>> WITH THAT, WE'LL CALL THE REGULAR SESSION TO ORDER AND THE FIRST ACTION,
[00:00:03]
AS ALWAYS, IS GOING INTO EXECUTIVE SESSION.AS MAYOR, I HEREBY ADVISE YOU THAT WE ARE GOING INTO THE EXECUTIVE SESSION PURSUANT TO THE TEXAS GOVERNMENT CODE, SECTION 551.071, TO SEEK LEGAL ADVICE FROM OUR CITY ATTORNEY, SECTION 551.072 TO DELIBERATE REGARDING REAL PROPERTY MATTERS, SECTION 551.074 TO DELIBERATE REGARDING PERSONNEL MATTERS, AND SECTION 551.087 TO DELIBERATE REGARDING ECONOMIC DEVELOPMENT NEGOTIATIONS AND WILL BE OUT BY 7:15, MAYBE 7:30.
SOME 45-MINUTE CALL THE REGULAR SESSION BACK INTO ORDER.
IS THERE ANY ACTION NEEDED OUT OF EXECUTIVE SESSION?
>> MOVING ON TO ITEM 3, A MARRIAGE REPORT.
NOTHING SCHEDULED, SO ITEM 3D IS THE CITY MANAGERS REPORT. MS. HILL-BURTON.
>> MS. MAYOR, MEMBERS OF THE COUNCIL, I'D LIKE TO INVITE MELODY ANDERSON AND HANNAH NYQUIST TO COME FORWARD AND TALK ABOUT OUR CUSTOMER RELATIONSHIP.
OUR CUSTOMER RELATIONS MANAGEMENT SYSTEM.
>> LOVE IT. GOOD EVENING, LADIES. HOW ARE YOU ALL?
>> THANK YOU, MAYOR AND CITY COUNCIL.
HANNAH AND I ARE HERE TO GIVE YOU AN UPDATE ON THE NEW CRM TOOL THAT'S CALLED SOUTHLAKE SERVES.
LAST YEAR, THE CITY PURCHASED A TOOL THAT CONNECTS TO OUR NEW PUBLIC WORKS WORK ORDER TOOL THAT YOU'RE FAMILIAR WITH.
THE NEW CRM IS CALLED CITIZEN VIEW AND WE BRANDED IT AS SOUTHLAKE SERVES.
THERE'S CURRENTLY A WEB VERSION THAT SITS ON CITY OF SOUTHLAKE.COM, AS YOU CAN SEE ON THE SCREEN HERE.
THERE'S ALSO AN APP THAT RESIDENTS CAN DOWNLOAD, AND THEN THERE'S A BACK-END VERSION THAT STAFF USES TO FOLLOW UP WITH CUSTOMERS.
THIS NEW PROCESS TIES DIRECTLY INTO OUR CITY VALUES AND THAT WE'RE DELIVERING OUTSTANDING CUSTOMER EXPERIENCES THROUGH INNOVATION, PASSION, AND A STRONG CULTURE.
SOME OF THE CUSTOMER VALUES THAT WE'VE IDENTIFIED AS PART OF THIS NEW PROCESS OR IT'S VERY EASY FOR THEM TO PROVIDE US FEEDBACK.
THEY CAN EASILY ADD PICTURES AND DOCUMENTS TO THEIR REQUEST.
[NOISE] THE CUSTOMER RECEIVES A CONFIRMATION EMAIL,
[3. Southlake Business Spotlight: CRAVE Kitchens, 280 Commerce, Suite 107]
AS WELL AS THEIR REQUEST NUMBER THAT'S TRACKABLE, AND THEN UPDATES OR EMAILED THROUGHOUT THE PROCESS.THEY CAN ALSO CONTACT ANY TEAM MEMBER TO PROVIDE THEM WITH UPDATES.
BY THE END OF THE PROCESS, WE WILL HAVE TRAINED ABOUT 80 TEAM MEMBERS TO USE THE NEW TOOL.
SINCE OUR LAUNCH IN AUGUST, WE HAVE ALREADY RECEIVED ABOUT 500 REQUESTS THROUGH THE NEW TOOL.
WE NOW JUST QUICKLY LIKE TO WALK YOU THROUGH THE NEW PROCESS AND SHOW YOU HOW EASY IT IS TO USE.
>> HANNAH IF I'M RIGHT, I SAID THE WRONG NAME.
[LAUGHTER] WE HAVE A FEW HANDOUTS ON STAFF.
>> THAT'S OKAY. MELODY SAID, THIS PLATFORM IS ACCESSIBLE FROM THE SOUTHLAKE WEBSITE.
IT'LL TAKE THE CUSTOMER DIRECTLY TO THE PORTAL.
THE FIRST STEP IN THIS PROCESS IS TO ADD DOCUMENTS AND PHOTOS THAT SUPPORT THE REQUESTS OF THE CUSTOMERS SUBMITTING.
THE SECOND STEP WOULD BE FOR THEM TO ENTER IN THEIR LOCATION OF THEIR REQUEST, WHICH IS GOING TO BE EITHER BY CLICKING ON THE MAP AND SELECTING LOCATION OR BY TYPING IN THE ADDRESS IN THE SEARCH BAR.
A NEAT FEATURE OF THIS PLATFORM IS THAT THERE IS A GEO FENCING THAT RESTRICTS ADDRESSES FROM OUTSIDE OF THE SOUTHLAKE BOUNDARIES TO BE SELECTED TO LIMIT THE DISCREPANCIES WITH THEIRS.
STEP 3 WOULD BE THE CUSTOMER WOULD SELECT THE DETAILS.
THE FIRST DROPDOWN IS GOING TO BE THE DEPARTMENT THAT THEIR REQUESTS IS RELATED TO, AND THE SECOND DROPDOWN IS GOING TO BE A DEPARTMENT-SPECIFIC ISSUE THAT CORRELATES WITH THEIR REQUEST.
LAST ON THIS STEP, THEY WOULD ADD A DESCRIPTION OF THEIR REQUEST.
NEXT, THEY'RE JUST GOING TO ADD THEIR CONTACT INFORMATION NAME, EMAIL, AND PHONE NUMBER IS REQUIRED, AND WE'LL USE THAT TO UPDATE THE CUSTOMER THROUGHOUT THE PROCESS.
THEN FINALLY, THEY HAVE AN OPTION TO REVIEW AND CONFIRM THEIR SUBMISSION.
ONCE THEY HAVE SUBMITTED, THEY RECEIVE A SUMMARY PAGE THAT PROVIDES THEIR SERVICE REQUEST NUMBER.
THE CUSTOMER WILL ALSO RECEIVE AN AUTOMATED EMAIL THAT SUMMARIZES THEIR SUBMISSION AS WELL AS PROVIDING THEIR SERVICE REQUEST NUMBER FOR FUTURE REFERENCE.
AT THIS TIME THE CORRESPONDING DEPARTMENT FOR THE SERVICE REQUEST IS GOING TO RECEIVE AN AUTOMATED EMAIL NOTIFICATION,
[00:05:03]
WHERE THE DEPARTMENT EMPLOYEES THAT WERE PREVIOUSLY IDENTIFIED BY THEIR ADMINISTRATION WILL BE EITHER ASSIGNED OR NOTIFIED OF THE SERVICE REQUEST AND EXPECT IT TO UPDATE THE CUSTOMER THROUGHOUT THE PROCESS OF ADDRESSING AND CLOSING THEIR SERVICE REQUESTS. NO THAT'S PRETTY MUCH.>> THE FINAL ITEM WE WANT TO SHARE WITH YOU IS OUR ROLL-OUT TIMELINE.
WE'VE ALREADY COMPLETED PHASE 1, WHICH WE ADDED EVERYTHING THAT WAS ON OUR COME FIX THIS FORM WHICH IS WHAT WE USED PRIOR EXCEPT FOR PUBLIC WORKS.
WE THEN ADDED THE PUBLIC WORKS TEAM AND SUNSET TO COME FIX THIS FORM.
IF ANYONE HAS THAT BOOKMARKED, YOU MAY WANT TO ADD OUR NEW PORTAL AS YOUR NEW BOOKMARK TO CONTACT US.
WE'RE IN THEIR PROCESS OF TRAINING OUR PHASE 3 DEPARTMENTS, AND AFTER THAT, WE WILL SUNSET REMAINING FORMS THAT ARE APPLICABLE OR BEING ROLLED INTO THIS NEW PROCESS.
OUR EXPECTED LAUNCH DATE FOR THAT WHICH WOULD COMPLETE THIS PROJECT WILL BE MID-NOVEMBER.
ONE THING I DID WANT TO SHARE IS THAT WHEN WE LAUNCHED IT INITIALLY, WE ASKED OUR RESIDENTS TO HELP US TEST THE NEW PORTAL AND GIVE US FEEDBACK ON THE TOOL ITSELF, AND FROM THAT, WE WERE ABLE TO UPDATE SOME LANGUAGE WE HAD IN THERE.
MAKE SURE IT WAS VERY CLEAR AND JUST MAKE SOME ENHANCEMENTS THAT WERE BASED ON THEIR FEEDBACK.
THAT WAS REALLY VALUABLE FOR US.
OUR OVERALL GOAL FOR THIS IS TO CONTINUE TO HAVE A CUSTOMER FOCUS AND INCREASE CUSTOMER SATISFACTION.
[4. Recognition & Proclamation: Veteran's Day]
THIS PROJECT HAS LITERALLY TOUCHED EVERY DEPARTMENT, SO WE APPRECIATE ALL OF THEIR HARD WORK AND HELPING US GET THIS LAUNCHED AND WE'RE HAPPY TO ANSWER ANY QUESTIONS THAT YOU MAY HAVE ABOUT IT.I'LL BE HONEST. ONCE YOU SHOWED THE WEBSITE, I GOT ON IT.
I THOUGHT I'D JUST TRY IT. I ALREADY SUBMITTED A CITY COMPLIMENT. DID YOU GET IT PAR? IT WAS LITERALLY LIKE 30 SECONDS.
IT'S GOT A MAP FEATURE THAT YOU CAN JUST SCROLL.
I PUT IT ON TOWN HALL AND I CLICK "SUBMIT." REALLY AWESOME.
THIS IS REALLY SUPER COOL. GREAT JOB YOU ALL.
>> COUNCIL, ANY QUESTIONS? YOU CAN SUBMIT YOUR OWN CITY COMPLIMENTS THAT'S REALLY OKAY. [OVERLAPPING]
>> THANK YOU, GUYS. I REALLY APPRECIATE IT, THAT'S A GREAT TOOL.
THANK YOU VERY MUCH. MS. GILBERT, ANYTHING ELSE ON THE CITY MANAGER'S REPORT?
>> WELL, THEN WE'LL MOVE ON TO OUR CONSENT AGENDA.
WE'VE PREVIOUSLY DISCUSSED THE ITEMS ON THE CONSENT AGENDA, BUT WE DID HAVE A PARTICULAR INTEREST IN ITEM 4F, SO I'M GOING TO DISCUSS THIS.
WE'RE GOING TO GET A BRIEF PRESENTATION FROM DENNIS AND THEN HEAR FROM OUR CITY ATTORNEY.
ITEM 4F IS THE APPROVAL OF A VARIANCE TO SUBDIVISION ORDINANCE NUMBER 43.
IT'S A PLAT EXTENSION FOR KZA 22-0051 FINAL PLAT OF ARRHENIUS DAYS.
DIRECTOR KYLE, CAN YOU GIVE US JUST A REAL BRIEF 30,000 FOOT OVERVIEW OF WHAT WE'RE BEING ASKED TO CONSIDER AND WHY WE'RE BEING ASKED TO CONSIDER IT NOW?
>> THANK YOU, MAYOR, CITY COUNCIL.
THE SUBDIVISION ORDINANCE, WHEN A SUBDIVISION PLAT IS APPROVED FOR FINAL PLAT IN PARTICULAR, IT'S VALID FOR A ONE-YEAR PERIOD OF TIME FROM THE DATE THAT THE PLANNING AND ZONING COMMISSION OR CITY COUNCIL, WHOEVER THE APPROVING AUTHORITY IS, APPROVES THAT PLAT.
IT HAS BECOME CUSTOMARY IN TODAY'S TIME THAT SUB-DIVIDERS, DEVELOPERS TAKE LONGER TO CONSTRUCT OR FINISH A SUBDIVISION.
OFTENTIMES, IT WILL SURPASS THAT ONE-YEAR PERIOD BEFORE THEY'RE ACTUALLY COMPLETE WITH THAT SUBDIVISION TO WHERE IT IS READY TO BE ACCEPTED BY THE CITY.
WE DELAY FILING THAT FINAL PLAT IN THE COUNTY PLAT RECORDS UNTIL FULL CONSTRUCTION HAS BEEN COMPLETED AND IT'S SUBSTANTIALLY READY TO BE ACCEPTED BY THE CITY.
THAT HELPS US ENSURE THAT ALL THE EASEMENTS REFLECTED ON THE PLAT, THE RIGHT-OF-WAY ALIGNMENTS ARE IN THE CORRECT LOCATION AND AN AMENDED PLAT IS NOT NEEDED TO COME BACK AND MAKE CORRECTIONS AFTER THE FACT.
THE SUB-DIVIDER IS CLOSE TO FINISHING A SUBDIVISION, BUT IT EXPIRED, I BELIEVE ON NOVEMBER 4TH OF THIS MONTH AND THEY'RE REQUESTING AN EXTENSION OF THAT TO FINISH IT.
THIS WAS ZONED AND CONCEPT PLANNED FOR A FOUR-LOT SINGLE-FAMILY RESIDENTIAL DISTRICT UNDER OUR SF1A SINGLE-FAMILY RESIDENTIAL DISTRICT, WHICH IS A STANDARD ZONING DISTRICT.
THE PLAT THAT WAS SUBMITTED, THIS IS THE FINAL PLAT WHICH FOLLOWED A PRELIMINARY PLAT THAT WAS FILED AND APPROVED BY P&Z AND COUNCIL.
SUBSTANTIALLY CONFORMS WITH THAT CONCEPT PLAN UNDER THE STANDARD ZONING THAT THEY REQUESTED.
[00:10:01]
AS PART OF THE CONCEPT PLAN, THERE WAS NO SPECIFICITY IN ANY WALLS OR SCREENING FEATURES ON THE PROPERTY, AND SO THEY WERE SIMPLY REQUIRED TO MEET THE CITY'S STANDARD FENCING REQUIREMENTS ALONG THE TYPE OF ROADWAYS THAT THEY BOUGHT.THEY HAVE CONSTRUCTED AN EIGHT-FOOT MASONRY WALL WITH A STONE CLADDING.
SOME OF THE RESIDENTS IN THE AREA HAVE CONVEYED NOTHING, SENT A PETITION TO THE COUNCIL ADDRESSING SOME CONCERNS REGARDING THAT.
AS FAR AS YOUR ACTION TONIGHT, IF YOU APPROVE THIS VARIANCE THEN THEY'D BE PERMITTED TO RECORD THAT PLAT ONCE THEY FINISHED THE SUBDIVISION.
IT WOULD BECOME A RECORD OF THE COUNTY, WOULD REFLECT ALL THE EASEMENTS AND DEDICATIONS MADE OF THIS SUBDIVISION.
IF THIS VARIANCE IS DENIED, THEN OPTION THERE IS TO REFILE THE FINAL PLAT, WHICH WOULD GO THROUGH OUR STAFF, INITIAL REVIEW, AND THEN THE PLANNING AND ZONING COMMISSION, AGAIN, FOR FINAL CONSIDERATION.
BASED ON WHAT THEY PRESENTED ON THIS FINAL PLAT, THERE WOULD BE NO APPARENT REASON TO DENY THAT PLAT ONCE CONSIDERED BY PLANNING AND ZONING COMMISSION OR RECONSIDERED BY PLANNING AND ZONING COMMISSION.
>> I WANT TO BE CLEAR ON THIS.
WE ARE BEING ASKED TO RE-VISIT THIS PLAT BECAUSE IT'S EXPIRED?
>> BUT IF WE DENY IT AND SAY NO, WE'RE NOT GOING TO EXTEND IT, YOU HAVE TO RESUBMIT, THEN IT WOULD COME BACK THROUGH THE PLANNING PROCESS, PLANNING AND ZONING, TWO READINGS IN CITY COUNCIL.
>> JUST ONE HEARING, [OVERLAPPING] AT PLANNING AND ZONING COMMISSION, THIS TYPE OF PLAT WOULD NOT BE BROUGHT TO COUNCIL FOR CONSIDERATION.
>> IT DOESN'T EVEN GO TO COUNCIL.
>> DID I HEAR YOU RIGHT WHEN YOU SAID PLANNING AND ZONING HAS MINISTERIAL APPROVAL, MEANING THEY HAVE NO DISCRETION WHETHER OR NOT TO APPROVE IT? THEY HAVE TO APPROVE IT?
>> OKAY. CAN I HAVE THE CITY ATTORNEY WEIGH IN ON THIS, IS THIS ACCURATE?
>> YES, MR. MAYOR. DIRECTOR KILLOUGH HAS CORRECTLY SUMMARIZED THE SITUATION WE'RE IN.
UNDER TEXAS LAW WHEN WE'RE DEALING WITH ZONING CASES IN CHAPTER 211 OF THE CODE, YOU HAVE ENORMOUS SUBJECTIVE DISCRETION.
ON LAND DESIGN, WHICH IS SUBDIVISION PLANNING THAT'S GOVERNED UNDER A DIFFERENT CHAPTER OF THE STATUTES IN CHAPTER 212.
IT SPECIFICALLY PROVIDES THAT IF A DEVELOPER SUBMITS A PLAT IT IS FULLY COMPLIANT WITH THE PERFORMANCE REQUIREMENTS OF THE CITY SUBDIVISION REGULATION ORDINANCE, THE BODY RESPONSIBLE FOR REVIEW SHALL APPROVE THE PLAN.
THERE IS NOT ONE MICRO-MILLIMETER OF DISCRETION.
[5. Recognition & Proclamation: Texas Rangers World Series Champions Day]
IF IT'S FULLY COMPLIANT, IT HAS TO BE APPROVED AS A MATTER OF LAW.IN THIS INSTANCE, THE STAFF HAS REVIEWED THIS PLAT.
IT IS FULLY COMPLIANT WITH OUR ORDINANCE.
THE PLANNING COMMISSION, IF THEY'RE ASKED TO REVIEW IT AGAIN, WOULD BE REQUIRED BY LAW TO APPROVE IT, AND IT WOULD NOT COME TO THE COUNCIL.
IF YOU APPROVE IT TONIGHT, IT SIMPLY GETS IT OFF THE AGENDA.
AS THEY COMPLETE THE WORK, THEY WILL THEN FILE IT AND GO FORWARD.
SOMEONE MIGHT ASK, COULD THE CITY CHANGE THE LAWS OR THE REGULATIONS? NO. YOU ALL ARE FAMILIAR WITH THE FACT THAT A NUMBER OF SESSIONS BACK THE LEGISLATURE AMENDED CHAPTER 245 TO PROVIDE THAT IF A DEVELOPER SUBMITS A DEVELOPMENT PROPOSAL THAT PUTS THE CITY ON FULL AND FAIR NOTICE OF A DEVELOPMENT INTENT, THEN THAT PROJECT IS GOVERNED BY THE LAW OR REGULATIONS AS THEY EXISTED AT THE DATE THAT INITIAL SUBMISSION WAS MADE.
IF IT WAS SENT BACK TO THE DEVELOPER THEY'VE ALREADY ESSENTIALLY BUILT IT AND THE INFRASTRUCTURE, SO THEY'RE NOT GOING TO CHANGE IT.
>> THAT MAKES SENSE. COUNCILORS, IS THERE ANY QUESTIONS ON THAT? I KNOW THERE ARE A LOT OF PEOPLE HERE TO TALK ABOUT IT, I JUST WANT TO MAKE SURE THAT POINT WAS CLEAR.
OUR CHOICES ARE EITHER TO APPROVE IT TONIGHT OR DENY IT TONIGHT AND THEN IT COMES BACK TO THE P&Z AND IT'S AUTOMATICALLY APPROVED.
EITHER WAY, IT'S GOING TO HAPPEN.
I STILL WANT TO GIVE EVERYONE THE OPPORTUNITY TO TALK, BUT I JUST WANT TO MAKE SURE THAT LEGAL PROCESS WAS VERY CLEAR.
DIRECTOR KILLOUGH, YOU CAN HAVE A SEAT.
I WANT TO CALL UP SOME PUBLIC COMMENTERS IF YOU GUYS STILL WANT TO TALK ABOUT THIS.
I'LL GO AHEAD AND OPEN UP A PUBLIC FORUM ON THIS ITEM OR ANY CONSENT ITEM IF YOU WANT TO TALK ABOUT IT.
WE HAVE THE FIRST, IS THIS A SPEAKER? MS. SHELLEY? YES, I HAVE A SPEAKER, ZOE SEXIS. IS ZOE HERE? MA'AM IF YOU JUST WANT TO STATE YOUR NAME AND ADDRESS FOR THE, COME ON DOWN SORRY.
STATE YOUR NAME AND ADDRESS FOR THE RECORD.
[00:15:02]
FYI, IF YOU WEREN'T HERE WHEN I WAS TALKING ABOUT PUBLIC COMMENTS IN WORK SESSION, THREE MINUTES AND THE LIGHTS WILL GO ON WHEN YOU START TO TALK RIGHT THERE ON THE PODIUM.YELLOW LIGHT GOES ON WHEN YOU HAVE 1 MINUTE LEFT, AND RED LIGHT FLASHES MEANS WE'RE DONE JUST FYI.
>> THAT'S GREAT AND THEN ALSO GOOD EVENING.
>> I HAVE TWO DOCUMENTS HERE WITH PHOTOS. CAN I?
>> SURE. DR. KILLOUGH CAN HELP OUT WITH THE OVERHEAD PROJECTOR.
IF YOU COULD JUST STATE YOUR NAME AND ADDRESS FOR THE RECORD THEN YOU CAN GET GOING.
>> GOOD EVENING. MY NAME IS ZOE SEXIS AND MY ADDRESS IS 500 EAST BOB JONES ROAD.
I'M SPEAKING REGARDING RAINEY COURT THE PETITIONS THAT I SUBMITTED ON BEHALF OF THE RESIDENTS OF THE NORTH WHITE CHAPEL AREA.
IN 2018, SOUTH LAKE CITY COUNCIL ADOPTED THE CITY OF SOUTHLAKE LAND-USE SECTOR PLAN AS THE COMMUNITY'S VISION FOR FUTURE DEVELOPMENT.
FOR THE NORTH SECTOR, PAGE 7 IT STATES, " THE SECTOR HAS A DISTINCTIVE RURAL CHARACTER DUE TO THE LARGE LOT RESIDENTIAL DEVELOPMENT PATTERN AND THE HEAVY CONCENTRATION OF NATURAL LANDSCAPE.
AS SUCH, THE PRIMARY OBJECTIVES FOR PLANNING IN THE NORTH SECTOR, ARE THE PRESERVATION AND ENHANCEMENT OF THE EXISTING RURAL CHARACTER AND PRESERVATION OF THE NATURAL AREAS".
I, AS WELL AS OTHER CITIZENS, BELIEVE THE DEVELOPERS OF RAINEY COURT ARE NOT IN KEEPING WITH THE PRIMARY OBJECTIVES OF THE SOUTHLAKE 2035 PLAN.
IT IS EVIDENT BY THIS EIGHT-FOOT WALL ERECTED ON WEST BOB JONES ROAD, AS YOU CAN SEE NOT CLEARLY, I APOLOGIZE.
IT IMPEDES THE MOVEMENT OF WILDLIFE THROUGH THE AREA AND SIGNIFICANTLY, I WOULD LIKE TO THINK YOU WOULD AGREE, IT DETRACTS FROM THE DISTINCTIVE RURAL CHARACTER OF THE ENVIRONMENT.
IT SHOULD BE NOTED THE CLARIDEN SCHOOL JUST AROUND THE CORNER FOR STUDENTS K THROUGH 12 DOES NOT HAVE ANY TYPE OF PRIVACY WALL.
IT IS IN KEEPING WITH THE BOB JONES PARK FENCING SYSTEM.
ON THIS NEXT PHOTO IS REGARDING THE DRAINAGE.
THERE IS SIGNIFICANT AMOUNTS OF SEDIMENT AND WATER RUNOFF.
THE POND ON THE EAST SIDE OF NORTH WHITE CHAPEL IS ALL PRIVATE PROPERTY.
THE DRAINPIPE ON THE NORTH END OF THE POND WAS INSTALLED IN 1960.
IT NO LONGER SUPPORTS THE DRAINAGE SYSTEM IN THE AREA.
WATER BACKS UP ONTO THE STREETS AND PRIVATE PROPERTIES WHEN THAT DRAIN PIPE THAT YOU SEE IS OVERFLOWING AND THE WATER IS ABOVE THE TOP OF THAT PIPE ON THE NORTH END OF THAT POND.
WATER AND SEDIMENTARY RUNOFF FLOWED FROM SADDLEBACK RIDGE ESTATES WHEN IT WAS UNDER CONSTRUCTION BECAUSE THE POND WAS A DARK COLOR FOR MORE THAN A YEAR.
WE BELIEVE THE DEPTH OF THE POND HAS CHANGED AS WELL.
AGAIN, WITH RAINEY COURT IN DEVELOPMENT, THERE IS SEDIMENT FLOWING INTO THE POND.
I'M HERE RESPECTFULLY REPRESENTING A NUMBER OF RESIDENTS WHO HAVE SIGNED PETITIONS AND WHO HAVE LIVED IN THE AREA FOR OVER 30 YEARS.
WE RESPECTFULLY REQUEST THE REMOVING OF THE MASONRY WALL IN ITS ENTIRETY AND REPLACING IT WITH AN OPEN RAIL FENCE TO ENHANCE THE COMMUNITY.
WE WOULD REQUEST A CERTIFIED FLOODPLAIN MANAGER TO PERFORM A COMPREHENSIVE ASSESSMENT OF THE DRAINAGE PLAN AND THE INFRASTRUCTURE DOWNSTREAM INCLUDING THE PRIVATE POND. THANK YOU.
>> THANK YOU VERY MUCH. I HAVE ANOTHER PUBLIC SPEAKER, DAVID THOMAS. IS MR. THOMAS HERE?
>> GOOD EVENING. I'M DAVID THOMAS, 4429 SADDLE RIDGE ROAD, BEEN UP THERE SINCE '95, AND FIRST I WANT TO SAY, I APPRECIATE THE CITY OF SOUTHLAKE'S DILIGENCE AND EFFORT TO MAKE THAT NORTH SECTOR A REMARKABLE PLACE WITH BOB JONES PARK, AND ALL OF THE ASSETS.
IT'S BEEN AMAZING. I CAME UP HERE TONIGHT TO SPEAK QUICKLY ON ONE SERIOUS CONCERN.
WE APPRECIATE THE PROACTIVE APPROACH IN BUILDING A NEW WHITECHAPEL BRIDGE.
IT WAS NEEDED, BUT THE CONCERN IS THE TIME LENGTH ON THE CONSTRUCTION PROCESS.
I SPOKE TO SOMEONE AT THE CONSTRUCTION COMPANY TODAY, AND THEY SAY ITS ONE LANE OF TRAFFIC MIGHT BE OPENED IN SEPTEMBER OF 24, BUT THE BRIDGE WILL BE OPEN IN NOVEMBER.
I AM GREATLY COMFORTED AFTER SPEAKING AND MEETING ROB OVER HERE, I THINK HE'S GOT A GOOD GRIP, AND A GREAT ASSET TO THE CITY.
[00:20:03]
I THINK HE'S DOING EVERYTHING HE CAN, BUT MY CONCERN IS A PUBLIC SAFETY ISSUE.THE FIRE STATION THAT WAS PUT AT DEV IN WHITECHAPEL, AFTER A LOT OF STUDY ON THE CITY STRATEGICALLY PLACED RESPONSE TIMES IN OUR NEIGHBORHOOD WAS TWO-AND-HALF MINUTES, VERY ACCEPTABLE, EXCEPTIONAL.
NOW, WITH THE DETOUR, IT'S ABOUT 6-7 MINUTES.
IF YOU HAVE AN APPARATUS, IF THERE'S A FIRE UP THERE, THERE'S NO OTHER WAY TO GET TO IT, OR A MEDICAL EMERGENCY.
I THINK IT'S PLACED THE PUBLIC SAFETY RESPONSE TIMES IN A MARGINAL ZONE AT NO FAULT OF OUR FIRST RESPONDERS.
THEY HAVE TO DEAL WITH WHAT'S DEALT WITH THEM.
WE HAVE AN EXCEPTIONAL DEPARTMENT, BUT I URGE YOU ALL TO GIVE THE SUPPORT TO ACCELERATE THE CONTRACT HOWEVER NECESSARY TO SPEED UP THE PROCESS.
I FEEL LIKE WE'VE GOT THE RIGHT PERSON IN CHARGE, AND JUST HOPE WE GIVE THEM THE SUPPORT TO MAKE THIS HAPPEN QUICKER. THANK YOU.
>> YES, SIR. THANK YOU. IS THERE ANYONE WHO WISHES TO SPEAK ON ITEM 4F? ANYBODY ELSE? I'VE GOT A NUMBER OF PUBLIC COMMENT FORMS, FOLKS THAT DIDN'T WISH TO SPEAK ARE SUBMITTED ONLINE.
THESE ARE ALL FOLKS WHO DID NOT WISH TO SPEAK BUT RECORDED THEIR OPPOSITION.
RICHARD ANDERSON IN OPPOSITION.
[6. Recognition of Tree City U.S.A. and Arbor Day Proclamation]
YES. OPPOSITION. SORRY. JEFF NOEL OPPOSITION.BEATRICE TERRESSA, OPPOSITION.
KAREN AND RICK WHITE, OPPOSITION.
THOMAS AND JACKIE WHITE, OPPOSITION.
DREW WILSON OPPOSITION. SANDRA WILSON, OPPOSITION. PAUL WILLWAY OPPOSITION.
ANYONE ELSE WHO WISHES TO WEIGH IN ON ITEM 4 F FOR ANYTHING ON CONSENT.
SEEING NONE, I WILL CLOSE THE PUBLIC HEARING AND COUNSEL, WE LEAVE IT ON CONSENT AND APPROVES OR WE PUT IT BACK TOWARDS P&Z AND IT GETS APPROVED.
>> MY THOUGHT IS TO NOT MAKE THE RESIDENTS COME BACK DOWN HERE FOR AN ADDITIONAL MEETING OR THE DEVELOPERS.
IF IT'S GONNA GET APPROVED EITHER WAY, LET'S JUST LEAVE IT ON CONSENT AND PLOW FOR.
>> NOT TO TAKE TOO MUCH ON CONSENT.
>> YES. MAYOR AND COUNCIL, I MAKE A MOTION TO APPROVE OUR CONSENT AGENDA ITEMS 4A-4I.
>> PLEASE CAST YOUR VOTE. CONSENT AGENDA PASSES 7-0.
MOVING ON TO ITEM NUMBER 5, WHICH IS PRE-PUBLIC FORUM.
PUBLIC FORUM IS OPPORTUNITY FOR ANYONE ON COUNCIL TO COME AND ADDRESS COUNCIL ON ANYTHING ELSE THAT'S ON YOUR MIND? I'LL GO AHEAD AND OPEN UP PUBLIC FORUM.
IS THERE ANYONE WISHING TO SPEAK AT PUBLIC FORUM? SEEING NONE, I'LL CLOSE PUBLIC FORUM AND MOVE ON TO ITEM 6A, ORDINANCE NUMBER 1279, SECOND READING, ADOPTING THE 2024 STANDARDS OF CARE FOR THE RECREATION PROGRAMS FOR ELEMENTARY SCHOOL AGE CHILDREN.
DIRECTOR OF COMMUNITY SERVICES, DAVID MILLER. TAKE IT AWAY, SIR.
>> THANK YOU. MAYOR AND COUNCIL.
THIS IS THE REQUESTED ACTION THIS EVENING AS CITY COUNCIL APPROVAL OF THE 2024 STANDARDS OF CARE, WHICH IS ORDINANCE 1279.
THESE ARE STANDARDS FOR ELEMENTARY AGE RECREATION PROGRAMS OFFERED BY THE COMMUNITY SERVICES DEPARTMENT.
I WILL ADD THAT EACH YEAR STAFF REVIEW THESE STANDARDS OF CARE AGAINST THE PROGRAMS THAT WE'RE OFFERING.
THEY MAKE SURE THAT WE'RE FOLLOWING THOSE POLICIES AND PROCEDURES OUTLINED.
THEY ALSO REVIEW THEM FOR ANY CHANGES AND SO I CAN SAY THIS YEAR THERE ARE JUST A FEW ADMINISTRATIVE CHANGES TO THIS DOCUMENT, SOME GRAMMAR, THE ADDITION OF A TRAINING PARTNER THAT WE USE FOR CPR.
OTHERWISE, THE STANDARDS OF CARE ARE THE SAME AS IN PREVIOUS YEARS.
THESE STANDARDS OF CARE ADOPTED ANNUALLY ARE IN COMPLIANCE WITH THE TEXAS HUMAN RESOURCES CODE, SECTION 42.041, (B)(14), THAT ALLOW MUNICIPALITIES NOT REQUIRE A LICENSE.
[00:25:01]
GRANTED, THEY ADOPT STANDARDS OF CARE ON AN ANNUAL BASIS.THE PROVISIONS IN THE STANDARDS OF CARE COVERS STAFF RESPONSIBILITIES, PARTICIPANT ENROLLMENT REQUIREMENTS, STAFFING RATIOS, STAFF QUALIFICATIONS AND TRAINING, FACILITY STANDARDS, HEALTH AND SAFETY STANDARDS AND MECHANISMS FOR INSPECTING AND MONITORING AND ENFORCING THOSE STANDARDS OF CARE ON AN ANNUAL BASIS.
THE COMMUNITY SERVICES DEPARTMENT, OUR YOUTH PROGRAMS ARE OPERATED BY THE CITY THAT ARE RECREATIONAL AND NATURE AND NOT LICENSED BY THE STATE OF TEXAS IS DAYCARE PROGRAMS. THE CITY YOUTH PROGRAMS HAVE RECEIVED AN EXEMPTION DETERMINATION CERTIFICATE FROM THE TEXAS DEPARTMENT OF FAMILY AND PROTECTIVE SERVICES.
THERE ARE NO FINANCIAL CONSIDERATIONS WITH THIS ORDINANCE.
NO ADDITIONAL FUNDING. PARK BOARD RECOMMENDED THIS ON OCTOBER 9TH THAT THEY'RE MEETING.
IT WENT THROUGH FIRST READING OF COUNSEL ON THE 17TH AND HERE TONIGHT FOR THE SECOND READING.
THEN FINALLY, THIS ADHERES TO THE CITY STRATEGY BASED ON THE FOCUS AREAS OF SAFETY AND SECURITY AND PERFORMANCE MANAGEMENT AND SERVICE DELIVERY.
BE HAPPY TO ANSWER ANY QUESTIONS AT THIS TIME
>> COUNCIL, ANY QUESTIONS? SEEMS PRETTY STRAIGHTFORWARD.
THANK YOU, MR. MILLER, THIS IS A PUBLIC HEARING ON THIS ITEM.
[7. Review of the Southlake Sidewalks Program]
YES. I DIDN'T SUCCEED AS A PUBLIC HEARING, SO I'M GOING TO GO AHEAD AND OPEN UP THE PUBLIC HEARING.IS THERE ANYONE WISHING TO SPEAK IN PUBLIC HEARING? COME ON DOWN. PLEASE STATE YOUR NAME AND ADDRESS FOR THE RECORD.
>> [INAUDIBLE]. I SPOKE TO YOU GUYS LAST YEAR WHEN THIS CAME UP.
THERE WASN'T A LAW ON THE BOOKS THEN, BUT WE HAVE SB 14 NOW.
I'M SURE YOU GUYS HAVE CONSIDERED SOME OF YOU ARE LAWYERS.
YOU HAVE A LAWYER, BUT I DON'T.
TEXAS STATE LAW REQUIRES EMPLOYEES OF THE YOUTH PROGRAM TO REPORT ANY SUSPECTED ABUSE OR NEGLECT OF A CHILD TO THE TEXAS DEPARTMENT OF FAMILY AND PROTECTIVE SERVICES OR A LAW AND ENFORCEMENT AGENCY, FAILURE TO REPORT SUSPECTED ABUSE AS PUNISHABLE BY FINES UP TO $1,000 OR CONFINEMENT UP TO 180 DAYS.
CONFIDENTIAL REPORTS MAY BE CALLED IN AT 1800, BLAH, BLAH, BLAH.
SO WHAT IS DIFFERENCES HERE? THERE IS NOW ALONG THE BOOK BECAUSE MY CONCERN HAD BEEN LAST YEAR THAT ATTORNEY GENERAL PAXTON AND GOVERNOR ABBOTT WERE ACTIVELY HAVING A FAMILY PROTECTIVE SERVICES.
INVESTIGATE FAMILIES WITH, I'LL SAY TRANSGENDER CHILDREN OR TRANSITIONING CHILDREN.
NOW THAT IS A LAW THAT MEANS THAT 16-YEAR-OLD EMPLOYEES OF THIS PROGRAM ARE REQUIRED TO REPORT.
ANYONE THEY SUSPECT IS BREAKING THIS NEW LAW, SB 14, AND I DON'T KNOW HOW A 16-YEAR-OLD IS GOING TO DETERMINE THAT ABUSE IS BEING COMMITTED.
IS THIS CHILD TAKING GENDER? I FORGOT THE WORD, BUT ANYWAY, IT'S ONLY AGAINST THE LAW FOR GENDER-DYSPHORIC CHILDREN.
ANY OTHER CHILD'S PARENTS CAN REQUEST THAT THEIR CHILDREN TAKE GENDER BLOCKERS, THAT'S IT.
PARENTS MAY STILL REQUEST THEM FOR DELAYING PUBERTY FOR ANY REASON INCLUDING ATHLETIC PARTICIPATION.
I'M CONCERNED ABOUT MISUSE AND ABUSE AND TRAUMATIZING CHILDREN BECAUSE THIS PROGRAM DOES GO UP TO A PRE-POST PREVIEW, THE AGES OF 12 OR 13.
WHAT ABOUT CHILDREN THAT ARE INTERSECTS? IF YOU CHECK BIRTH CERTIFICATES, I DON T KNOW WHAT IS ON THE BIRTH CERTIFICATE OF AN INTERSEX CHILD.
IT JUST SEEMS VERY TRICKY TO ME.
I DON'T KNOW HOW YOU'RE GOING TO LOOK AT A CHILD.
WE HAVE A FEMININE CHILDREN, WE HAVE MASCULINE CHILDREN THAT ARE FEMALE.
WE HAVE NON-GENDER DYSPHORIC CHILDREN THAT CAN TAKE GENDER BLOCKERS.
I'M ASSUMING ALL YOU GUYS HAVE COVERED THIS THOROUGHLY AND NO, IT JUST WON'T TURN INTO A FREE-FOR-ALL WITH ONE DISTRAUGHT MOTHER CAUSE THE CITY OR CALL SOMEBODY.
>> THANK YOU. ANYONE ELSE WISHING TO SPEAK ON ITEM 6A? SEEING NONE, WE'LL CLOSE THE PUBLIC HEARING AND COUNSEL, IF THERE'S NO FURTHER DISCUSSION, I'LL TAKE A MOTION.
>> YES. MAYOR-COUNCIL, I MAKE A MOTION TO APPROVE ITEM 6A, ORDINANCE NUMBER 1279, SECOND READING, ADOPTING THE 2024 STANDARDS OF CARE FOR THE RECREATION PROGRAMS FOR ELEMENTARY SCHOOL-AGED CHILDREN OPERATED BY THE COMMUNITY SERVICES DEPARTMENT AND THIS IS
[00:30:01]
SUBJECT TO OUR MEMORANDUM DATED NOVEMBER 1ST, 2023.>> PLEASE CAST YOUR VOTE. ITEM 6A PASSES SEVEN, ZERO.
THANK YOU, MR. MILLER. MOVING ON TO ITEM 6B, ORDINANCE NUMBER 1280 SECOND READING ADOPTION OF A 2023 NATIONAL ELECTRIC CODE. DIRECTOR KILO.
>> THANK YOU, MAYOR, CITY COUNCIL.
STATE OF TEXAS, THIS PAST YEAR ADOPTED THE 2023 NATIONAL ELECTRICAL CODE AS A STANDARD MINIMUM CODE BE FOLLOWED FOR ALL ELECTRICAL WORK AND STATE OF TEXAS, AND THAT WENT INTO EFFECT ON SEPTEMBER 1ST.
ALL ELECTRICIANS ARE REQUIRED TO FOLLOW THIS LAW AND SO THE PURPOSE OF THIS ORDINANCE IS JUST UPDATE OUR ADOPTED CODES TO BE IN LINE WITH WHAT THE STATE IS ADOPTED AS A MINIMUM STANDARD.
SOME OF THE HIGHLIGHTS OF THAT INCLUDE BONDING REQUIREMENTS ON SPLASH PADS, GFCI PROTECTION ON THINGS SUCH AS CLOTHES DRYERS, MICROWAVES, ADDITIONAL SURGE PROTECTION ON MULTIFAMILY DORMS, GUESTS, SWEETS, AND NURSING HOMES, AND ALTERNATIVE ENERGY SYSTEMS REGARDING ON ON-SITE POWER SUPPLIES.
SOME ADDITIONAL STANDARD HAS BEEN APPLIED THERE OUTSIDE OF EMERGENCY DISCONNECTS FOR HOUSING AND UPDATED ELECTRICAL STANDARDS FOR VEHICLE POWER SUPPLY EQUIPMENT.
AS BUILDING PROFESSIONALS, OUR GOAL IS TO PROTECT PUBLIC THROUGH COMMITMENT TO BUILDING SAFETY.
ADOPTING THE MOST RECENT CURRENT CODES ENSURES ALL CONSTRUCTION IS AS SAFE AS POSSIBLE.
>> THIS ITEM HAS BEEN TO SPEND ON OCTOBER 10TH APPEARED BEFORE THE BUILDING BOARD OF APPEALS ON OCTOBER 16TH, WHICH THEY RECOMMENDED APPROVAL 50, AND FIRST RATING OF THIS ITEM WAS APPROVED BY COUNCIL AT YOUR LAST MEETING 70.
>> THANK YOU, SIR. THE SECOND READING COUNCIL, ANY QUESTIONS OR DISCUSSION? SEEING NONE ALL OPEN UP A PUBLIC HEARING ON ITEM 6B, IS ANYONE WISHING TO TALK TO US ABOUT THE ELECTRICAL CODE? SEEING NONE, I'LL CLOSE THE PUBLIC HEARING. SECOND MOTION.
>> YES, MAYOR AND COUNCIL, I MAKE A MOTION TO APPROVE ITEM 6B ORDINANCE NUMBER 1280, SECOND READING ADOPTION OF THE 2023 NATIONAL ELECTRICAL CODE AND THIS IS SUBJECT TO OUR MEMORANDUM DATED OCTOBER 31ST, 2023.
>> WE HAVE MOTION IS THERE A SECOND?
>> PLEASE VOTE. ITEM 6B PASSES 70. THANK YOU SO MUCH.
MOVING ON TO ITEM 6Z ORDINANCE NUMBER 48-804ZA123 DESERTERS ARE 008 SECOND READINGS ONLY CHANGE IN SITE PLAN FOR SOUTHLAKE MARKETPLACE.
DIRECTOR KYLA, HAS ANYTHING CHANGED FOR THIS ONE BETWEEN FIRST AND SECOND READING?
>> SOME VERY MINOR CHANGES SINCE YOUR FIRST RATING OR I BELIEVE THEY ARE WOULD BE CONSIDERED MINOR.
>> THE RESTAURANT SITES THAT WERE AT THE LET ME JUMP TO THE SITE PLAN AT THESE TWO CORNERS HERE.
THE RISE SOUFFLE RESTAURANTS SITE FINALIZED DESIGN CRITERIA FOR THEIR ELEVATION AND THIS IS BEING INCLUDED AS AS PART OF THE SITE PLAN.
ADDITIONALLY, AS A REGULATION MOVING FORWARD FOR THIS CENTER, THEY'VE PROPOSED A REGULATION THAT WOULD ALLOW ANY ADDITIONAL PATIOS, FOR INSTANCE, ON THE CORRESPONDING SIDE OF THIS AND SOME OF THE OTHER RESTAURANTS SITES THEY HAVE, OR ANY FACADE CHANGES.
IF THEY FALL OUTSIDE OF ADMINISTRATIVE APPROVAL, THAT THEY BE PERMITTED TO BE BROUGHT FORWARD.
JUST WHAT A SITE PLAN CONSIDERATION FOR THE ELEVATION CHANGE WITH A RECOMMENDATION FROM P&Z AND COUNSEL RATHER THAN A ZONING CHANGE UNDER THEIR CURRENT SPB1 ZONING.
THERE HAS BEEN NO CHANGE WITH THAT.
THIS IS THE OPEN SPACE PLAN, NO CHANGE FOR THAT AND ON THEIR LANDSCAPE PLAN, THESE HATCHED AREAS HERE ARE IDENTIFIED AS INTENDED TO BE BERMUDA GRASS, BUT THEY I'VE ASKED FOR THE ABILITY TO PUT IN ARTIFICIAL TURF IN THOSE AREAS IF THE TRAFFIC IMPACT IS HARSH ON THE NATURAL GRASS AREA.
WITH THAT, NO OTHER CHANGES IN THE REGULATIONS BESIDES WHAT I MENTIONED HERE AND THAT WOULD BE THE ABILITY TO JUST BRING FORWARD SITE PLAN IF ELEVATION CHANGES TO THE BUILDING OR PATIO AREAS FALL OUTSIDE OF OUR ADMINISTRATIVE AUTHORITY.
[00:35:01]
>> I DON'T THINK THOSE CHANGES ARE MINOR, BUT COUNCIL, ANY ISSUES WITH THOSE CHANGES, ANY QUESTIONS? SOUND LIKE ANY QUESTIONS FOR STAFF.
SIR, THANK YOU SO MUCH, AND THANK YOU, DEVELOPERS.
YOU GUYS HAVE A PRESENTATION THAT YOU WANT TO GIVE OR WE PRETTY MUCH COVERED IT.
SOUNDS GREAT. WE'RE EXCITED, EVERYONE ELSE'S TOO.
WE GOT TO SOCIAL MEDIA, AND WENT BANANAS WHEN WE PUT THE STUFF UP.
THEY'RE REALLY EXCITED ABOUT WHAT YOU GUYS ARE BRINGING, SO ALRIGHT.
IS THERE ANYONE IN THE AUDIENCE WISHING TO SPEAK ON ITEM 6C? SEEING NONE, I'LL CLOSE THE PUBLIC HEARING AND COUNSEL, IF THERE'S NO FURTHER DISCUSSION, I'LL TAKE A MOTION.
>> YES. MAYOR AND COUNCIL, I MAKE A MOTION TO APPROVE ITEM 6C, ORDINANCE NUMBER 48-804, CASE NUMBER ZA123-0008, SECOND READING, ZONING CHANGE IN THE SITE PLAN FOR SOUTHLAKE MARKETPLACE FOR PROPERTY DESCRIBED AS LOTS FIVE, SIX AND SEVEN OF BLOCK 1, SOUTHLAKE CROSSING PHASE II, IN ADDITION TO THE CITY OF SOUTHLAKE, TARRANT COUNTY, TEXAS, AND LOCATED AT 2001 THROUGH 21 15 WEST SOUTH LAKE BOULEVARD, SOUTHLAKE, TEXAS, SUBJECT TO OUR STAFF REPORT DATED OCTOBER 31ST, 2023, AND SITE PLAN REVIEW SUMMARY NUMBER 6 DATED OCTOBER 31ST, 2023.
NOTING THAT WE'RE APPROVING THE VARIANCES REQUESTED, NOTING WE'RE APPROVING THE REQUESTED ZONING CHANGE AND SITE PLAN AS PRESENTED, NOTING THAT THE SP1 DETAILED SITE PLAN ZONING WILL ALLOW THE C3 GENERAL COMMERCIAL USES AND REGULATIONS, BUT THE FOLLOWING MODIFICATIONS AND VARIANCES MAXIMUM IMPERVIOUS COVERAGE TO BE 78%, ALLOWING THE MINIMUM OF 579 PARKING SPACES WITH A MAXIMUM OF 25,000 SQUARE FEET OF RETAIL SPACE FOR RESTAURANTS AND THIS IS A VARIANCE OF APPROXIMATELY A 9% REDUCTION.
LANDSCAPING APPROVED AS SUBMITTED, ALLOWING THE CANOPY COLUMNS FOR THE RESTAURANT RETAIL PADS SITES TO BE AS PRESENTED IN THE PLAN, PERMITTING THE PROPOSED ASSAD AND PATIO AREA OF THE RESTAURANT SITE, NOTED AS RICE SOUFFLE AS PRESENTED THIS EVENING, AND ALSO PREVENTING FUTURE FACADE AND PATIO IMPROVEMENTS TO BE PROCESSED AS A SITE PLAN CONSIDERATION BY THE CITY COUNCIL FOLLOWING A RECOMMENDATION BY THE PLANNING AND ZONING COMMISSION, IF IT'S DETERMINED TO FALL OUTSIDE THE SCOPE OF ADMINISTRATIVE APPROVAL BY THE ADMINISTRATIVE OFFICIAL.
>> WE HAVE A MOTION. IS THERE A SECOND?
CONGRATULATIONS. CAN'T WAIT TO SEE ALL OF THOSE RESTAURANTS OPEN.
MOVING ON TO ITEM 8A RESOLUTION NUMBER 23-026, CASTING VOTES FOR THE TARRANT APPRAISAL DISTRICT BOARD OF DIRECTORS.
MS. HILL-BURTON, IS THERE A LIST OF WHO? I MEANT FOR PRESENTATION.
>> NO, WE DON'T HAVE A PRESENTATION.
WE'VE GOT THE LITTLE STRIKE HERE THOUGH.
>> COUNCIL, MY SUGGESTION, WE'VE GOT A CERTAIN NUMBER OF VOTES.
WE'VE NOMINATED RICH DEOTTE, GARY LOSADA, AND VINCE PUENTE.
MY SUGGESTION IS WE DIVIDE THE VOTES AND CAST THEM FOR THE THREE OF THOSE.
>> I WOULD RECOMMEND GIVING YOU ALL THE VOTES TOO RICH DEOTTE.
I THINK THAT'S THE BEST PLAN FOR ALL THREE OF THEM BEING SUCCESSFUL.
>> I THINK THAT'S THE RIGHT THING TO DO HERE.
>> I'M GOOD WITH THAT. ANY OTHER DISCUSSION?
>> HOW MANY OF THOSE DO WE HAVE? THIRTY TWO.
CAST THEM FOR RICH DEOTTE. LET'S GO.
>> MAYOR AND COUNCIL, I MAKE A MOTION TO APPROVE ITEM 8A RESOLUTION NUMBER 23-026 CASTING VOTES FOR TARRANT APPRAISAL DISTRICT BOARD OF DIRECTORS, NOTING THAT TAD HAS SOLICITED AND RECEIVED NOMINEES FOR CANDIDATES TO THE BOARD OF DIRECTORS.
THE CITY OF SOUTHLAKE HAS 32 VOTES THAT CAN BE CAST FOR ONE NOMINEE OR DISTRIBUTED AMONG THE NOMINEES, AND WE ARE ALLOCATING ALL 32 OF THE CITY OF SOUTHLAKE VOTES TO RICH DEOTTE.
>> WE HAVE A MOTION. IS THERE A SECOND?
>> PLEASE VOTE. ITEM 8A PASSES 7-0.
MOVING ON TO ITEM 9ASV23-0018, SIGN VARIANCES FOR JOHNSON HEALTH AND WELLNESS, DIRECTOR KILLOUGH.
>> THANK YOU, MAYOR, CITY COUNCIL.
THIS FACILITY IS LOCATED IN THE GATEWAY PLAZA SHOPPING CENTER AT 2800 EAST SOUTHLAKE BOULEVARD.
THIS IS THE BUILDING SITE LOCATION.
THESE ARE DISTANCES FROM THE ADJOINING ROADWAYS FOR WHICH DETERMINE THE MAXIMUM LETTER HEIGHT FOR EACH OF THE SIGNS BEING CONSIDERED.
THIS IS THE EXISTING SIGN ON THIS PARTICULAR BUILDING.
[00:40:03]
GATEWAY PLAZA IN GENERAL HAS A MASTER SIGN PLAN.HOWEVER, THIS PARTICULAR BUILDING AND A COUPLE OF THE OTHER PADS HOT BUILDINGS WERE NOT PART OF THE MASTER SIGN PLAN AND THEY SIMPLY ARE REQUIRED TO FOLLOW THE CITY'S SIGN REGULATIONS.
NOW, THIS IS THE SOUTH FACADE OF THE EXISTING OR PREVIOUS TENANT THAT WAS IN THIS LOCATION.
THAT IS THE WEST FACADE OF THE PREVIOUS TENANT IN THAT LOCATION.
THESE ARE SOME EXISTING SITE PHOTOS AND WHAT THAT ORIGINAL SIGN CONSISTED OF.
OUR SIGN ORDINANCE HAS CHANGED SOMEWHAT SINCE THAT SIGN WAS ORIGINALLY APPROVED.
THIS IS THE PROPOSED SIGN ON THE WEST ELEVATION AND THIS IS THEIR OPTION 1 INITIAL PROPOSAL AND WHAT WAS PRESENTED TO SIGN BOARD.
ALSO THE INITIAL OPTION 1 THAT WAS PRESENTED TO SIGN BOARD.
DETAIL OF THOSE TWO SIGNS, EXCUSE ME.
THIS IS A NIGHT VIEW OF WHAT THAT SIGN WOULD LOOK LIKE AT NIGHT.
IT'S RED IN THE DAYTIME, AND IT'S INTERNALLY LIT APPEARS WHITE AT NIGHT, SO THAT DOES CONFORM WHAT THE COLOR STANDARDS OF THE SIGN ORDINANCE.
SOUTH VIEW. FOR THE OPTION 1 SIGN, MOST PRESENTED SIGN BOARD.
THESE ARE THE ELEMENTS THAT DO NOT COMPLY WITH THE SOUTH LAKES CRAP SIGN ORDINANCE.
ON THE SIGN WIDTH THAT'S APPROXIMATELY A FOOT WIDER THAN WHAT IS PERMITTED ON THE SOUTH ELEVATION.
MAXIMUM LETTER HEIGHTS 18 INCHES AND THEY'RE PROPOSING 37.
ON THE MAXIMUM SIGN AREA FOR THAT SOUTH SIGN JUST UNDER 33 SQUARE FEET AND THEY'RE PROPOSING JUST UNDER 74 SQUARE FEET.
ON THE WEST ELEVATION, THE SIGN WIDTH IS CONFORMING.
HOWEVER, LETTER SIZE IS LIMITED TO 14 INCH UNDER OUR ORDINANCE, THEY'RE PROPOSING 44.5.
ON THE SIGN AREA LIMITED TO JUST OVER 48 INCHES AND/OR 48 SQUARE FEET.
THEY'RE PROPOSING 108 SQUARE FEET.
THE FOLLOWING SIGN BOARDS RECOMMENDATION.
>> SORRY TO INTERRUPT. IS THIS ABOUT THE SAME SIZE AS WHAT THEY HAVE NOW?
>> THEY DID, AND COURSES THAT THEY PROVIDE SOME ALTERNATE, VARYING REDUCE SIZES, AND THE APPLICANT OBLIGED THEIR RECOMMENDATION.
THIS IS OPTION 2, WHICH IS ROUGHLY 50% DECREASE IN OVERALL SIZE OF THE SIGN.
THIS WOULD BE THE WEST ELEVATION, AND THE SAME ON THE SOUTH ELEVATION, ROUGHLY 50% REDUCTION.
>> WILL YOU FLIP TO THE OTHER ELEVATION.
ARE THOSE WINDOWS SIGNS GOING AWAY?
>> THE WINDOW SIGNS WOULD HAVE TO DEFER TO THE APPLICANT ON THAT.
THOSE SHOULD BE COMPLIANT WITH THE PERMITTED AMOUNT OF WINDOW SIGNAGE.
>> REALLY. WE'LL TALK ABOUT IT. THANK YOU, SIR.
>> THEY DID PROVIDE A THIRD OPTION.
[OVERLAPPING] BASICALLY REDUCES ASSIGN CONSIDERABLY.
THE TWO VERY CLOSELY MATCH WHAT OUR SIDE OF THE ORDINANCE AND THEN IT GETS EXTREMELY SMALL.
I MIGHT MENTION TOO, ON OPTION 2 AND OPTION 3 BECAUSE OF THE REDUCTION OF THE SIZE, IT MAKES IT DIFFICULT FOR THE MANUFACTURER, INDIVIDUAL CHANNEL CUT LETTERS FOR THE TAGLINE.
THE NEW VARIANTS ASKED FOR UNDER OPTION 2 AND 3 AS A CABINET SIGN FOR THAT TAGLINE.
I'LL BE GLAD TO GO IN FURTHER DETAIL IF YOU WISH.
>> COUNCIL, ANY QUESTIONS OF DR. KILLOUGH? THANK YOU, SIR.
>> BEFORE YOU HEAR FROM THE APPLICANT,
[00:45:02]
WHAT ARE YOU GUYS THINKING?>> OPTION 3 IS LAUGHABLY SMALL.
SIGN BOARD APPROVED, BUT THEY DENIED ALL THE VARIANCES.
I LIKE OPTION 2 ON THE BUILDING ACTUALLY.
THREE IS TOO SMALL, BUT NOT THAT ONE.
THE NEW VERSION. IF YOU GO BACK TO THE FIRST ONE THAT THEY PROPOSED, IT'S HUGE.
>> IT'S TOO BIG. WE GO TO OPTION 1 ON THE OTHER ELEVATION, DENNIS. YEAH, THAT ONE.
I DON'T THINK THAT LOOKS DISPROPORTIONATE.
I'LL BE HONEST. THE WHOLE THING.
>> I THINK IT'S TOO BIG, BUT I DON'T KNOW.
>> IF WE HAVE A ONE OR THREE I WOULD AGREE WITH THAT, BUT I FEEL TWO AT LEAST IS A COMPROMISE AND I AGREE WITH YOU.
I THINK THAT BECAUSE OF THERE'S SO MUCH ON THE WINDOWS, I WOULD BE OKAY SHRINKING THAT DOWN TO YOUR OPTION 2.
>> WE NEED TO TALK TO THE APPLICANT, BUT WHAT IF WE TRADED OPTION 1 ON THAT SIGN? IF WE GAVE THEM OPTION 1 AND YOU GOT RID OF THE WINDOW SIGNS.
I'LL BE HONEST, I THINK THOSE WINDOW SIGNS ARE CHEAP.
[BACKGROUND] IF WE COULD GET RID OF THOSE SOMEHOW, BECAUSE MY ONLY CONCERN WITH OPTION 2 IS THE FITNESS AND WELLNESS STORE IS REALLY SMALL.
YOU'RE DRIVING BY, YOU GOING TO SEE JOHNSON AND SO YOU'RE NOT GOING TO READ FITNESS AND WELLNESS STORE.
I AGREE THAT JOHNSON PART IS MORE PROPORTIONATE, BUT I JUST WONDER IF THEY'D BE WILLING TO TRADE US THE WINDOW SIGNS FOR A BIGGER JOHNSON FITNESS AND WELLNESS.
>> BUT IF WE DID THE BIGGER, IS THIS THE SOUTH SIDE?
[BACKGROUND] I AGREE THAT ONE LOOKS BETTER.
>> WELL, LET'S SEE WHAT THE APPLICANT HAS TO SAY.
COME ON DOWN. SIR, IF YOU COULD JUST, AS YOU'VE SEEN, STATE YOUR NAME AND ADDRESS FOR THE RECORD AND THEN TALK TO US ABOUT, WHAT YOU'VE DONE.
>> MY NAME IS CARLOS CASANOVA, WITH CASANOVA SCIENCE AND I AM COMING FROM 1735 CYPRUS, [INAUDIBLE] DOWN IN CYPRUS.
TO BEGIN WITH, I WANT TO SAY THANK YOU ALL FOR TAKING YOUR TIME INTO DOING THIS AND EVEN THOUGH THAT WE LOST TO YOUR TEAM, AT THE END OF IT, WE KEEP IT ALL IN TEXAS, WHICH WAS THE MOST IMPORTANT PART.
>> YOUR TEAM IS A WONDERFUL BASEBALL TEAM AS WELL.
>> YEAH. ANYWAYS, ONE OF THE REQUIREMENTS FROM THE PROPERTY MANAGER MINUS MY KNEES TO REMOVE ALL THE WINDOWS SIGNS [OVERLAPPING] EXITING.
DUE TO THE DISTANCE AND AS YOU NOTICE, THERE WAS 185 FEET FROM THE AND I'M NOT SURE WHETHER THEY'RE RIGHT, NORTH SIDE, BUT ON THE LARGER SIDE THAT'S MY OPINION AND JUST LOOKING AT THE DISTANCE, 185 FEET DESIGN IS NOT GOING TO BE READABLE.
IT'S NOT GOING TO BE VERY EFFECTIVE FOR TRAFFIC THE DRIVING BY.
REMEMBER THAT PEOPLE ARE NOT JUST GOING TO BE WALKING, THEY'RE GOING TO BE DRIVING BY ON LOCATION.
MY HUMBLE OPINION IS THE DESIGN IS IN THE MIDDLE, BUT IT'S STILL IT'S TOO SMALL COMPARED TO THE ORDINANCE AND THAT IS REALLY SMALL.
THAT WILL BE MY MY TAKE ON THAT AND THAT JUST ON THE OTHER PARTY, REMEMBER THAT A BUSINESS, WITH NO SIGN IS A SIGN OR NO BUSINESS AND THE PEOPLE ARE PRETTY MUCH GOING TO GO AHEAD AND THEN FOCUSING, PROVIDE AND HELP OUT ON THE ECONOMY.
NOT YET FROM SOUTHLAKE, BUT THEY ARE LOCATED IN SEVERAL PARTS THROUGHOUT THE STATE, SO GREAT.
THAT IS MY TWO CENTS IN THIS AND THEN I REALLY APPRECIATE ALL YOUR TIME AND BEING HERE AND TAKING DECENT CONSIDERATION.
>> THANK YOU, SIR. I APPRECIATE THE PRESENTATION.
>> SIR, I HAVE A QUESTION REGARDING THE TAGLINE.
YOU SAID SOMETHING ABOUT OUR STAFF SAID SOMETHING THERE WAS AN ISSUE WITH BUILDING NOT BEING ABLE TO BUILD THE CHANNEL CUT LETTERS FOR THE TAGLINE AND THAT'S WHY YOU'RE GOING TO ASK FOR CABINET SIGN?
>> IS THAT ACCURATE? YOU CAN'T BUILD A SIGN CHANNEL CUT LETTERS IN THAT SIZE IF IT WAS UNDER OPTION 2?
[00:50:03]
>> EXACTLY. WE SAW THE LETTERS ARE TOO SMALL.
THE LETTERS ARE FIVE INCHES TALL OR SOMETHING LIKE THAT.
BESIDES BEING REAL HARD TO BE WHERE I'LL BE REAL HARD TO BE SEEING TAGLINE IS PART OF THE JOHNSON'S TRADEMARK.
THAT IS YES TO SOMETHING ELSE.
>> I GUESS FOR COUNCIL THEN IF WE DID OPTION 1 ON THE WEST ELEVATION, IT SOUNDS LIKE THAT'S NOT AN ISSUE THOUGH.
IF WE WENT WITH OPTION 1, YOU COULD STILL DO THE TAGLINE WITH THE CHANNEL CUT LETTERS?
>> YEAH, I'M GOOD WITH OPTION 1 ON THE SOUTH ELEVATION.
BUT I WOULD SPECIFICALLY NOTE IN THE MOTION THAT THEY'VE AGREED THEY'RE GOING TO TAKE DOWN THE WINDOW SIGNS.
I'M GOOD WITH THAT IF YOU GUYS ARE.
>> OH, THAT'S THE WEST ELEVATION. SWITCHING BACK, SORRY. RIGHT AWAY.
>> NO. OBVIOUSLY THE BIGGER ONE ON THE WEST ELEVATION, THE SMALLER ONE ON THE SOUTH ELEVATION, RIGHT?
>> WE'LL REQUIRE THE CHANNEL CUT LETTERS ON THE WEST ELEVATION WITH THE BIGGER SIGN OPTION 1, THEY CAN HAVE THE CABINET SIGN TAGLINE FOR OPTION 2 ON THE SOUTH ELEVATION AND WE'LL REMOVE ALL THE WINDOW SIGNS AND THEY'RE NOT PERMITTED.
>> ASHMIN. SOUNDS GOOD? QUESTIONS, COMMENTS.
>> THAT ONE FACES THE INTERIOR PIECE.
THIS SIGN HERE FACES THAT PARKING PIECE.
IS THAT RIGHT AND THAT'S ON 1709.
JUST WANT TO MAKE SURE BECAUSE YOU WANT THE BIGGER ONE ON 1709 IS WHERE YOU WANT IT, CORRECT? [BACKGROUND] IT ISN'T THAT WAY.
>> OH, YEAH. WE'RE GOING TO PUT THE SMALLER WORDS 1709.
>> I THINK YOU PROBABLY NEED TO GET ONE ON BOTH OF THEM.
ONLY COMING TOWARDS 140, WHICH IS HERE THEN.
>> I JUST THINK THE BIGGER ONE ON THE SOUTH ELEVATION LOOKS SO DISPROPORTIONATE.
>> I WOULDN'T DISAGREE RIGHT THERE WITH THAT ONE BUT [OVERLAPPING] I WONDER IF PART OF IT IS BECAUSE THAT TREE JUST BECAUSE OF HOW THAT PICTURE IS TAKEN.
>> WHEN YOU'RE ON THE STREET, I WONDER IF IT'S GOING TO LOOK DIFFERENT THAN THAT AND I JUST THINK THAT IS THE BOX SIGN YET WE'LL LOOK AS NICE AS EVEN THAT ONE DOES BIGGER.
>> WE'RE TALKING ABOUT IT'S FACING SOUTHLAKE BOULEVARD, SO PEOPLE ARE DRIVING 45 MILES AN HOUR.
I THINK IT'S MORE IMPORTANT TO HAVE THE BIG SIGN ON THE OTHER SIDE OR THEY'RE COMING AT IT.
>> BUT THEY'RE ONLY COMING OUT OF ONE.
>> I JUST THINK IT LOOKS TOO BIG FOR THAT BUILDING. FOR THAT.
>> YEAH, I AGREE. IT'S SO BIG.
>> I STEPPED OUT, SO I PROBABLY MISSED A COUPLE OF COMMENTS.
>> YOU MISSED MY BEST COMMENTS OF THE NIGHT SIR.
>> THERE WERE THE BEST COMMENTS. [LAUGHTER]
>> NO, I'M ALIGNED WITH WHAT WAS SAID EARLIER.
THAT RENDERING THAT'S TOO LARGE. I THINK IT'S THE NEXT ONE.
OPTION 2 IS WHAT WOULD I WOULD WANT ON THAT ONE AND THEN OVER HERE, THE ONE POINT I WAS GOING TO MAKE YEAH, IS NO. LET'S GO BACK.
RIGHT THERE. YEAH, I'M COMFORTABLE GIVEN THAT NEXT SIZE BIGGER HERE TOO, BECAUSE IF YOU KNOW THE AFRICAN IS SHARED THAT THOSE WINDOWS SIGNS ARE GOING TO TAKE NOW, THAT ACTUALLY MAKES THAT EVEN SMALLER.
YOU TRY TO PUT YOUR HAND UP OVER IT, THAT GETS REAL SMALL, REAL FAST WHEN YOU TAKE ALL THAT OTHER ADVERTISING AWAY.
I WOULD GIVE THEM THE LARGER SIZE THERE. I AGREE.
>> I JUST WANT TO CONFIRM BEFORE THE MOTION.
ON THE WEST ELEVATION, WHICH I THINK IS THIS ONE WE'RE GOING TO GO WITH OPTION 1, CHANNEL CUT LETTERS FOR THE TAGLINE AND NO WINDOW SIGNS.
THEN FOR THE SOUTH ELEVATION, OPTION 2 ALLOWING THE CABINET SIGN TAGLINE. LOOK AT THOSE, RIGHT?
>> MAYOR, I THINK THE APPLICANT IS CONSERVATIVE.
>> DID YOU HAVE SOMETHING ELSE? [BACKGROUND] WELL, COME DOWN, USE THE MICROPHONE, PLEASE.
>> I JUST WANT TO POINT OUT THAT THE PROPOSED SIGN ON THE OTHER SIDE OF IT IS JUST ABOUT THE SAME SIZE AS THE EXISTING SIGN.
OBVIOUSLY WAS PREVIOUSLY WHAT WE CALL VARIANTS REQUESTED BECAUSE THEY ARE THREE EXTINCT IN SIGNS.
WE ARE REQUESTING A VARIANCE FOR ONLY TWO SIGNS.
THE OLDEST SIGN, I JUST HAVE A SIGN ON THE OTHER SIDE, HE HAS A LITTLE BIT LARGER THAN WHAT IS ALREADY EXISTING.
THERE IS NOT IMAGE OF WHAT'S EXISTING THERE,
[00:55:02]
BUT IT IS JUST ABOUT THE SAME SIZE.I GOT OVER HERE, BRINGING OUT IF YOU WANT TO YES.
GO AHEAD AND LOOK AT AND COMPARE TO WHAT IS EXISTING.
>> IT WAS IN THE STAFF PRESENTATION SO WE SAW IT.
>> THANK YOU VERY MUCH. COUNCIL MEMBER, DO YOU HAVE ENOUGH TO TRY A MOTION?
>> YES, SIR. YES, MAYOR AND COUNCIL, I MAKE A MOTION TO APPROVE ITEM 9A CASE NUMBER, SV 23-0018, SIGN VARIANCE FOR JOHNSON HEALTH AND WELLNESS LOCATED AT 2808 SOUTHLAKE BOULEVARD, SOUTHLAKE TEXAS, SUBJECT TO OUR STAFF REPORT DATED OCTOBER 31ST, 2023, NOTING THAT WE'RE APPROVING FOR THE WEST ELEVATION, WE'RE APPROVING OPTION 1 WITH CHANNEL CUT LETTERS FOR THE TAGLINE.
FOR THE SOUTH ELEVATION, WE'RE PROVING OPTION 2 WITH THE CABINET SIGN TAGLINE AND NOTING THAT THE WINDOW SIGNS WILL BE REMOVED AND THEY ARE NOT PERMITTED.
>> WE HAVE A MOTION. IS THERE A SECOND?
>> PLEASE CAST YOUR VOTE. ITEM 9A IS APPROVED.
GOOD LUCK, EVERYBODY. MOVING ON TO ITEM 9B, WHICH IS SV 23-0019 SIGN VARIANCES FOR GMI, [INAUDIBLE].
>> THANK YOU AGAIN, MAYOR, CITY COUNCIL.
THIS IS A VARIANCE FOR UPPER STORY SIGN, TO ALLOW AN UPPER STORY SIGN AT 350 SOUTH NOLEN.
THIS IS FOR THE GMI, GREATER METROPLEX INTERIORS CORPORATE OFFICE BUILDING.
CIRCLED AREA SHOWS THE LOCATION OF THE PROPOSED UPPER STORY SIGN. AERIAL VIEW.
THIS IS THE PROPOSED SIGN LOCATION HERE AND THEN WHAT THE NIGHT-TIME VIEW OF THAT SIGN WOULD BE.
DETAIL OF THE SIZE OF THAT SIGN.
HERE'S A COMPARISON OF THE PROPOSED SIGN WITH STANDARD REGULATIONS OF SIGN ORDINANCE.
THEY'RE REQUESTING UPPER STORY SIGN, REQUESTING THAT SIGN TO BE LEFT JUSTIFIED RATHER THAN WITHIN THE MIDDLE 75% OF THAT FACADE.
ASKING FOR A 44.3 INCH MAXIMUM LETTER HEIGHT WHEREAS 24 IS THE MAXIMUM PERMITTED.
ALSO, 48-INCH BACKER PLATE BEHIND THE SIGN.
THESE WOULD BE CHANNEL LETTERS WITH BACKLIGHTING AGAINST THAT BACKER PLATE THAT WOULD BASICALLY CLOUD THE LETTERS.
THEY'RE COMPLIANT WITH SIGN AREA.
THIS IS SOME PHOTOS OF THEIR SITE.
YOU MAY RECALL THEY CAME IN FOR A VARIANCE TO ALLOW THIS SCULPTED SIGN AT THEIR ENTRY TO THEIR BUSINESS.
HERE'S SOME PHOTOS OF THEIR BUILDING AND SOME OF THE SURROUNDING AREAS.
SIGN BOARD APPROVED THIS ONE 6-1.
HERE'S SOME COMPARATIVE SIGNS WITH SIMILAR VARIANCES ASSOCIATED WITH THEM.
THIS WAS ACADIA CONTRACTOR OVER ON WEST SOUTH LAKE BOULEVARD THAT HAD A BACKER PLATE WITH BACKLIGHTING ON THAT.
I'LL BE GLAD TO ANSWER ANY QUESTIONS YOU MIGHT HAVE.
>> I DO HAVE A QUESTION ON THE BACKER PLATE.
THE ONE YOU JUST SHOWED, THAT ONE HAD A DESIGN ELEMENT TO IT, IF YOU WILL, WITH A TREE.
IS THERE ANYWHERE ELSE IN THE CITY WHERE WE'RE CURRENTLY APPROVING BACKER PLATES? I CAN'T REMEMBER A BACKER PLATE IN A LONG TIME.
IS THERE A REASON THAT APPLICANT WAS WANTING THAT OR IS THE APPLICANT HERE?
>> YEAH, I THINK WE DO HAVE THE APPLICANT.
>> DEFER TO THEIR DESIGN ON THAT.
>> ANY OTHER QUESTIONS TO STAFF? IF THE APPLICANTS HERE WELL COME ON DOWN AND IT SOUNDS LIKE THERE ARE A COUPLE OF QUESTIONS.
>> THANK YOU, GUYS FOR YOUR TIME AND ALLOWING ME TO BE HERE TO SPEAK TONIGHT.
I JUST WANTED TO ADDRESS THE FIRST QUESTION THAT I HEARD.
>> I'M SORRY. CAN YOU STATE YOUR NAME AND ADDRESS FOR THE RECORD, PLEASE?
>> YES, SIR. ABSOLUTELY. MY NAME IS BROOKS HAYES AND I'M AT 4344 LA CROIX LANE [NOISE] IN DENTON, TEXAS. EXCUSE ME.
I JUST WANTED TO ADDRESS THE QUESTION THAT WAS ASKED THERE ABOUT THE BACKER PLATE.
[01:00:02]
I BELIEVE THAT EVERYTHING FOR THIS SIGN BOILS DOWN TO THE VISIBILITY OF THE SIGN.I THINK THAT YOU CAN GO THROUGH HERE AND SEE THAT EACH OF THE THINGS THAT WE'RE PROPOSING CATER TO THAT.
OBVIOUSLY, THE SIGN NEEDS TO BE UP ON THE UPPER STORIES, SO THE VISIBILITY FOR THIS SIGN IS FROM CROOKED LANE IS WHERE YOU WOULD VIEW THIS SIGN FROM.
THAT SCULPTED MONUMENT WHEN YOU'RE AT CROOKED LANE IS BASICALLY INVISIBLE.
THE LEFT JUSTIFICATION AS WELL IS FOR VISIBILITY AS YOU'RE DRIVING ON CROOKED LANE.
OBVIOUSLY, THE LETTER HEIGHT IS AS WELL.
THE BACKER, SO THE PURPOSE OF THAT IS AT NIGHT WHEN THE SIGN ILLUMINATES, IT'S REVERSES THE LETTERS SO THE LIGHT SHINES OUT THE BACK.
THAT BACKER PROVIDES A LITTLE BIT MORE OF A REFLECTION OF THAT LIGHT AND ALLOWS THE SILHOUETTE OF THOSE GMI LETTERS TO BE VIEWED A LITTLE BETTER AT NIGHT TIME. IT'S ALRIGHT.
>> TRYING TO GET TO THE NIGHT VIEW.
>> THAT'S OKAY. WE'RE ENJOYING THE PICTURES.
>> THERE YOU GO. RIGHT THERE AT THE BOTTOM.
>> ANY OTHER QUESTIONS FOR THE APPLICANT?
>> WHAT IS GMI? I'M CURIOUS. GMI, WHAT IS THAT?
>> GMI IS GREATER METROPLEX INTERIORS.
IT'S SIMILAR TO WHAT THE GENTLEMAN WAS TALKING ABOUT WITH THE NEW WAY THAT THEY'RE FABRICATING THE BUILDINGS.
HE TALKED ABOUT HOW THEY WERE TRANSITIONING TO WHERE THEY ARE DOING A TILT-UP AND PUTTING A BRICK VENEER AS OPPOSED TO ACTUALLY HAVING MASONS BUILD IT.
BASICALLY WHAT GMI DOES IS THEY DO THAT WITH INTERIOR WALLS.
YOU HAVE LIKE SHEETROCK AND STUDS AND THEY MAKE THESE BIG, HUGE MODULAR PIECES THAT YOU STAND UP AND IT DOES MAKE THINGS FASTER.
>> THANK YOU, SIR. WE WILL CALL YOU BACK UP IF WE HAVE MORE QUESTIONS.
>> I GOT NO PROBLEM WITH, I THINK ACTUALLY THAT FLANGER BACKING ADDS A NICE LITTLE ELEMENT.
I CERTAINLY GOT A LOT LESS PROBLEM WITH THIS THAN I DO ACADIA, SO I'M TOTALLY GOOD.
>> I MEAN, IT LOOKS GOOD TO ME THAT THE LEFT JUSTIFIED DOESN'T BOTHER ME.
IT'S VERY CLEAN LOOK, ACTUALLY.
[8. Municipal Service Center & Public Safety Training Tower Project Update]
IT'S AN INDUSTRIAL AREA IN THE EVENING I DON'T KNOW THAT IT REALLY MATTERS THAT YOUR SIGN IS SEEN REALLY WELL AFTER DARK IN AN INDUSTRIAL AREA, BUT CERTAINLY DESERVE TO HAVE SOME ADVERTISING LOOKS GOOD TO ME>> THIS BUILDING IS TUCKED WAY BACK IN THERE.
>> WELL GOOD. WELL, IF THERE'S NO FURTHER DISCUSSION WE'LL TAKE A MOTION.
>> YES, MAYOR AND COUNCIL, I'LL MAKE A MOTION TO APPROVE ITEM 9B, CASE NUMBER SV23-0019, SIGN VARIANCES FOR GMI LOCATED AT 350 SOUTH NOLEN DRIVE, SOUTHLAKE, TEXAS, SUBJECT TO OUR STAFF REPORT DATED OCTOBER 31ST, 2023, NOTING WE'RE APPROVING THE SIGN VARIANCE FOR THE ONE ATTACHED UPPER STORY BUILDING SIGN.
WE'RE GRANTING THE VARIANCES FOR THE LEFT JUSTIFIED SIGN PLACEMENT.
THE LETTER HEIGHT OF APPROXIMATELY 44.3 INCHES AND THE SIGN TYPE HAVING CHANNEL LETTERS OUTLINED WITH AN APPROXIMATE 48-INCH BACKER PANEL.
>> WE HAVE A MOTION. IS THERE A SECOND?
>> PLEASE CAST YOUR VOTE. ITEM 9B PASSES 7-0 AND THAT IS THE LAST ITEM ON TONIGHT'S AGENDA.
[NOISE]
