ONE POINT, JUST UNDER 1.5 MILLION AND A TAXABLE VALUE OF JUST UNDER 880,000.
BUT THE TAX CITY TAX BILL HAS DECREASED BY 4% IN A TEN YEAR FACTOR.
AND THE CHART BELOW IS BASED OFF OF A HOME APPRAISED VALUE OF JUST UNDER 1.3 MILLION TAXABLE VALUE OF A MILLION, AND THE INCREASE OVER THE TEN YEARS, 78% INCREASE IN ASSESSED VALUE, 47 INCREASE IN TAXABLE VALUE AND JUST A 1% INCREASE IN THEIR TAX BILL OVER A TEN YEAR PERIOD.
NEXT TO TOUCH ON THE OVERALL BUDGET.
THE OPERATING BUDGET PROPOSED BUDGET IS 127 MILLION AND AS STATED PREVIOUSLY IN THE PREVIOUS PRESENTATIONS, IT DOES CONSIST OF NUMEROUS FUNDS WITH THE LARGEST FUND BEING THE GENERAL FUND OF 52.6 MILLION.
NEXT IS UTILITY FUND OF 31.4 MILLION.
AS WITH THE PREVIOUS YEARS, THIS PROPOSED BUDGET HITS ALL OF OUR FINANCIAL GUIDING PRINCIPLES.
BUT ONE THING ABOUT THE GUIDING PRINCIPLES HAS SERVED US WELL.
THERE'S A GREAT EXAMPLE, IS THAT WE HAVE A TRIPLE-A RATING BY ALL THREE RATING AGENCIES, AND PRIMARILY DUE TO THE GUIDING PRINCIPLES THAT WERE ESTABLISHED NUMEROUS YEARS AGO. AND AGAIN, THIS BUDGET IS ALIGNED WITH ALL THE GUIDING PRINCIPLES THAT ARE NOTED ON THE SLIDE.
AND THAT CONCLUDES THE BUDGET PRESENTATION.
I'D BE HAPPY TO ANSWER ANY QUESTIONS THAT YOU MAY HAVE.
COUNCIL ANY QUESTIONS FOR MISS JACKSON? ONCE AGAIN, THANK YOU SO MUCH FOR YOUR HARD WORK.
AND YOU GUYS ARE BEING GREAT FIDUCIARIES FOR THAT REVENUE.
WELL, THESE ITEMS ARE BOTH PUBLIC HEARINGS.
SO IF ANYBODY IN THE AUDIENCE WOULD LIKE TO COME DOWN AND AND TELL MS. JACKSON HOW GREAT OF A JOB SHE'S DOING, YOU'RE ABSOLUTELY WELCOME TO.
SO I'LL CALL THE PUBLIC HEARING ON ITEM 6 A IF ANYBODY WANTS TO SPEAK ON THIS ITEM.
[00:45:03]
SEEING NONE, I'LL CLOSE THE PUBLIC HEARING ON 6 A AND TAKE A MOTION.WE HAVE A MOTION. IS THERE A SECOND? SECOND, PLEASE CAST YOUR VOTE.
GREAT. AND WE'LL CALL ITEM 6B AND OPEN UP A PUBLIC HEARING ON THIS ITEM.
IS THERE ANYONE WISHING TO SPEAK IN THE AUDIENCE ON 6B? SEEING NONE. I'LL CLOSE THE PUBLIC HEARING AND TAKE A MOTION.
YES, MAYOR. COUNCIL. I MAKE A MOTION TO APPROVE ITEM 6B ORDINANCE NUMBER 1276.
WE HAVE A MOTION. IS THERE A SECOND? SECOND, PLEASE CAST YOUR VOTE.
ALL RIGHT. ITEM 6 B PASSES 6 TO 0.
THANK YOU SO MUCH FOR A GREAT BUDGET.
CONGRATULATIONS ON FINISHING THAT PART OUT.
AND WE'LL SEE YOU GUYS NEXT BUDGET SEASON.

Current Zoning: "1-2" Heavy Industrial District. SPIN Neighborhood #8.]
KILLOUGH. THANK YOU, MAYOR AND CITY COUNCIL.THIS IS A REQUEST FOR SITE PLAN APPROVAL ON JUST UNDER 34 ACRES LOCATED AT 2000-2120 MUSTANG COURT.
THIS IS JUST NORTH OF STATE HIGHWAY 26.
THE PROPOSAL IS FOR APPROXIMATELY 536,000FTĀ² OF WAREHOUSE SPACE THAT WOULD REPLACE CURRENTLY OPERATING FUEL TANK FARM.
THIS AERIAL PHOTO OF THE SITE.
THE LAND USE DESIGNATION FOR THIS PROPERTY IS INDUSTRIAL.
AND THE CURRENT ZONING IS I2 HEAVY INDUSTRIAL.
THESE ARE SOME PHOTOGRAPHS OF THE SITE FROM STATE HIGHWAY 26 AND LIKEWISE FROM THE INTERSECTION OF 26 AND MUSTANG COURT. AND THIS IS A EXHIBIT OF THE SITE PLAN THAT IS DIVIDED WITH MATCH LINES AND TWO PLAN SETS.
THE PORTION OF THE PLAN ON THE LEFT IS THE NORTHERN PORTION OF THE SITE, AND THAT ONE ON THE RIGHT IS THE SOUTHERN PORTION OF THE SITE CLOSEST TO STATE HIGHWAY 126 AND OR 2026 AND MUSTANG COURT.
THIS IS A SITE DATA SUMMARY OF THE PROJECT AND EXCUSE ME, THAT'S 546,330FTĀ² PROPOSED. AND ELEVATIONS OF THE BUILDINGS.
BUILDING THREE AND BUILDING FOUR.
THESE ARE SOME RENDERED ELEVATIONS OF THE SITE AND BUILDINGS.
THIS IS A VIEW LOOKING IN A NORTH EASTERLY DIRECTION.
AND MUSTANG COURT 26 IS TO THE LOWER RIGHT.
AND ENTRANCE VIEW COMING IN OFF MUSTANG.
THIS IS THE PROPOSED LANDSCAPE PLAN.
NOW, THIS WOULD BE A DETENTION AREA LOCATED IN THIS PORTION OF THE SITE.
AND THIS IS MH ZONE RESIDENTIAL.
PROPERTY JUST TO THE WEST BOUNDARY.
THEY WOULD BE PROPOSING THE STANDARD REQUIRED EIGHT FOOT WIDE SCREENING FENCE AND WOULD BE P
[00:50:01]
LANTING THE REQUIRED PLANTINGS THERE WITH THE TEXAS ASH TREE.THIS IS A EXHIBIT OF THE TREE PLAN.
THE SITE IS COVERED WITH APPROXIMATELY 23% TREE COVER LOCATED IN THE NORTHERN PORTION OF THE SITE, AND THEY ARE REQUESTING A VARIANCE TO REMOVE 100% OF THAT.
THERE WOULD BE ZERO PRESERVATION OF THE EXISTING TREE COVER.
THE PLANNING AND ZONING COMMISSION RECOMMENDED APPROVAL SIX ZERO.
AND WE'VE RECEIVED NO RESPONSES FROM SURROUNDING PROPERTIES.
AND WITH THAT, I'LL BE GLAD TO ANSWER ANY QUESTIONS YOU MAY HAVE.
THANK YOU, DIRECTOR KILLOUGH. COUNCIL ANY QUESTIONS FOR DENNIS? SO THIS CLEAN SITE PLAN OTHER THAN A SLIGHT TREE VARIANCE? YES, SIR. OKAY.
AND THIS IS PURSUANT ONCE AGAIN TO THE ZONING CHANGE THAT WE PUT ON THE PROPERTY.
I MEAN, YEARS AGO AT THIS POINT, CORRECT? YES. YEAH. OKAY.
OKAY, GREAT. IS THE APPLICANT HERE? IF YOU GUYS HAVE A PRESENTATION, YOU CAN COME ON DOWN.
IF HE COVERED EVERYTHING, THAT'S OKAY TOO.
YOU SEEM LIKE YOU REALLY WANT TO TALK.[LAUGHTER] COME ON DOWN.
IF YOU COULD JUST STATE YOUR NAME AND ADDRESS FOR THE RECORD.
I WORK FOR HALFF ASSOCIATES LOCATED AT 1201 NORTH BOWSER IN RICHARDSON.
SO THE ONLY THING I GUESS THAT I WANTED TO SAY WAS ALONG THE RESIDENTIAL AREA ONE THING THAT WASN'T STATED WAS THAT THERE IS A LARGE WALL THAT'S GOING TO BE THERE WHERE OUR SITE IS APPROXIMATELY AT THE HIGHEST POINT, 16FT LOWER THAN THE ADJACENT RESIDENTIAL.
SO IF THERE'S ANY CONCERN ABOUT SCREENING ALONG THAT AREA, IT'S ACTUALLY SCREENED MUCH MORE AS THE HOUSES WILL BE MUCH HIGHER AND WON'T BE ABLE TO SEE AS MUCH OF THE INDUSTRIAL AREA.
BUT OTHER THAN THAT. SO YOU GUYS ARE LOWER THAN THE GRADE OF THE HOUSES? YES, THAT'S CORRECT.
AND WHAT FENCE ARE YOU BUILDING ALONG THE RESIDENTIAL? IT'S A WOOD FENCE IN A SORRY, IN ACCORDANCE WITH THE ZONING.
BUT AVAILABLE FOR ANY QUESTIONS.
COUNCIL. COUNCIL ANY QUESTIONS FOR THE APPLICANT? PRETTY STRAIGHTFORWARD. OKAY.
YOU HAVE SOMETHING TO ADD? COME ON DOWN.
JOHN DELVAC 769 WINDERMERE WAY, KELLER.
I AM THE APPLICANT AND I JUST WANTED TO GIVE ONE ADDED PERK TO THE SITE.
CURRENTLY, THE ACCESS FOR EXPLORERS TANKS, WHICH HOLD DFW AIRPLANE ERA JET FUEL. THAT ACCESS IS OFF OF CONTINENTAL, AND WE HAVE OFFERED AND INTEND TO PROVIDE ACCESS EASEMENT TO EXPLORER TO GO THROUGH OUR SITE TO KEEP THOSE TRUCKS OFF OF CONTINENTAL.
GREAT. WE APPRECIATE THAT. I THOUGHT EVERYBODY WOULD APPRECIATE THAT.
ANY QUESTIONS FOR ME? COUNCIL ANY QUESTIONS FOR APPLICANT NUMBER TWO? OKAY. ALL RIGHT. SOUNDS GOOD, SIR.
THANK YOU SO MUCH. AND THIS WAS YOUR COMMENT CARD, CORRECT? YES. OKAY. SO WE'LL PUT YOU DOWN AS SUPPORTIVE IN THE RECORD.
OKAY. SEEING NONE, I'LL CLOSE THE PUBLIC HEARING.
COUNCIL ANY DISCUSSIONS? IF NOT, I'LL TAKE A MOTION.
YES, MAYOR AND COUNCIL. I MAKE A MOTION TO APPROVE ITEM 6D.
CASE NUMBER ZA 23-0049 SITE PLAN FOR CONSTELLATION SOUTHLAKE FOR PROPERTY DESCRIBED AS TRACKS.
1B01 1B01B 1B01C 1B01C1 1B01C2 1B01D HARRISON DECKER SURVEY ABSTRACT NUMBER 438 CITY OF SOUTHLAKE TARRANT COUNTY, TEXAS, AND LOCATED AT 2100-2120 MUSTANG COURT SOUTHLAKE, TEXAS, SUBJECT TO OUR STAFF REPORT DATED SEPTEMBER 12TH, 2023, AND SITE PLAN REVIEW SUMMARY NUMBER TWO, DATED SEPTEMBER 7TH, 2023, NOTING THAT WITH RESPECT TO THE VARIANCE REQUESTS, THE PROPOSED TREE PRESERVATION DOES NOT COMPLY WITH THE EXISTING TREE COVER PRESERVATION REQUIREMENTS.
[00:55:01]
A TOTAL OF 0% OF THE EXISTING TREE COVER IS PROPOSED TO BE PRESERVED AND NOTING THAT WE'RE APPROVING THE REQUESTED TREE PRESERVATION VARIANCE AS PRESENTED.OKAY, WE HAVE A MOTION. IS THERE A SECOND? SECOND, PLEASE CAST YOUR VOTE.
CONGRATULATIONS. THANK YOU GUYS SO MUCH.
[9.A. City Council confirmation of the City Manager's appointment of Pilar Schank as the Director of Communications.]
SCHANK AS DIRECTOR OF COMMUNICATIONS.THIS IS NOT A PUBLIC HEARING, AND I THINK EVERYBODY SHOULD KNOW THAT WE COULD HAVE PUT THIS ON CONSENT, BUT THEN THAT WOULDN'T HAVE BEEN ANY FUN BECAUSE NOW WE CAN TALK GREAT ABOUT ALL THE WONDERFUL THINGS THAT PILAR DOES AND EMBARRASS HER JUST A LITTLE BIT IN FRONT OF ALL YOU GUYS.
SO LET ME ASK MISS YELVERTON AND I GUESS STACY, WE'LL.
MISS BLACK IF YOU COULD PLEASE PRESENT THIS ITEM HAPPILY.
MEMBERS OF CITY COUNCIL, AS MAYOR SAID, WE'RE HERE TONIGHT TO REQUEST COUNCIL CONFIRMATION OF THE CITY MANAGER'S APPOINTMENT OF PILAR SCHANK AS OUR DIRECTOR OF COMMUNICATIONS.
THE DEPARTMENT HEAD IS APPOINTED BY THE CITY MANAGER, IS CONFIRMED BY CITY COUNCIL, AND THEN THAT DEPARTMENT HEAD WOULD HAVE SUPERVISORY AUTHORITY AND FINANCIAL CONTROL OVER THEIR DEPARTMENT.
JUST A LITTLE BIT ABOUT THE POSITION ITSELF.
THE DEPARTMENT IS THE OFFICE OF COMMUNICATIONS AND CUSTOMER EXPERIENCE.
SO SHE IS OUR GO TO PERSON FOR ALL THINGS PR AND COMMUNICATIONS RELATED.
BUT NOW LET'S TALK A LITTLE BIT ABOUT PILAR.
MISS SCHANK HAS DEMONSTRATED EXCEPTIONAL COMMITMENT AND EXPERTISE THROUGHOUT HER 30 YEAR CAREER IN COMMUNICATIONS, PUBLIC RELATIONS, WRITING AND TV NEWS MEDIA. HER CAREER IN SOUTHLAKE BEGAN IN 2006 WHEN SHE ASSUMED THE ROLE OF COMMUNITY RELATIONS OFFICER.
OVER THE YEARS, SHE HAS PROGRESSIVELY TAKEN ON ROLES OF INCREASING RESPONSIBILITY, INCLUDING COMMUNICATIONS AND WEBSITES MANAGER, DEPUTY DIRECTOR OF PUBLIC RELATIONS, AND MOST RECENTLY, DEPUTY DIRECTOR OF COMMUNICATIONS.
STAFF'S RECOMMENDATION WOULD BE THAT COUNCIL WOULD CONFIRM THIS APPOINTMENT.
AND OF COURSE, I'D BE GLAD TO ANSWER ANY QUESTIONS THAT YOU MIGHT HAVE.
COUNCIL LET ME START BY SAYING WE'RE VERY, VERY HAPPY TO BE VOTING ON THIS ITEM TONIGHT.
AND I WANT TO THANK YOU, PILAR, FOR ALL THE WORK THAT YOU DO.
YOU JUST DO A GREAT JOB IN HELPING US THROUGH TOUGH ISSUES AND ME PARTICULARLY BOTH ON THE CONTENT CREATION SIDE, YOU BRING SUCH A GREAT PROFESSIONAL APPROACH TO HOW WE DO COMMUNICATIONS AND YOU'VE PIVOTED IN ALL KINDS OF DIFFERENT WAYS TO THE SOCIAL MEDIA ERA, AND YOU'VE DONE A WONDERFUL JOB AND RUN A WONDERFUL TEAM, BUT ALSO IN CRISIS MANAGEMENT, PUBLIC RELATIONS, WHEN THINGS COME UP THAT WE NEED MEDIA RELATIONS HELP, YOU'RE ALWAYS THERE AND WE REALLY, REALLY APPRECIATE YOU DO A WONDERFUL JOB AND WE'RE EXCITED THAT YOU'RE CONTINUING THIS ROLE.
SO THANKS FOR AGREEING TO STEP UP.
COUNCIL ANY COMMENTS? YEAH. I ECHO WHAT YOU SAID.
I THOUGHT SHE WAS ALREADY THE DIRECTOR OF COMMUNICATIONS, SO.
[LAUGHTER] AND REALLY, THAT SPEAKS TO ALL THE THINGS THE MAYOR JUST TALKED ABOUT.
YOUR LEVEL OF PROFESSIONALISM, THE WAY YOU LEAD IN THIS AREA AND LEAD OUR CITY AND TAKE CARE OF US RELATIVE TO PR AND COMMUNICATIONS AND ALL THE DIFFERENT THINGS THAT THAT YOU MANAGE IN THOSE AREAS.
GOD BLESS PILAR. I MEAN, IT'S NOT AN EASY JOB.
I MEAN, I'VE WITNESSED IT FIRSTHAND AND YOU DO A PHENOMENAL JOB AT THAT.
AND WE THANK YOU FOR THAT AND FOR EVERYTHING ELSE YOU'RE DOING.
SO THANK YOU AND CONGRATULATIONS.
[01:00:03]
SO PILAR IS PROBABLY THE ONE PERSON I'VE DEALT WITH LONGER THAN ANYONE ON CITY STAFF BECAUSE I WAS ON COMMUNITY ENGAGEMENT COMMITTEE A DECADE AGO WHEN THEY FIRST STARTED IT.AND SO SHE'S BEEN PUTTING UP WITH MY PR NIGHTMARE FOR OVER A DECADE NOW.
MY MOUTH GETS ME IN A LOT OF TROUBLE AND I'M OKAY WITH THAT.
SHE JUST HAS TO LEARN HOW TO HELP ME CONTROL IT.
I LOVE HER AGAIN, KIND OF LIKE CHRIS THE ACCESSIBILITY, THE CHANCE THAT ANYTIME I NEED ANYTHING AT ALL, JUST, HEY, HOW DO I SAY THIS WITHOUT MAKING HALF THE WORLD MAD? YOU HELP ME WALK THROUGH THAT AND GET THAT DONE.
I WOULD HAVE THOUGHT YOU WERE A DIRECTOR, TOO.
SO THAT'S ON US FOR NOT KNOWING THAT.
[LAUGHTER] BUT JUST GLAD YOU'RE HERE AND SUPER HAPPY FOR YOU TO HAVE THIS POSITION NOW.
AGAIN, SIMILAR TO THE COMMENTS ABOUT CHRIS.
I REMEMBER WHEN WE FIRST STARTED WORKING TOGETHER AND WE WERE VERY GREEN, VERY MUCH NEWBIES AND I'M SURE WE MADE A LOT OF MISTAKES AND YOU POLITELY POINTED THEM OUT TO US AND MADE SURE THAT IT WAS A TEACHING MOMENT.
AND YOU'VE GOT A GREAT SENSE OF HUMOR, I MEAN, TO PUT UP WITH US AND SOME OF OUR ANTICS AND WHAT WE THINK IS A GREAT SENSE OF HUMOR MIGHT NOT BE SO, BUT YOU PUT UP WITH IT AND YOUR PATIENCE.
SO THANK YOU FOR ALL YOU'VE DONE AND WHAT YOU'RE GOING TO CONTINUE TO DO FOR US.
I LOVE THAT WE'RE MAKING YOU UNCOMFORTABLE.
[LAUGHTER] RIGHT? SO SO SELFISHLY, AGAIN, TO MAKE THIS ABOUT ME.
I LOVE HAVING A BRAND MANAGER WORKING WITH THE CITY.
I THINK THERE'S THINGS AND I'VE KNOWN THIS FOR YEARS THAT THERE WILL BE THINGS THAT COME UP AND WE NEED TO BE ABLE TO, AS I TOLD THE THE CITY MANAGER, WE NEED TO NOT PUT THE SCHOOL SAYS PROTECT TRADITION.
WE NEED TO BE ABLE TO SPEAK FOR OURSELVES.
AND I LOVE THAT YOU PROVIDE THAT.
SO THANK YOU FOR ALL YOU'VE DONE AND CONTINUE TO DO AND GO BRANDING.
I DO NOTICE THIS PROMOTION COMES ABOUT A YEAR AND A HALF AFTER I STARTED TWEETING A LOT.
I DON'T THINK IT'S CALLED TWEETING ANYMORE, THOUGH.
I DON'T EVEN KNOW. I DON'T KNOW. I'LL TWEET ABOUT THAT LATER.
I MEAN, WHEN I THINK ABOUT PILAR, I THINK OF THE CONSUMMATE PROFESSIONAL.
I MEAN, IT'S WONDERFUL WHEN YOU CAN GO TO A STAFF MEMBER AND IN THIS CASE, YOU KNOW, THE DIRECTOR OF OUR COMMUNICATIONS WHOLE PROCESS AND JUST HAVE FULL CONFIDENCE. YOU JUST KNOW THAT YOU CAN TRUST HER AND SHE UNDERSTANDS THE SITUATION AND SHE'S GOING TO LOOK DOWNSTREAM FOR WHAT ARE THE IMPLICATIONS OF WHAT WE'RE DOING AND WHAT YOU MAY OR MAY NOT SAY.
WHEN YOU WHEN YOU SIT UP HERE.
AND I ALSO APPRECIATE THE FACT THAT YOU AND YOUR TEAM, ANY TIME WE SPEAK OR SPEAK PUBLICLY, THE TIME AND THE EFFORT THAT GOES INTO THE BACKGROUND WORK YOU PUT INTO THAT TO PROVIDE TALKING POINTS AND KNOWING THAT IN MOST CASES WE'RE GOING TO WANDER OFF AND GO IN DIFFERENT DIRECTIONS, BUT GIVING US THOSE TO KIND OF KEEP US GUIDED IS SO VALUABLE.
AND WE APPRECIATE THAT. SO CONGRATULATIONS.
DIRECTOR SCHENCK, WOULD YOU CARE TO SAY ANYTHING? YOU DON'T HAVE TO.
I'M TRULY HONORED, TRULY HONORED TO BE A PART OF THE SOUTHLAKE TEAM AND SPECIFICALLY THE OFFICE OF COMMUNICATION AND CUSTOMER EXPERIENCE. I'VE LEARNED SO, SO MUCH FROM WORKING HERE AND WHEN I WAS HIRED IN 2006. I NEVER WOULD HAVE THOUGHT THAT A LONG CAREER IN CITY GOVERNMENT WAS GOING TO BE MY LEGACY.
AND LIKE CHRIS, MY MY BABIES HAVE GROWN UP HERE AND I KIND OF TIME THEM ACTUALLY TO MY TENURE HERE. AND SO HAVING THE OPPORTUNITY TO WORK HERE HAS BEEN THE OPPORTUNITY OF A LIFETIME AND I'M GREATLY, GREATLY APPRECIATIVE.
ALL RIGHT. WELL, COUNCIL, IF THERE'S NO FURTHER DISCUSSION, I WILL TAKE A MOTION ON THIS ITEM.
AND THIS BETTER BE UNANIMOUS VOTE TO APPROVE.
WE HAVE A MOTION. IS THERE A SECOND? SECOND. PLEASE CAST YOUR VOTE.
CONGRATULATIONS, DIRECTOR SCHANK, THANK YOU SO MUCH FOR ALL YOUR WORK.
[01:05:03]
ALL RIGHT. WELL, MOVING ON, WE'RE GOING TO TAKE UP ITEM 7A AND 7B, WHICH IS OUR FINAL TWO ITEMS ON TONIGHT'S AGENDA.[Items 7.A & 7.B]
SO 7A IS ORDINANCE NUMBER 1269A CP 23-0001 FIRST READING AMENDMENT TO THE CITY OF SOUTHLAKE CONSOLIDATED FUTURE LAND USE PLAN AND ITEM 7 B IS ORDINANCE NUMBER 480-806ZA 23-0042 FIRST READING ZONING CHANGE AND SITE PLAN FOR FLOOR AND DECOR.AND DIRECTOR KILLOUGH I BELIEVE YOU'RE GOING TO PRESENT BOTH ITEMS AT THE SAME TIME.
THAT IS CORRECT. TAKE IT AWAY, SIR.
AND THANK YOU MAYOR AND CITY COUNCIL.
FIRST ITEM IS A LAND USE PLAN AMENDMENT CP23-0001.
THIS IS AN AERIAL VIEW OF THE PROPERTY.
AND THE CURRENT ZONING ON THIS PROPERTY IS B1 BUSINESS SERVICE PARK DISTRICT.
AND THE CURRENT LAND USE DESIGNATION ON THE PROPERTY IS RETAIL COMMERCIAL ON ROUGHLY THE NORTH HALF OF THE PROPERTY AND OFFICE COMMERCIAL ON ROUGHLY THE SOUTH PORTION OF THE PROPERTY.
AND THE RETAIL COMMERCIAL LAND USE DESIGNATION PROPOSES AND DEFINES THAT USE AS A RETAIL COMMERCIAL CATEGORY THAT IS LOWER TO MEDIUM INTENSITY, COMMERCIAL CATEGORY, PROVIDING NEIGHBORHOOD TYPE RETAIL SHOPPING FACILITIES AND GENERAL COMMERCIAL SUPPORT ACTIVITIES.
IT IS INTENDED THAT ALL USES IN THIS CATEGORY WILL BE COMPATIBLE WITH ADJACENT SINGLE FAMILY RESIDENTIAL USES, THEREBY MAINTAINING THE CHARACTER, AND INTEGRITY OF THE NEIGHBORHOODS.
THIS CATEGORY IS INTENDED TO ENCOURAGE COMPREHENSIVELY PLANNED DEVELOPMENTS IN AREAS WHERE THE RETAIL COMMERCIAL DESIGNATION IS ADJACENT TO RESIDENTIALLY ZONED PROPERTY OR AREAS WITH RESIDENTIAL DESIGNATION ON THE LAND USE PLAN.
OTHER SUITABLE ACTIVITIES ARE THOSE PERMITTED IN THE PUBLIC PARKS, OPEN SPACE, PUBLIC SEMIPUBLIC AND OFFICE COMMERCIAL LAND USE CATEGORIES.
AND BELOW THAT IS JUST A GENERAL GUIDELINE.
IT'S NOT INTENDED TO BE SPECIFIC, BUT HOW THESE AREAS ARE ENVISIONED AND IN DEVELOPING AS FAR AS THE PERCENTAGE OF THE MIX OF USES.
THE OFFICE COMMERCIAL DEFINITION IS OFFICE COMMERCIAL CATEGORIES COMMERCIAL CATEGORY DESIGN AND INTENDED FOR THE EXCLUSIVE USE OF OFFICE AND LIMITED OFFICE RELATED ACTIVITIES.
IT HAS BEEN ESTABLISHED TO ENCOURAGE AND PERMIT GENERAL, PROFESSIONAL AND BUSINESS OFFICES OF HIGH QUALITY AND APPEARANCE IN ATTRACTIVE LANDSCAPED SURROUNDINGS WITH TYPES OF USES AND DESIGN EXTERIOR APPEARANCE SO CONTROLLED AS TO BE GENERALLY COMPATIBLE WITH EXISTING AND FUTURE ADJACENT SURROUNDING RESIDENTIAL DEVELOPMENT.
OTHER SUITABLE ACTIVITIES, ONCE AGAIN, ARE THOSE IN THE PUBLIC PARKS, OPEN SPACE, PUBLIC SEMIPUBLIC CATEGORIES, AND BELOW IS A GENERAL GUIDELINE OF MIX OF USES TYPICALLY IN THIS LAND USE CATEGORY.
THE APPLICANT'S PROPOSAL IS TO RETAIN THE CURRENT LAND USE AND PROVIDE A SITE SPECIFIC JUSTIFICATION FOR THE PROPOSED ZONING.
ACCOMPANYING THIS REQUEST, WHICH WOULD BE TO ALLOW THE SP2 DETAILED SITE PLAN DISTRICT ZONING ALLOWING A LARGE SINGLE FAMILY RETAIL DEVELOPMENT OF APPROXIMATELY 75,000FTĀ².
[01:10:02]
THE PERMITTED USES AS WELL AS GENERAL REGULATIONS THAT WOULD FOLLOW ARE THE B 1 ZONING DISTRICT AND C 3 USES AND WOULD ALSO INCLUDE A SINGLE TENANT OWNER OCCUPIED BUSINESS EXCEEDING THE 60,000 SQUARE FOOT CAP THAT IS WRITTEN INTO THE C 3 GENERAL COMMERCIAL DISTRICT.IT WOULD ALSO PERMIT WAREHOUSE USES AS DEMONSTRATED IN THEIR PROPOSAL.
IT WOULD INCLUDE OUTSIDE STORAGE WITH MASONRY SCREENING FOR PROPANE TANKS.
WITH THE ZONING REGULATION ALLOWING ALSO USE OF A COLOR RED THAT APPEARS TO BE WITHIN THE PROHIBITED COLORS OF THE ZONING ORDINANCE.
ALSO APPLICANT IS IN THEIR SP1 REGULATIONS PROPOSING A REDUCED PARKING FROM WHAT WOULD BE THE STANDARD PARKING BASED ON THE DISTRIBUTION OF USES WITHIN THE BUILDING BASED ON A STUDY OF THEIR OTHER FACILITIES.
THEIR STUDY INDICATES THAT TYPICAL PARKING IS JUST SLIGHTLY UNDER ONE SPACE PER 1000FTĀ², AND THEY ARE PROPOSING ONE SPACE FOR A TOTAL OF 141 PARKING SPACES, WHICH REALLY EQUATE TO ROUGHLY A LITTLE OVER 237 SPACES OR ONE SPACE PER 237FTĀ².
AND THEY ARE ASKING FOR ARCHITECTURAL FEATURES OF THE BUILDING TO GO AS HIGH AS 40FT.
UNDER TREE PRESERVATION ON THE PROPERTY.
THERE'S ROUGHLY 22% TREE COVER ON THE SITE.
THEY'RE ASKING TO PRESERVE 4.34% OF THAT AND INDICATING THAT WITH SOME OF THE LARGER CALIPER SIZED TREES THEY'RE PROPOSING WOULD OFFSET THE LACK OF OF PRESERVED COVERAGE WITH THE TREE REMOVAL.
ALSO UNDER LANDSCAPE PROVISIONS, THEY'RE REQUESTING A REDUCED NUMBER OF PLANTINGS, BUT ONCE AGAIN, INCREASING THE MINIMUM CALIPER SIZE UP TO FOUR INCHES ON, I BELIEVE, AS MANY AS 28 TREES.
THEY'RE WORKING TO GUIDE PRIMARY DIRECTION OF CUSTOMER AND DELIVERY TRAFFIC, AS WELL AS REGULATING CUSTOMER PICKUP TIMES.
AND ON THE SITE PLAN, THERE IS A STACKING VARIANCE FOR THE MOST SOUTHERN DRIVEWAY THAT PRIMARILY ACCESSES THEIR TRUCK LOADING AREA FOR DELIVERIES AND THEY ARE ASKING FOR A VARIANCE TO STACKING DEPTH TO ALLOW THE 41FT SPACING FROM THE DRIVEWAY TO THE VILLAGE CENTER DRIVE.
THIS IS THEIR PROPOSED SITE PLAN.
THIS IS THE STACKING VARIANCE INDICATED THEY ARE PROPOSING AN EIGHT FOOT MASONRY WALL JUST ALONG THE NORTH EDGE OF THE VILLAGE CENTER RIGHT OF WAY DEDICATION.
AND THIS IS A BLOW UP OF THE LARGER PORTION OF THE SITE AND THE SITE DATA SUMMARY.
THESE ARE THE ELEVATIONS PROPOSED.
AND THE SIGNAGE, OF COURSE, IS NOT AN ELEMENT OF APPROVAL OR CONSIDERATION WITH THE SITE PLAN.
HOWEVER, THE AWNING COLOR PROPOSED AND SOME OF THIS UPPER ELEMENT ARE THE COLOR REGULATION
[01:15:02]
BEING PROPOSED WITHIN THE SP ONE ZONING.FRONT AND REAR ELEVATION DETAIL.
THIS WILL BE LOOKING SOUTHWEST.
AND A VIEW LOOKING NORTH EAST.
THIS IS THE SOUTH ELEVATION OF THE BUILDING AND THE EIGHT FOOT WALL.
THIS IS THE PROPOSED LANDSCAPE PLAN.
AND JUST SOME VIEWS OF THE PROPERTY AS IT EXISTS TODAY.
SURROUNDING PROPERTY OWNER RESPONSES.
THERE'S TWO LETTERS OF SUPPORT FROM JOINING COMMERCIAL PROPERTY TO THE NORTH.
THIS IS, I BELIEVE, ETHAN ALLEN.
AND THEN THE KIMBLE OAKS SHOPPING CENTER OWNERSHIP.
WE RECEIVED AN EMAIL FROM THE SCHOOL SCHOOL DISTRICT TODAY NOTING THEIR OPPOSITION.
WE'VE RECEIVED SEVERAL RESPONSES BY EMAIL OUTSIDE OF THAT 300 FOOT NOTIFICATION OR WHICH APPEAR TO ALL BE OUTSIDE OF THAT. AND AS OF THE CLOSE OF OUR COMPLETION OF THIS PRESENTATION, THAT WAS AT ABOUT 31 IN OPPOSITION.
AND OUR PLANNING AND ZONING COMMISSION APPROVED A MOTION TO DENY A 6 TO 0.
WE'LL NOTE THAT UNDER SOUTHLAKE ZONING ORDINANCE, A DENIAL BY PLANNING AND ZONING COMMISSION DOES NOT INVOKE A SUPERMAJORITY OR REQUIREMENT AT THE COUNCIL LEVEL.
PROPERTY OPPOSITION FROM SURROUNDING PROPERTIES IN EXCESS OF 20% WOULD IMPACT A VOTE OF A SUPERMAJORITY REQUIREMENT AT A SECOND READING.
DENNIS, DO YOU KNOW IF THE OPPOSITION THAT WE RECEIVED PUTS US OVER THAT 20% THRESHOLD? IF THE APPROPRIATE OPPOSITION FORM HAS BEEN SUBMITTED BY THE SCHOOL DISTRICT, THAT WOULD APPEAR TO PUT IT IN A SUPERMAJORITY.
YES, SIR. THAT'S ONLY ON SECOND READING.
THAT'S ONLY AT SECOND READING, CORRECT? THAT IS CORRECT, YES.
GOTCHA. ARE YOU AWARE IF THE APPLICANT HAS MADE ANY CHANGES TO THE APPLICATION AFTER THE P&Z DENIED THE SIX ZERO? WHAT WE'VE PRESENTED TO YOU TONIGHT DOES NOT REFLECT ANY CHANGES.
AND THE APPLICANT DOES HAVE THEIR PRESENTATION, IF YOU WOULD LIKE TO ENTERTAIN THAT.
SURE. BEFORE WE GET TO THAT COUNCIL ANY QUESTIONS FOR STAFF AT THIS POINT? OKAY. OKAY.
STATE YOUR NAME AND ADDRESS FOR THE RECORD AND THEN GO AHEAD WITH THE PRESENTATION.
VICTORIA MORRIS. JACKSON WALKER.
I'M A LAND LEASE ATTORNEY 2323 ROSS AVENUE.
MAYOR HUFFMAN, COUNCILMEMBERS, THANK YOU FOR YOUR TIME TONIGHT.
WITH US TODAY WE HAVE A FULL TEAM.
[01:20:07]
PROVIDE RESPONSES TO THE NEIGHBORHOOD FEEDBACK.BUT WE WERE NOT PERMITTED TO DO SO.
AGAIN, JUST RE-ORIENTING YOU TO THE SITE WHICH STAFF DID A GREAT JOB OF.
THE CURRENT LAND USE? B-1 BUSINESS SERVICE PARK DISTRICT.
RESTAURANT, DIFFERENT TYPES OF RETAILERS TO THE NORTH AND INSTITUTIONAL USES TO THE WEST AND SOUTH.
MAINLY IT'S LARGE INFILL PROPERTY AND THERE IS LIMITED VISIBILITY FROM SOUTHLAKE BOULEVARD.
ESSENTIALLY THE MOST COMPATIBLE USE WOULD BE AN OFFICE DEVELOPMENT WHICH CARRIES WITH IT HIGHER PARKING AND TRAFFIC DEMANDS, PARTICULARLY DURING PEAK TIMES SCHOOL HOURS.
AS I MENTIONED, THE PROPERTY HAS UNDERGONE A COUPLE OF DEVELOPMENT APPLICATION REQUESTS, NONE OF WHICH HAVE BEEN SUCCESSFUL, INCLUDING A SINGLE FAMILY DEVELOPMENT, AS WE UNDERSTAND, IN THE EARLY 90S.
AND ALSO THE PROPOSAL BEFORE YOU TONIGHT FLOOR & DECOR DOES PROVIDE A LOWER INTENSITY USE THAN SOME OF THE OTHERS THAT COULD BE PLACED ON THE PROPERTY MEETING SOME OF THOSE SPECIFIC REGULATIONS OF THE COMPREHENSIVE PLAN IN BOTH RETAIL, COMMERCIAL AND OFFICE COMMERCIAL DEFINITIONS THAT DIRECTOR KILLOUGH EXPLAINED EARLIER.
QUALITY DEVELOPMENT BEING THE FIRST AND FOREMOST.
FLOOR & DECOR IS UNIQUELY POSITIONED TO BE ABLE TO PROVIDE A CREATIVE QUALITY INVESTMENT.
BALANCE IS THE SECOND GOAL LOWER DENSITY, YET HIGHER INTENSITY RETAIL USES ARE SURROUNDING.
SO WE ARE THE LOWER INTENSITY AND FLOOR & DECOR IS A SPECIALTY SOLE OPERATOR RETAILER HELPS BALANCE THOSE DIFFERENT USES THAT ARE SURROUNDING.
AND THIRD, ECONOMIC GROWTH, ECONOMIC DEVELOPMENT.
THERE'S GROWTH, EMPLOYMENT OPPORTUNITIES AND SERVICES.
I'LL LET PHILIP SPEAK TO THAT IN A MOMENT.
SO THE ZONING REQUEST IS AN SP1 DETAILED SITE PLAN.
I WON'T BELABOR MANY OF THE SITE PLAN REGULATIONS THAT WE'VE PROPOSED.
PARKING. OUR PARKING STUDY ACTUALLY DEEMED ONLY 70 PARKING SPACES WERE REQUIRED FOR THIS USE, WHICH I THINK LENDS ITSELF TO THE LOWER INTENSITY THAT WE'LL SPEAK ABOUT IN MORE DETAIL AS WELL.
AND TO ACCOMMODATE SOME OF THE NEIGHBORHOOD CONCERNS THAT WE'VE HEARD, WE'VE INCLUDED THAT ADDITIONAL SIGNAGE REGARDING VILLAGE CENTER DRIVE AND OUR TRUCK TRAFFIC HAS BEEN REROUTED TO NOT UTILIZE VILLAGE CENTER DRIVE.
MY LAST SLIDE, BUT MAYOR HUFFMAN, I HEARD YOU ASK ABOUT CHANGES SINCE P&Z, WHICH HAVE NOT BEEN MADE, BUT SIGNIFICANT CHANGES HAVE BEEN MADE SINCE THE SPIN MEETING.
AND SO WE HAVE REMOVED THE EXTENSION.
IT STILL HAS BEEN DEDICATED ON OUR PLANS TO THE CITY AND WE'VE CHANGED THAT ACCESS POINT AS WELL.
[01:25:02]
AND AS PART OF THE PROCESS, INCLUDING THE CORRIDOR COMMITTEE MEETING, SPIN MEETINGS.WE'VE ALSO CONDUCTED AN OUTREACH TO ALL OF THE ABUTTING PROPERTY OWNERS, AND WE ALSO HAVE VOLUNTARILY HOSTED A COMMUNITY MEETING AND INVITED OVER 80 NEIGHBORS.
I WILL PASS IT OVER TO PHILIP COCHRAN WITH FLOOR & DECOR TO GIVE YOU SOME BUSINESS OPERATIONS.
SURE. THANK YOU SO MUCH. THANK YOU.
SIR. COME ON DOWN, PLEASE. STATE YOUR NAME AND ADDRESS FOR THE RECORD.
GOOD EVENING, MAYOR HUFFMAN, MEMBERS OF THE CITY COUNCIL AND CITIZENS OF SOUTHLAKE.
I'M PHILIP COCHRAN. I'M A LAND DEVELOPMENT MANAGER WITH FLOOR & DECOR.
WE'RE LOCATED AT 2500 WINDY RIDGE PARKWAY IN ATLANTA, GEORGIA.
30339. AS TORY SAID, WE ARE ACCOMPANIED BY OUR DESIGN TEAM AND THEY'RE HAPPY TO ASSIST WITH ANY TECHNICAL QUESTIONS OR CONCERNS YOU MAY HAVE. AND I'M HAPPY TO PRESENT TO YOU OUR APPLICATION FOR OUR NEW STORE AT 2185 EAST SOUTHLAKE BOULEVARD.
AFTER CAREFUL AND STRATEGIC REVIEW OF THIS MARKET, A REAL ESTATE TEAM BELIEVES THAT THIS WILL BE THE BEST LOCATION FOR US TO SERVE OUR CLIENTS AND GUESTS IN THE WESTERN PORTION OF THE DFW METROPLEX.
THE SUBJECT PROPERTY IS LOCATED IN A VIBRANT AND SUCCESSFUL COMMERCIAL NODE, AND IT HAS A STRONG MIXTURE OF POPULATION CONSISTING OF CONTRACT PROFESSIONALS, DIYERS AND ESTABLISHED HOMEOWNERS WHO WILL MORE THAN LIKELY BE LOOKING TO UPGRADE THEIR HOMES.
WE BELIEVE POSITIONING OURSELVES WITHIN THIS EXISTING COMMERCIAL AND INSTITUTIONAL LAND USES WILL ALLOW US TO HAVE A SUCCESSFUL STORE SERVING THE SOUTHLAKE AND SURROUNDING COMMUNITIES FOR MANY YEARS.
A LITTLE BIT ABOUT FLOOR & DECOR.
WE WERE FOUNDED IN ATLANTA IN THE YEAR 2000.
THE SPECIALTY RETAILER IS VERY IMPORTANT TO NOTE.
UNLIKE OTHER TRADITIONAL BIG BOX RETAILERS WHO ARE SELLING YOU PRODUCTS, YOU'LL TYPICALLY VISIT PROBABLY WEEKLY OR EVEN TWICE A WEEK HOME DEPOT OR LOWE'S, THE TARGET OR WALMART, FLOOR & DECOR IS MORE FOCUSED ON SELLING THE PROJECT.
SO YOU MAY NOT HAVE A PROJECT AT YOUR HOME FOR 5-10 YEARS.
SO VISITS TO US ARE LESS FREQUENT THAN THEY ARE TO OTHER BIG BOX RETAILERS.
A LITTLE BIT ABOUT OUR OPERATIONS.
WE SOURCED DIRECTLY FROM THE MANUFACTURERS AND QUARRIES.
EACH STORE STOCKS ABOUT 1,000,000 SQUARE FOOT OF FLOORING PRODUCTS.
OUR AVERAGE TICKET PRICE IS APPROXIMATELY $500 PER CUSTOMER.
WE NOW OFFER FREE DESIGN SERVICES IN STORES.
THE MAKE UP OF OUR CUSTOMERS ARE ROUGHLY 60% PROFESSIONALS.
THE HOURS OF THE STORE ARE 7 A.M.
AND DELIVERIES OCCUR AFTER RETAIL HOURS AFTER MOSTLY AFTER 10 P.M.
AND AN EXCITING PIECE OF NEWS, WE WERE VOTED A 2023 NEWSWEEK BEST PLACE TO WORK.
HERE'S A COPY OF THE LANDSCAPE PLAN.
I'D LIKE TO SPEAK A LITTLE BIT ABOUT THE SLIDE YOU HAVE IN FRONT OF YOU.
THIS IS FROM A NATIONWIDE STUDY WE'VE CONDUCTED OF OUR STORES.
YOU'LL SEE THAT WE HAVE INCLUDED STORES FROM EACH MAJOR MARKET FLORIDA, VIRGINIA, NEW YORK, THE SOUTHEAST WITH SOUTH CAROLINA, TEXAS.
AS YOU SEE DURING THE WEEK OUR AM PEAK IS AROUND 9:30.
PM PEAKS FOR THE STORE ARE AROUND 4:15 TO 4:30 AND THEN WEEKEND TIMES PEAK TIMES ARE AROUND LUNCH.
AS MENTIONED EARLIER, AND EVEN IN THE PUBLIC FORUM, THERE WAS DISCUSSION OF THE SCHOOL TRAFFIC.
THIS IS A CURRENT SLIDE TAKEN FROM THE SCHOOL'S WEBSITE.
BUS TRAFFIC IS TO FILL FROM THE FRONT DRIVE.
[01:30:02]
ELEMENTARY SCHOOL TRAFFIC IS TO FILTER THIS WAY AND MIDDLE SCHOOL TRAFFIC DOES COME OFF VILLAGE CENTER DRIVE.IT HAS BEEN NOTED BY THE CITIZENS AND BY US THAT DURING AFTERNOON PICKUP HOURS, MANY PEOPLE ARE UTILIZING THE SHOPPING CENTER AS A PARKING AREA TO AVOID THE CAR RIDE OR PICKUP.
THIS GIVES YOU AN IDEA OF HOW CLOSE WE ARE PROPOSING TO BE TO OUR NEIGHBORS.
TO KING'S UNIVERSITY, WE ARE APPROXIMATELY ONE FOOTBALL FIELD.
THE RESIDENTIAL SITES BELOW US ROUGHLY THREE FOOTBALL FIELDS FROM THE BACK OF THE STORE TO THE BACK OF THE HOUSE AND ONE FOOTBALL FIELD AWAY FROM THE SCHOOL. I'D LIKE TO TAKE A MINUTE NOW AND TURN THIS OVER TO ONE OF OUR CONSULTANTS, DAVID MARSH, WITH MARSH PMK.
SIR, ONCE AGAIN, IF YOU CAN STATE YOUR NAME AND ADDRESS FOR THE RECORD.
MY NAME MY NAME IS DAVID MARSH WITH MARSH PMK INTERNATIONAL.
WE'RE LOCATED AT 1130 EAST ARAPAHO ROAD IN RICHARDSON, TEXAS 75081.
THE SLIDE YOU HAVE IN FRONT OF YOU IS ONE OF FIVE SIMILAR TO THIS THAT ARE GENERATED BY THAT WERE GENERATED BY AN ACOUSTICAL MODELING PROGRAM. IT'S USED ALL OVER THE WORLD.
IT'S CALLED SOUND PLAN, AND IT IS A MODEL OF OUTDOOR SOUND PROPAGATION.
SO WE'RE GOING TO BE TALKING ABOUT BACKGROUND NOISE, WHICH IS THE NORMAL ORDINARY NOISE OF THE DAY, AIRCRAFT FLYOVERS, NEARBY LOCAL ROADS, HIGHWAY 114. THAT'S AN IMPORTANT ELEMENT.
AND WHENEVER WE ARE LISTENING TO NOISE, OUR EARS FILTER THE SOUND.
SO IF YOU LISTEN TO YOUR STEREO AND YOU TEND TO WANT TO CRANK THE BASS UP A LITTLE BIT, IT'S BECAUSE YOUR EARS ARE LESS SENSITIVE AT BASS FREQUENCIES THAN THEY ARE AT TREBLE FREQUENCIES. THAT NATURAL FILTERING WHEN YOU MAKE A MEASUREMENT, IS CALLED AN A WEIGHTING FILTER.
SO WHEN WE REFER TO DECIBELS, WE WE USE THE ABBREVIATION DB AND WHAT IS A WEIGHTED TO CORRESPOND TO THE WAY WE HEAR SOUND AND CHANGES IN LEVEL IS CALLED DBA.
ON THE SLIDE YOU'LL SEE THAT IT SAYS LEQ NIGHT DBA LEQ MEANS YOU KNOW, THE SOUND LEVELS ALWAYS VARY.
SO THIS IS SOME OF THE ALPHABET SOUP.
I WANT TO TALK ABOUT THE BACKGROUND NOISE LEVEL.
WE WENT OUT TO KING'S UNIVERSITY AND MEASURED ALONG THE SOUTH FENCE AND ALSO PARTWAY UP IN THE PARKING LOT BECAUSE WE WANTED TO BE ABLE TO SEE IF WE COULD PICK UP SOME NOISE FROM SOUTHLAKE BOULEVARD AND FROM 114 THIS WAS RIGHT AFTER IT WAS DURING THE WEEK OF JULY 4TH.
SO WE WERE ABLE TO IDENTIFY THAT AND REMOVE IT AND KIND OF DO A LINEAR REGRESSION OF THE CURVE TO SEE WHAT WOULD IT BE LIKELY, WHAT'S THE BEST CASE OR THE LOWEST IT COULD POSSIBLY BE WITHOUT THE INSECTS.
SO 40 DBA IN MY OPINION, IS A UNREALISTICALLY LOW ESTIMATE, BUT IT'S KIND OF WORST CASE.
IS NOT AT 40 OR ABOVE 40, CERTAINLY, BECAUSE THEN THAT COULD IMPACT THE ENVIRONMENT.
THEY ADD UP TO BE 43 EACH TIME YOU ADD TWO SOUND LEVELS OVER THE SAME LEVEL, YOU GET THREE DECIBELS INCREASE AND IT TAKES ABOUT A TEN DECIBEL INCREASE TO SOUND TWICE AS LOUD. YOU REALLY CAN'T EVEN HARDLY HEAR A DIFFERENCE OF THREE.
THAT WOULD BE JUST NOTICEABLE.
[01:35:03]
40, BUT IN REALITY, MORE ALPHABET SOUP.I WON'T HAVE TIME TO DEFINE IT, SO I'LL JUST SAY THERE'S SOMETHING CALLED LDN.
DAY NIGHT AVERAGE LEVEL NOISE CONTOURS AROUND ALL MAJOR AIRPORTS IN DFW.
THE HOMES THAT WE'RE DISCUSSING HERE ON THE WEST SIDE AND ON THE SOUTH SIDE OF THAT, ON THE BOTTOM EDGE OF THAT DRAWING, THOSE HOMES ARE IN THE LDN RIGHT AT THE LDN 65 NOISE CONTOUR.
SO IT'S NOT THE SAME AS WHAT YOU'D MEASURE WITH A SOUND LEVEL METER.
BUT LET'S SAY IT'S FAIR TO SAY THAT TO BE AT 65, YOU MIGHT MEASURE 55 ALL DAY LONG.
55 MIGHT BE THE HIGH END OF WHAT WE HAVE.
OUR PREDICTION IS THAT THAT SHOULD BE 53DB PRETTY MUCH ALL THE TIME WHEN IT'S RUNNING.
SO IT'S FAIR TO SAY THAT THE BACKGROUND NOISE IS PROBABLY MORE LIKE 50 AND 50 TO 53 IS PROBABLY THE NORMAL LONG TERM, YOU KNOW, ANNUALIZED BACKGROUND NOISE LEVEL. BUT EVEN IF WE GO AT 40, WHAT HAPPENS WITH THE TRUCK NOISE? AS PHILIP SAID, WE MEASURED ABOUT AN HOUR AND 15 MINUTES FROM THE TIME THE TRUCK PULLED UP UNTIL IT PULLED INTO THE TRUCK DOCK OVER AT THE COLONY FLOOR & DECOR STORE, ALL THE ACTIVITIES, YOU KNOW, STOPPING THE AIR BRAKES, TURNING OFF THE ENGINE, OPENING THE OVERHEAD DOORS, THE FORKLIFT RUNNING IN AND OUT, PICKING THINGS UP, DROPPING THEM OFF.
AND THAT ENTIRE DURATION OF ACTIVITIES WHEN ADJUSTED FOR DISTANCE IS WHAT YOU'RE LOOKING AT HERE. SO ON THE LEFT SIDE, YOU MAY NOTICE THAT THE THERE'S ONE HOUSE AT THE NORTH SIDE JUST AT THE CURVE ON THE WEST SIDE THERE WHERE IT SAYS 31, THAT'S 31 DBA WITH IF YOU WERE IF YOU WERE TO TAKE WHAT WAS HAPPENING IN THE COLONY AND MOVE IT TO THIS LOCATION, THAT'S WHAT YOU'D BE GETTING AT THAT HOUSE ONLY 31.
AND DOWN ON THE SOUTH END, THE HIGHEST LEVEL IS 28.
SO WE'RE NOWHERE NEAR THE 40, WHICH WOULD BE THE WORST CASE SOUND LEVEL.
WE SAID, WHAT IF YOU SORT OF WANT TO LOOK AT A WORST CASE SCENARIO? SO ALL THE SPIKES THAT OCCUR WHEN A FORKLIFT MAKES A NOISE OR DROPS AND YOU KNOW, THERE'S SORT OF YOU CAN SEE THIS, THIS, THIS TIME CHART WHERE THERE'S A SPIKE AND THEN IT COMES BACK AND IT REPEATS THE ACTIVITY AND THERE'S A SPIKE.
AND WE SAID IF THAT WAS A CONTINUUM RUNNING WITH NO SPACES IN BETWEEN, HOW LOUD WOULD THAT BE? WE DON'T HAVE THE CHART HERE TO SHOW YOU, BUT IT ONLY RAISED THE OVERALL LEVEL OF THE HOMES BY THREE DECIBELS BECAUSE AT THE COLONY THEY PULLED OUT OF THE THERE WAS A RAMP THERE.
AND I DON'T THINK WE HAVE A RAMP HERE FOR THE TRUCK DOCK.
BUT THERE WAS ONE IN THE COLONY, SO THEY PULLED UP A RAMP, WHICH, YOU KNOW, THE GEARING UP, I MEAN, THE ACCELERATING UP A RAMP WHERE THE TRUCK GETS A LITTLE BIT LOUDER THAN USUAL. THEN THEY STOPPED AND THEY RELIEVED THE PRESSURE FROM THE AIR BRAKES, WHICH WAS A LOUD EVENT.
AND THEN WHEN THEY STARTED AGAIN, THERE WAS ANOTHER AIR BRAKE THING AND THEY TOOK OFF.
AND WE MODELED THAT AGAIN, WE DON'T HAVE THE THING.
BUT IT WAS IT WAS IT WAS THREE DECIBELS LOUDER AT ONE HOME.
IT MIGHT HAVE BEEN EVEN 5 OR 6DB LOUDER.
BUT GOING FROM, SAY, 31 OR 28 PLUS 5 OR 6DB GIVES YOU 36, 37.
SO MAYBE ON THE LOW END, 28 PLUS, THAT'S 33, 34.
WE'RE NOWHERE NEAR 40 AND WE'RE CERTAINLY NOWHERE NEAR 50.
AND MY PROFESSIONAL OPINION, AND I'LL CLOSE WITH THIS, THE TRUCK MOVEMENTS.
STOPPING STARTING ALL THE UNLOADING ACTIVITIES FOR THE FULL DURATION, NIGHT AFTER NIGHT, SOMETIME AFTER 10:00 UNTIL WHO KNOWS WHAT TIME IN THE MIDDLE OF THE MORNING WILL NOT HAVE ANY MATERIAL IMPACT ON THE ENVIRONMENTAL NOISE AT THE RESIDENCE ON THE WEST SIDE AND THE SOUTH SIDE OF THE PROPERTY.
AND IF YOU DON'T HAVE ANY QUESTIONS, THAT'LL BE ALL I HAVE TO SAY.
OKAY. COUNCIL, ANY QUESTIONS? THANK YOU, SIR. OKAY.
THANK YOU. ONE THING TO ADD TO DAVID'S PRESENTATION, THE WAYS WE'RE WORKING TO MINIMIZE THE NOISE LEAVING OUR SITE IS AS A LOADING DOCK.
WE'RE PROPOSING A TEN FOOT WALL THAT WILL SHIELD THE TRUCK FROM ANY VIEW.
YOU'VE SEEN THESE AS DENNIS SHARED THE BUILDING RENDERINGS AND I WOULD LIKE TO ADD A COUPLE OF OTHER ITEMS IF I COULD.
[01:40:02]
AS A SINGLE TENANT SOLE OPERATOR, FLOOR & DECOR IS UNIQUELY POSITIONED TO BUILD AN ATTRACTIVE RETAIL FACILITY WITH AN OPEN, SPACIOUS SHOWROOM AND A MODERN, SAFE STOCK ROOM THAT WILL ALLOW FOR QUICK AND EASY CUSTOMER PICKUP.OUR ARCHITECT WILL MEET THE MASONRY REQUIREMENTS OF THE CITY OF SOUTHLAKE.
THE LOADING AS I DISCUSSED A MOMENT AGO, THE LOADING AREA FOR THE STOCK ROOM WILL BE SHIELDED FROM SURROUNDING PROPERTIES BY A TEN FOOT WALL, MINIMIZING ANY VIEWS OF THE DELIVERY TRUCK. AS SHOWN EARLIER, DELIVERY TRUCKS WILL BE INSTRUCTED TO UTILIZE THE INGRESS EGRESS POINTS ON SOUTHLAKE BOULEVARD AND TO FOLLOW THE DRIVE AISLE AROUND THE BUILDING TO THE LOADING AREA AND UTILIZE THE SOUTHERN DRIVEWAY TO EXIT THE SITE NORTH.
I'M SORRY. EVEN EVEN THOUGH STORE DELIVERIES WILL NOT CONFLICT WITH SCHOOL HOURS.
WE WILL INSTRUCT TRUCK TRAFFIC TO UTILIZE THE AXIS ON SOUTHLAKE BOULEVARD.
DELIVERIES OCCUR POST RETAIL HOURS.
THE CURRENT ASSESSMENT OF THE LAND IS ROUGHLY THE CURRENT ASSESSMENT OF THE LAND IS $575,000, WITH SOUTHLAKE RECEIVING $1,863 OF PROPERTY TAX, AND THE CARROLL INDEPENDENT SCHOOL DISTRICT RECEIVING ROUGHLY $61,308.
WE'RE PROPOSING TO MAKE A $20 MILLION INVESTMENT IN THE CITY OF SOUTHLAKE, WHICH WILL RETURN ROUGHLY $72,000 OF PROPERTY TAX AND ROUGHLY $243,000 IN TAXES TO THE CARROLL INDEPENDENT SCHOOL DISTRICT.
I'D LIKE TO TAKE A MOMENT OF YOUR TIME AND DISCUSS SOME OF THE COMMENTS THAT WERE DISCUSSED AT P&Z.
ONE OF THE COMMENTS WAS THAT WE WERE A WHOLESALER, NOW A RETAILER.
WE PROPOSE TO COMPLEMENT THE SURROUNDING BUSINESSES.
AS I DISCUSSED EARLIER, OUR STORE HOURS ARE 7 TO 7 AND PRODUCT DELIVERY WILL BE AFTER 10:00 PM.
THERE WAS MANY DISCUSSIONS ABOUT OTHER REAL ESTATE IN THE AREA.
TWO IN PARTICULAR, THE BED, BATH AND BEYOND, WHICH WAS RECENTLY CLOSED DUE TO BANKRUPTCY.
WE'VE LOOKED AT THAT, THAT THAT BUILDING IS ACTUALLY TOO SMALL FOR WHAT WE'RE PROPOSING.
AND THE PROPERTY IS DEED RESTRICTED.
SAME ISSUE WITH THE BYE BYE BABY.
A THIRD BUILDING WE WERE ASKED TO LOOK AT WAS THE SAM'S IN GRAPEVINE.
CALLS TO WALMART AND SAM'S CORPORATION SHOWED THAT THIS PROPERTY IS CURRENTLY OFF MARKET.
LIKE TO DISCUSS TRAFFIC WITH YOU AS WELL.
DUE TO OUR UNIQUE USE FLOOR & DECOR COMMISSIONED A NATIONAL TRAFFIC STUDY, AS I DISCUSSED EARLIER, WE INCLUDED SITES FROM ACROSS THE UNITED STATES.
LIKE TO NOTE THAT ON AVERAGE, 9:30 A.M.
THE WEEKDAY PM PEAK IS AROUND 4:30.
WEEKEND PEAK TIMES OCCUR AROUND 1:00.
WE ARE FOCUSED ON PROJECTS, NOT PRODUCTS.
[01:45:11]
WE DO NOT ANTICIPATE HAVING AN IMPACT ON THE SCHOOL.OUR DELIVERY HOURS DO NOT CONFLICT WITH SCHOOL HOURS.
OUR PEAK TIMES ON SITE DO NOT CONFLICT WITH DROP OFF AND PICK UP TIMES AT THE SCHOOL.
I'D ALSO LIKE TO NOTE THAT WE PERSONALLY RECEIVED SOME EMAILS FROM THE LOCAL CITIZENS REFERENCING A GOOGLE EARTH PHOTO OF ONE OF OUR LOCATIONS IN GLENDALE, ARIZONA. WE'VE DONE SOME RESEARCH, AND THIS PHOTO SHOWS A WATER STAIN ON THE CONCRETE.
AFTER THE PLANNING COMMISSION, I TOOK THE TIME TO DO OPEN RECORDS REQUEST.
THEY HAVE NOT BEEN RECEIVED YET VIA MAIL, BUT PER PHONE CALLS WITH NORTH RICHLAND HILLS.
WE CURRENTLY DO NOT HAVE ANY VIOLATIONS ON OUR SITE.
OUR DENTON STORE. WE CURRENTLY DO NOT HAVE ANY CODE VIOLATIONS.
THERE IS ONE OF AN ABANDONED TRUCK ON SITE WITH STORE STAFF IS CURRENTLY WORKING WITH CODE ENFORCEMENT OF DENTON TO REMOVE THE TRUCK FROM THE FACILITY.
AND IT SHOULD BE NOTED THAT THE FORT MYERS STORE HAS ENDURED TWO HURRICANES, IAN, DURING THE MONTH OF JULY AND IDA IN AUGUST. WE'RE HERE TONIGHT.
TO JOIN THE BUSINESS COMMUNITY OF SOUTHLAKE.
WE WOULD LIKE TO BE GOOD NEIGHBORS.
WE'D LIKE TO BE GOOD CORPORATE CITIZENS.
AND WE HAVE STRIVED TO ADDRESS THE CONCERNS OF NOT ONLY YOUR STAFF, BUT YOUR CITIZENS.
WE BELIEVE THAT THIS NEW STORE WILL BE A BENEFIT TO THE CITY OF SOUTHLAKE.
COUNCIL ANY QUESTIONS FOR THE APPLICANT AT THIS TIME? YES, MAYOR, I DO HAVE ONE QUESTION ON YOUR DELIVERIES.
IS IT SAFE TO ASSUME THOSE ARE GENERALLY 18 WHEELERS? THAT IS CORRECT. THEY ARE.
OKAY. ON AN AVERAGE WEEK FOR A STORE LIKE THIS, WHAT WOULD YOU ANTICIPATE THE NUMBER OF DELIVERIES TO BE? GOOD QUESTION.
THEY DO OCCUR POST RETAIL HOURS AND I BELIEVE MOST DELIVERIES ARE AROUND TWO A WEEK.
TWO TOTAL FOR THE ENTIRE WEEK.
COUNCIL, ANY OTHER QUESTIONS FOR THE APPLICANT.
THANK YOU, SIR. WE MIGHT HAVE ADDITIONAL QUESTIONS, SO.
BUT YOU CAN HAVE A SEAT FOR NOW.
OKAY, HERE'S WHAT WE'RE GOING TO DO.
AND I WANT TO GIVE YOU GUYS THAT OPPORTUNITY.
SO I'M GOING TO OPEN UP A PUBLIC COMMENT SECTION FOR THIS.
WE GET THREE MINUTES FOR EVERYONE.
WHEN YOU COME UP, STATE YOUR NAME AND ADDRESS FOR THE RECORD.
THAT GREEN LIGHT ON THE PODIUM WILL GO ON.
SO IF YOU COULD PLEASE KEEP YOUR COMMENTS INSIDE THAT TIME PERIOD, THAT WOULD BE GREAT.
[01:50:06]
BECAUSE WE'VE GOT A LOT OF SPEAKERS.WE WANT TO GET THROUGH THIS IN A ORGANIZED FASHION.
SO I'VE GOT A NUMBER OF COMMENT CARDS HERE READY TO GO.
SO I'LL START WITH DENNIS MENDER FROM 223 EASTWOOD DRIVE.
ONCE AGAIN, WHEN YOU START, PLEASE STATE YOUR NAME AND ADDRESS FOR THE RECORD.
GOOD EVENING, MR. MAYOR, CITY COUNCIL.
DENNIS MENDER 223 EASTWOOD DRIVE SOUTHLAKE BEEN HERE 42 YEARS AND PROUD OF IT.
AND THAT'S WHY I'M DOWN HERE SPEAKING AGAINST THIS PROJECT.
I FEEL IT DOESN'T MEET THE FIT, THE NEIGHBORHOOD AND SURROUNDING AREA.
AND JUST FOR FYI, WE QUERIED THEM ON THE DRIVER'S SITUATION.
THEY NOT EMPLOYED BY FLOOR & DECOR THERE.
SO THEY DON'T CARE ABOUT OUR RULES.
YOU CAN SEE ALL THE VIOLATIONS OVER HERE AT THE GROCERY STORE.
THEY JUST COME AND GO WHENEVER THEY WANT.
THEY GET THEIR TICKETS AND THEY KEEP ON GOING.
SO THEY'RE NOT CONTROLLED BY FLOORS & MORE ANYMORE AT ALL.
THEY'RE JUST INDEPENDENT DRIVERS MAKING DELIVERIES.
IT'S A BIG BOX STORE 20 TO 40FT.
HAVEN'T SEEN ANY OF THAT ON THEIR PICTURES AT ALL.
IT'S JUST A BIG BOX AND NOT VERY INVITING TO OUR DECOR HERE IN THE CITY OF SOUTHLAKE.
THERE'S THIS AREA SHOULD BE REALLY A TRANSITIONAL DEAL BETWEEN THE SCHOOLS AND THAT.
AND IF YOU'VE BEEN ON THERE ON A SCHOOL DAY, IT'S TERRIBLY CONGESTED.
WE HAVE KIDS THAT COME DOWN THERE AND THEY EAT IN THOSE VARIOUS SHOPS THERE ALONG 1709.
PLUS THEY GO TO THE CHICKEN PLACE THERE ON THE HILL AND INCREASE TRAFFIC.
THE AVERAGE PICKUP TRUCK WITH A TRAILER ON IT IS OVER 30FT LONG.
BY THE TIME YOU FIGURE A 20 FOOT TRUCK IN A 16 TO 20 FOOT TRAILER, HAVE YOU EVER TRIED GETTING ACROSS 1709 AND MAKE A TURN OUT THERE WITH A CAR? WELL, TRY TO DO THAT WITH A PICKUP AND A TRAILER.
IT'S ONE OF THE MOST HAZARDOUS INTERSECTIONS IN SOUTHLAKE AND IT'S NOT CONDUCIVE TO THE SAFETY OF NEIGHBORHOOD, TO THE SHOPPERS THERE, TO THE KIDS THAT RIDE THEIR BIKES TO SCHOOL OR WALK TO SCHOOL.
AND I DON'T THINK THAT'S A GOOD USE OF THAT SPACE BACK THERE.
LET'S SEE. IF YOU LOOK AT TURNING RADIUS OF TRACTOR TRAILERS, IF THEY TURN OFF 1709 GOING EASTBOUND AND TRAVEL UP THAT SIDE STREET, THEY'RE GOING TO COME WAY TO THE OTHER SIDE OF THE TURNING LANE THAT'S PROPOSED THERE.
I MEAN, YOU'VE GOT 24FT, 12 FOOT LANES AND TURNING RADIUS ON 18 WHEELERS ABOUT 29FT.
WELL, LET'S SEE. I GOT MAYBE 1 OR 2 OTHER THINGS HERE.
WE'RE KIND OF BIG IN ARTICULATION HERE IN SOUTHLAKE, AND I HAVEN'T SEEN ANY ARTICULATION THAT IS GOING TO MAKE THIS A MORE APPEALING BUILDING EXCEPT A STRAIGHT LINE ACROSS THE HORIZON. SO I IMPLORE ON YOU TO MAKE THESE GUYS GO BACK AND DO SOMETHING A LITTLE MORE SPECIFIC WITH THEIR BOX SITUATION.
BUT AND OVERALL, I'M DEFINITELY OPPOSED TO IT FOR SAFETY REASONS.
THE WRONG PLACE IN TOWN FOR IT.
WHAT ELSE CAN I SAY? I'VE BEEN IN THREE MEETINGS ALREADY AND I'VE KIND OF SAID MY PIECE, SO THANK YOU VERY MUCH FOR YOUR TIME.
WHO WISHES TO SPEAK IN OPPOSITION TO THIS ITEM? MR. SLEDS. GOOD EVENING. MY NAME IS CARL SLEDS.
I WISH WE COULD PUT UP THE SECOND TO THE LAST SLIDE OF THE SITE PLAT AND THE PROPOSED ENTRY GO BACK TO THE NO, GO FORWARD.
ONE MORE TO WHERE IT WAS SHOWING THE ENTRY OFF OF SOUTHLAKE BOULEVARD.
IT WAS THE FIRST ONE THAT WILL WORK.
OKAY, HERE WE'VE GOT THIS PROPOSED ENTRY OFF OF SOUTHLAKE BOULEVARD WITH CONSIDERED A COUPLE TIMES A WEEK 40 FOOT SEMI TRAILERS, THAT SPACE BETWEEN SNAPPY SALADS AND BJ'S BREWERY.
[01:55:02]
I MEASURED THAT ENTRYWAY.TWO OF THOSE LANES ARE DEDICATED TO OUTBOUND TRAFFIC.
IMPOSSIBLE FOR A SEMI TO MAKE A LEGAL TURN.
IF HE'S GOING EASTBOUND HE'S GOT TO ENCROACH ON AT LEAST ONE LANE.
HE'S GOT TO BE TURNING OUT OF THE MIDDLE LANE AND STILL HE'S GOING TO DESTROY THE SIDEWALK.
IF HE'S COMING WESTBOUND, I'M SURE YOU ALL HAVE EXPERIENCED GOING DOWN SOUTHLAKE BOULEVARD AND HAVING SOMEBODY TRY TO MAKE THAT TURN INTO THAT SHOPPING AREA WHILE HEADED WESTBOUND.
IT'S A NEAR IMPOSSIBILITY AND IT'S PROBABLY ONE OF THE RISKIER AREAS IN OUR CITY.
THESE YOU'RE GOING TO HAVE CONTRACTORS, YOU'RE GOING TO HAVE RETAIL CUSTOMERS THAT ARE JUST NATURALLY GOING TO MIGRATE TO WHATEVER THEIR FIRST ENTRY IS. BUT THAT'S JUST A DANGEROUS, DANGEROUS SET UP TO EXPOSE OUR SCHOOLCHILDREN TO THAT.
THE OTHER ENTRY OFF OF KIMBLE AGAIN.
IF YOU'RE GOING NORTHBOUND ON KIMBLE, YOU HAVE TO COME ACROSS THAT TRAFFIC.
AND WE ALREADY HAVE A PROBLEM THERE WITH CHICK FIL A AND THE DAYCARE CENTER.
THERE'S ALREADY A TRAFFIC PROBLEM THERE.
PLUS, THE SLOPE INTO THE PROPERTY IS AT ABOUT A 25 DEGREE ANGLE AND THEN IT ABRUPTLY ENDS INTO PARKING SPACES.
SO THERE'S NO WAY FOR ANYBODY TO JUST GO STRAIGHT IN.
SO IF YOU'RE CONSIDERING BOX TRUCKS.
TRUCKS WITH TRAILERS, ANYTHING THAT WOULD COMMERCIALLY BE GOING INTO THIS AREA.
YEAH, ABSOLUTELY. APPRECIATE IT.
SORRY. WE GOTTA KEEP MOVING. YES, SIR.
NEXT SPEAKER, WE HAVE BETSY WILLIFORD, WHO WISHES TO SPEAK IN OPPOSITION TO THIS ITEM.
HELLO, MY NAME IS BETSY WILLIFORD.
AND MY DAUGHTER TAYA WANTED TO SAY SOMETHING, TOO SHE'S BEEN SO PATIENT.
DO YOU REMEMBER WHAT YOU WANTED TO SAY? I DON'T WANT THE FLOOR & DECOR BECAUSE I DON'T WANT MY BROTHER TO GET RAN OVER.
I WANTED TO MAKE A COUPLE POINTS FROM THE LAST MEETING AND AND THEN WHAT WAS BROUGHT UP THIS EVENING? THERE WAS A MEETING HELD AT THE MARQ FOR OUR NEIGHBORS, AND UNFORTUNATELY, IT WAS HELD ON A NIGHT WHERE MOST OF US WERE AT EITHER DAWSON OR EUBANKS FOR CURRICULUM NIGHT.
AND SO WE WEREN'T GOING TO CHOOSE TO ABANDON THAT WHEN WE'RE HERE FOR ALL OF OUR DRAGONS.
ANOTHER POINT THAT STOOD OUT TO ME THAT IS PRETTY CONCERNING.
I BELIEVE SOMEONE MENTIONED IT FLOOR & DECOR DOESN'T HAVE THEIR OWN DRIVER.
SO THOUGH THEY MAY SAY THAT DELIVERIES WON'T BE UNTIL AFTER A CERTAIN TIME, HOW CAN THEY PROMISE THAT WHEN THEY DON'T HAVE THEIR OWN TRUCKING COMPANY AND THEY'RE SUBCONTRACTING THAT OUT? I'M FINE WITH CONTRACTORS BEING OVER AT HOME DEPOT AND LOWE'S COMING IN AND OUT OF THOSE FACILITIES.
BUT WHEN I HAVE, YOU KNOW, LITTLE, LITTLE KIDS WALKING BY AND AS THEY GET OLDER, GOING TO TORCHY'S AND CONTRACTORS MAY BE GOING OUT TO THEIR TRUCKS AND TRAILERS, I DON'T KNOW.
I JUST I'M NOT A FAN OF THAT BEING SO CLOSE TO OUR SCHOOL CAMPUSES.
SO I HOPE YOU WILL CONSIDER THESE CONCERNS.
NEXT, WE HAVE CAM BRYAN, WHO WISHES TO SPEAK IN OPPOSITION TO THIS ITEM.
MR. MAYOR, MEMBERS OF THE COUNCIL, MS. YELVERTON, GOOD EVENING.
I'M A 20 YEAR RESIDENT OF SOUTHLAKE 970 OMB LANE.
I ALSO CURRENTLY SERVE AS YOUR SCHOOL BOARD PRESIDENT.
IN THE INTEREST OF TIME, I AM HERE SPEAKING ON BEHALF OF THE SCHOOL BOARD AND DR.
[02:00:04]
LEDBETTER AND HIS ADMINISTRATION TO VOICE OUR OPPOSITION TO THIS PROPOSED PROPOSED ZONING CHANGE AND SITE PLAN FOR FLOOR & DECOR.IN SHORT, THE REASON FOR OUR OPPOSITION IS, IF APPROVED, WE BELIEVE THE INCREASE IN VEHICLE AND PEDESTRIAN PRESENCE IMMEDIATELY ADJACENT TO DAWSON, MIDDLE AND EUBANKS INTERMEDIATE SCHOOLS WILL POSE ADDITIONAL SAFETY AND SECURITY CONCERNS.
I'VE HAD TWO CHILDREN GRADUATE FROM BOTH CAMPUSES AND CAN TELL YOU FIRSTHAND THAT CURRENT INGRESS AND EGRESS TO THESE CAMPUSES IS ALREADY CHAOTIC, TO SAY THE LEAST.
LASTLY, IF THIS PROPOSAL IS APPROVED, CARROLL ISD WILL MOST LIKELY HAVE TO SPEND THOUSANDS OF DOLLARS TO ENSURE THAT THE SAFETY AND SECURITY OF OUR CHILDREN ARE MET. ITEMS SUCH AS NEW FENCING, INSTALLATION AND MONITORING OF SECURITY CAMERAS, INCREASED ADMIN AND SRO PRESENCE TO JUST NAME A FEW. THANK YOU FOR THE OPPORTUNITY TO SPEAK AND FOR YOUR CONSIDERATION.
THANK YOU, SIR. NEXT SPEAKER, WE HAVE PATTY MENDER, WHO WISHES TO SPEAK IN OPPOSITION TO THIS ITEM.
MR. MAYOR AND COUNCIL PATTY MENDER, 223 EASTWOOD DRIVE SOUTHLAKE 40 YEAR RESIDENT.
AND I AM THE ONE WHO TOOK ALL THE PICTURES YOU HAVE THEM IN FRONT OF YOU.
AND I TOOK THEM ON THREE OCCASIONS AT FORT MYERS, AT THE FLOORS AND MORE IN APRIL, MAY AND AUGUST.
AND I HAVE SOME MORE TO SHOW YOU.
MS. MENDER WHY DON'T YOU PUT THOSE ON THE PROJECTOR SO EVERYBODY CAN SEE THEM.
DOES THAT THING STILL WORK, DENNIS? THEY'RE THE ONES I HAVE HERE ARE FROM THE FORT MYERS STORE IN FLORIDA, AND THE OTHER ONES ARE NORTH RICHLAND HILLS.
AND WHEN THIS GENTLEMAN SAID THEY HAVE NO VIOLATIONS, I BEG TO DIFFER WITH THEM.
WE'VE NEVER HAD ANYTHING THAT LOOKED LIKE THIS BEHIND LOWE'S OR HOME DEPOT.
AND I TOOK THESE PERSONALLY OVER THE OVER FOUR MONTHS.
AND I BELIEVE I LEFT SOME WITH MY HUSBAND LEFT SOME WITH YOUR CITY SECRETARY ALSO.
YES, MA'AM. I BELIEVE MOST OF THE THINGS HAVE BEEN ADDRESSED THAT I WAS GOING TO SAY.
I WOULD LIKE TO SAY SOMETHING ABOUT THE NOISE.
DFW WE CAN HEAR THE ENGINES RUN UP AT NIGHT.
JUST ABOUT BRINGS YOU OUT OF OUR BED BECAUSE WE HAVE A VALLEY THAT GOES BETWEEN THE SCHOOL AND US.
I'D LIKE TO POINT OUT THAT WHEN WE LOOKED AT THE MASTER PLAN, WE ALWAYS WANTED A TRANSITION BETWEEN THE SCHOOLS AND RETAIL.
THAT WAS ONE OF THE REASONS WE ALL WANTED TO HAVE OFFICE BETWEEN THE BUILDINGS HERE.
AND I WOULD STILL LIKE TO SEE OFFICE BUILDINGS BACK THERE.
AND WE HAVE CHILDREN RIDING THEIR BIKES AND WALKING TO SCHOOL EVERY DAY.
AND THEY GO TO CHICK FIL A TO MEET THEIR PARENTS AND SOCIALIZE WITH THEIR FRIENDS AFTER SCHOOL.
AND I BELIEVE EVERYBODY HAS JUST ABOUT ADDRESSED EVERYTHING.
BUT I HAVE NOTHING AGAINST FLOORS AND DECOR.
IT'S JUST THIS IS NOT THE RIGHT PLACE.
OUR NEXT SPEAKER IS LINDSAY KASTNER, WHO WISHES TO SPEAK IN OPPOSITION TO THIS ITEM.
IS LINDSAY STILL HERE? OKAY. NEXT, WE HAVE KATIE CARPENTER, WHO WISHES TO SPEAK IN OPPOSITION TO THIS ITEM.
OKAY. NEXT WE HAVE DARCY, WHO WISHES TO SPEAK IN OPPOSITION TO THIS ITEM.
[02:05:05]
NO. OKAY. AND NEXT, WE HAVE JENNY YOUNG, WHO WISHES TO SPEAK IN OPPOSITION TO THIS ITEM.OKAY, SO I'VE GOT A LOT OF CARDS THAT I WANT TO READ INTO THE RECORD.
BUT BEFORE I DO, LET ME ASK, IS THERE ANYONE ELSE IN THE CROWD THAT WANTS TO ACTUALLY SPEAK LIVE? OKAY. ALL RIGHT. SO BEFORE I OFFICIALLY CLOSE THAT DOWN, I'M GOING TO GO AHEAD AND READ THESE RESPONSE CARDS.
SO WE HAVE CINDY GROSSMAN, WHO DOES NOT WISH TO SPEAK, BUT RECORD OPPOSITION.
WE HAVE ANN LEVINS WHO DOES NOT WISH TO SPEAK BUT RECORD OPPOSITION.
ALEXANDRA BRYCE, WHO DOES NOT WISH TO SPEAK BUT RECORD OPPOSITION.
JASON WILLIFORD DOES NOT WISH TO SPEAK BUT RECORD OPPOSITION.

LINDSAY TERRY DOES NOT WISH TO SPEAK, BUT RECORD OPPOSITION.
DANIELLE TUCKER DOES NOT WISH TO SPEAK, BUT RECORD OPPOSITION.
ANYBODY ELSE WANTING TO SPEAK OR ENTER IN A COMMENT CARD.
OKAY. SEEING NONE, WE'LL CLOSE THE PUBLIC COMMENT PORTION.
COUNCIL ANY DISCUSSION AT THIS TIME? WELL, IF THERE'S NO DISCUSSION, I'LL JUST SAY THAT I CAN'T SUPPORT THE APPLICATION AS PRESENTED.
AND I WILL TAKE A MOTION TO DENY.
YES, MAYOR? I HAVE A QUESTION FOR OUR CITY ATTORNEY.
CAN YOU GO TO THE ISSUE THAT WE HAD EARLIER TODAY OR TONIGHT ON THE CARRILLON PROJECT WHERE WE DENIED THAT APPLICATION ON FIRST READING AND THEN IT WAS BACK ON OUR AGENDA FOR A SECOND READING? HOW WOULD THAT APPLY HERE? JUST EXPLAIN THAT PROCESS UNDER STATE LAW.
THE SAME ISSUES WOULD GENERALLY ARISE IN THIS INSTANCE.
BUT REMEMBER, THIS IS A TWO STEP PROCESS ON THIS PARTICULAR APPLICATION.
THE FIRST ITEM YOU WILL BE CONSIDERING IS AN AMENDMENT TO THE LAND USE PLAN THAT WOULD THEN ALLOW THE ZONING APPLICATION TO BE CONSIDERED AS POSSIBLY COMPLIANT WITH THE PLAN.
IF YOU DENY THE LAND USE PLAN AMENDMENT, THEN THAT PRETTY WELL IS A DEATH KNEEL FOR THE ZONING CASE THAT FOLLOWS BECAUSE WE ARE REQUIRED UNDER CHAPTER 211 TO ZONE CONSISTENTLY WITH THE PROVISIONS OF THE COMMUNITY'S MASTER PLAN ABSENT SOME CLEAR REASON TO VARY.
BUT WE WOULD GO FORWARD WITH ACTION ON THE PLAN AMENDMENT.
THEN WE WOULD GO FORWARD WITH THE ACTION ON THE ZONING CASE.
IF THE ZONING CASE IS DENIED, THE APPLICANT CAN SEEK TO WITHDRAW THE APPLICATION.
IF WE GET A PUBLICATION OF NOTICE OF A PUBLIC HEARING GOING FORWARD, THEN WE'RE GOING TO HAVE TO GO FORWARD AND HOLD A HEARING ON THAT APPLICATION, EVEN THOUGH IT HAS BEEN DENIED ON FIRST READING.
[02:10:10]
A SUFFICIENT PORTION OF LAND TO INVOKE THE 20% RULE, THEN IT WOULD TAKE A SUPERMAJORITY VOTE OF THE COUNCIL TO APPROVE THE ZONING CHANGE.BUT THAT DOES NOT APPLY TO THE TO THE MASTER PLAN CHANGE.
YES, MAYOR AND COUNCIL I MAKE A MOTION TO DENY ITEM 7A ORDINANCE NUMBER 1269 A CASE NUMBER CP23-0001 FIRST READING AMENDMENT TO THE CITY OF SOUTHLAKE CONSOLIDATED FUTURE LAND USE PLAN, AN ELEMENT OF THE SOUTHLAKE COMPREHENSIVE PLAN FOR FLOOR & DECOR AT 2185 EAST SOUTHLAKE BOULEVARD IN SOUTHLAKE, TEXAS.
AGAIN, THIS IS A MOTION TO DENY.
THIS MOTION TO DENY. SO A YES VOTE IS TO DENY.
I HAVE A MOTION. IS THERE A SECOND? SECOND, PLEASE CAST YOUR VOTE.
OKAY. ITEM 7A IS DENIED SIX ZERO.
I'LL TAKE A MOTION ON ITEM 7B.
AND AGAIN, THIS IS A MOTION TO DENY IT'S A MOTION TO DENY IS A VOTE FOR YES IS A VOTE TO DENY.
HAVE A MOTION. IS THERE A SECOND.
SECOND. PLEASE CAST YOUR VOTE. ITEM 7B IS DENIED SIX ZERO.
AND THAT IS IT FOR TONIGHT'S AGENDA.
SO THIS MEETING IS ADJOURNED.
