IT'S NON-CONFORMING USE NOTIFICATION, THE CITY COUNCIL PUBLIC HEARING WEBSITE POSTING, PUBLIC HEARING SIGN REQUIREMENTS, AND ZONING PROTEST PROCEDURES. THE FIRST ONE IS FOR NON-CONFORMING USE NOTIFICATION. THAT'S FROM SENATE BILL 929, WHICH WAS IN THE LAST LEGISLATIVE SESSION. WE'VE ALREADY BEEN DOING THIS. IT'S JUST WE WANT TO CODIFY IT AND MAKE IT CLEAR IN OUR ORDINANCE THAT THIS IS A REQUIREMENT. YOU MAY RECALL THIS FROM WHEN WE DID THE TRANSITION ZONING DISTRICT. IT'S VERY SPECIFIC WHAT NOTICE WE NEED TO INCLUDE WHENEVER THERE'S A ZONING CHANGE THAT COULD CREATE A NON-CONFORMING USE. THIS IS THE LANGUAGE AND IT HAS TO BE IN 14.5. WE'RE JUST ADDING THAT TO OUR ORDINANCE. THEN FOR WEBSITE POSTING, HOUSE BILL 24 OF THIS LEGISLATIVE SESSION THIS YEAR. IT JUST IS BASICALLY SAYING THAT WE NEED TO POST ON THE CITY'S INTERNET WEBSITE. THIS IS SOMETHING THAT WE'RE ALREADY DOING. JUST FOR CLARIFICATION, WE'RE JUST ADDING IT TO OUR EXISTING ORDINANCE. THEN WE'RE JUST ALSO CLARIFYING A LITTLE BIT TO ALIGN WITH THE STATE CODE. CURRENTLY, IT SAYS, OUR WORDING IS AT LEAST 15 DAYS NOTICE, AND THEN WE'RE CHANGING IT TO BEFORE THE 15TH DAY. THAT'S JUST AN ALIGNMENT WITH HOW THE STATE CODE IS WRITTEN. THE NEXT CHANGE IS REGARDING PUBLIC HEARING SIGN REQUIREMENTS, AND THAT'S ALSO FROM HOUSE BILL 24. PREVIOUSLY, OUR SIGNS WERE 18 BY 24. WASN'T SPECIFIED HOW BIG THE SIGNS HAD TO BE, AND OUR ORDINANCE HAD US POST THOSE SIGNS AT LEAST 15 DAYS BEFORE THE CITY COUNCIL PUBLIC HEARING. THIS NEW BILL REQUIRES THE SIGNS TO BE 24 INCHES BY 48 INCHES AND THEY CAN'T BE POSTED ANY LATER THAN THE TENTH DAY PRIOR TO THE PLANNING AND ZONING COMMISSION HEARING. THEN THAT SIGN WILL STAY UP THROUGHOUT ACTION UNTIL CITY COUNCIL MAKES A DETERMINATION ON THAT. YOU CAN SEE THE TWO DIFFERENCES BETWEEN THE SIGNS. THIS IS JUST A SIGN, A MOCK UP THAT WE'VE GOTTEN TOGETHER. YOU CAN SEE THE DIFFERENCE IN HOW THOSE SIGNS WILL LOOK. THEN THE NEXT CHANGE IS REGARDING ZONING PROTEST PROCEDURES, AND THAT'S FROM HOUSE BILL 24 AS WELL. FOR ANY CHANGES THAT WOULD ALLOW ADDITIONAL RESIDENTIAL DEVELOPMENT, AND THAT THEY ALSO DO NOT ALLOW ADDITIONAL COMMERCIAL OR INDUSTRIAL USES UNLESS LIMITED TO THE FIRST FLOOR OF ANY RESIDENTIAL DEVELOPMENT AND NOT TO EXCEED 35% OF DEVELOPMENT. THE THRESHOLD FOR PROTEST INCREASES FROM 20%-60% OF AFFECTED PROPERTY OWNERS. BUT EVEN SO, THE CITY COUNCIL MAY STILL APPROVE THAT ZONING CHANGE WITH A SIMPLE MAJORITY VOTE OF ALL MEMBERS.
