TONIGHT WE'RE GOING TO START WITH OUR WORK SESSION, AS WE ALWAYS DO. AND FIRST UP, AS ALWAYS, IS TO INVITE PASTOR CLAYTON REED, OUR OFFICIAL CITY CHAPLAIN FROM SOUTHLAKE BAPTIST CHURCH TO LEAD US IN PRAYER.

AND THEN AFTER THAT, WE'RE GOING TO PAUSE FOR A MOMENT AND WE'RE GOING TO INVITE SOME SPECIAL GUESTS FROM THE GIRL SCOUTS TO COME ON UP AND HELP US WITH THE PLEDGES.

THERE WERE NO OPPONENTS, NO OTHER FILERS. SO WE WILL WELCOME GARY AND ERIC TO CITY COUNCIL AT A SWEARING IN CEREMONY AND OATH OF OFFICE.

FIRST MEETING IN MAY. IT'S EXCITING TO HAVE NEW COUNCIL MEMBERS.

ALTHOUGH WE KNOW THESE GUYS, GARY HAS SERVED THE CITY OF SOUTHLAKE OFF AND ON FOR ALMOST 30 YEARS, INCLUDING ON CITY COUNCIL. AND I WAS FORTUNATE ENOUGH, WHEN I JOINED CITY COUNCIL, GARY WAS HERE AND HE WAS LIKE A MENTOR TO ME VERY PATIENT, A GREAT TEACHER. SO I'M EXCITED THAT WE GET TO WORK TOGETHER AGAIN.

AND ERIC WANG IS CONTINUING HIS FAMILY'S TRADITION OF SERVING THE CITY, WHICH HAS BEEN GOING ON FOR MORE THAN 20 YEARS.

HIS FATHER, JEFF, SERVED ON CITY COUNCIL. ERIC HAS SERVED IN VARIOUS APPOINTED POSITIONS.

SO IT'S REALLY GREAT THAT WE HAVE PEOPLE WHO HAVE, YOU KNOW, A LONG RECORD OF SERVICE TO SOUTHLAKE WHO ARE NOW JOINING THIS CITY COUNCIL.

SO WE'RE EXCITED ABOUT THAT. AND FIRST MEETING IN MAY WILL MAKE IT OFFICIAL.

AND AT THE LAST MEETING IN APRIL, WE'LL TALK ABOUT COUNCIL MEMBER TALLEY AND COUNCIL MEMBER WILLIAMSON AS THEY GET READY TO REACH A TERM LIMIT.

AND I KNOW RANDY'S ALREADY COUNTING DOWN THE MEETINGS UNTIL HE'S DONE, BUT MORE TO COME ON THAT.

I'M PLEASED TO REPORT THAT THE CITY HAS RECEIVED THE DISTINGUISHED BUDGET AWARD FROM THE GOVERNOR'S, GOVERNMENT FINANCE OFFICERS ASSOCIATION FOR THE FISCAL YEAR 2026 BUDGET DOCUMENT.

THIS AWARD REPRESENTS GFOA HIGHEST RECOGNITION IN GOVERNMENTAL BUDGETING AND IS BASED ON AN INDEPENDENT PEER REVIEW FOR THE CITY'S BUDGET DOCUMENT.

TO EARN THIS DISTINCTION, THE BUDGET MUST MEET NATIONALLY RECOGNIZED CRITERIA AND BE RATED PROFICIENT IN ALL REQUIRED CATEGORIES, DEMONSTRATING THAT IT FUNCTIONS AS A POLICY DOCUMENT, FINANCIAL PLAN, OPERATIONS GUIDE, AND COMMUNICATIONS TOOL.

ORDINANCE NO. 1069A, 2ND READING, AMENDING CHAPTER 4 OF THE SOUTHLAKE CITY CODE RELATING TO THE DEFINITION OF "DANGEROUS ANIMAL" AND TRAPPING OF ANIMALS, AND ANIMALS IN PROTECTIVE CUSTODY.

CHIEF CASEY. GOOD EVENING, MAYOR, AND MEMBERS OF CITY COUNCIL, THIS IS ITEM 6.B.

APPROVE THE ORDINANCE NO. 1069A, 2ND READING, AMENDING CHAPTER 4, SOUTHLAKE CITY CODE RELATED TO THE DEFINITION OF "DANGEROUS ANIMAL" TRAPPING OF ANIMALS, AND ANIMALS IN PROTECTIVE CUSTODY.

AS YOU'RE AWARE, EARLIER THIS YEAR, THE CITY OF KELLER UPDATED ITS ORDINANCES TO INCLUDE THE DEFINITION OF "DANGEROUS ANIMAL" AND THE GOVERNING OF ANIMAL TRAPPING TO ENSURE COMPLIANCE WITH STATE LAW AND TO REFLECT CURRENT ANIMAL SERVICES PRACTICES.

BECAUSE THE CITY CONTRACTS WITH THE KELLER POLICE DEPARTMENT FOR ANIMAL SERVICES, IT'S NOT NECESSARY FOR THE CITY TO UPDATE ITS OWN ORDINANCES TO ALIGN WITH THOSE PROCEDURES. ADDITIONALLY, THE CITY'S, KELLER'S UPDATED ORDINANCES INCLUDE PROVISIONS WHICH THEY HAVE NOT HAD BEFORE, ADDRESSING ANIMALS THAT ARE TAKEN INTO PROTECTIVE CUSTODY AS A RESULT OF AN ARREST, MEDICAL EMERGENCY OR OTHER EXIGENT CIRCUMSTANCES.

SO THE PROPOSED ORDINANCE INCLUDES SIMILAR PROVISIONS TO ENSURE THAT THE CITY HAS CLEAR LEGAL AUTHORITY FOR THE IMPOUNDMENT, CARE AND DISPOSITION OF SUCH ANIMALS IN THOSE SITUATIONS.

THE REVISED DEFINITION OF DANGEROUS ANIMAL IN THE PROPOSED AMENDMENT FOR SECTION 4-100 EXPANDS THE SCOPE OF DANGEROUS ANIMAL TO INCLUDE ONE THAT MAKES AN UNPROVOKED ATTACK ON A DOMESTICATED ANIMAL THAT CAUSES SERIOUS BODILY INJURY TO THE ANIMAL AND OCCURS IN A PLACE OTHER THAN A PRIVATE ENCLOSURE, COMMERCIAL KENNEL, ANIMAL SHELTER, OR CITY DESIGNATED DOG PARK.

THIS UPDATE ALIGNS THE CITY'S ORDINANCE WITH THE TEXAS HEALTH AND SAFETY CODE AND BRINGS CONSISTENCY WITH SURROUNDING JURISDICTIONS.

THE AMENDMENT IN SECTION 4-460. TRAPPING OF ANIMALS CLARIFIES IT'S UNLAWFUL TO FOR INDIVIDUALS TO TAMPER WITH, REMOVE OR DAMAGE TRAPS SET BY ANIMAL SERVICES PERSONNEL.

AND IT ALSO PROHIBITS SETTING TRAPS IN A MANNER THAT MAY INJURE OR KILL AN ANIMAL.

THE CHANGES ENSURE HUMANE TREATMENT OF ANIMALS IN COMPLIANCE WITH APPLICABLE STATE LAWS AND BEST PRACTICES.

DUE TO SOME REGULATORY CHANGES, KELLER ANIMAL SERVICES NO LONGER PROVIDE CITY ISSUE TRAPS TO RESIDENTS FOR USE IN TRAPPING WILDLIFE.

RESIDENTS WHO CHOOSE TO UTILIZE PERSONALLY OWNED TRAPS FOR WILDLIFE REMOVAL WILL NOW BE REFERRED TO PRIVATE WILDLIFE SPECIALTY SERVICES TO RELOCATE OR PROPERLY DISPOSE OF HEALTHY WILDLIFE IN A HUMANE MANNER. HANDLING HEALTHY WILDLIFE REQUIRES SPECIALIZED TRAINING, CERTIFICATION AND LICENSING, WHICH PRIVATE WILDLIFE SPECIALISTS ARE PROPERLY EQUIPPED AND QUALIFIED TO PROVIDE SAFELY AND LAWFULLY.

BUT IT'S IMPORTANT TO NOTE THAT ANIMAL SERVICES WILL CONTINUE TO ASSIST WITH WILDLIFE ISSUES THAT POSE A PUBLIC HEALTH OR SAFETY CONCERN, SUCH AS INJURED OR SICK ANIMALS, HIGH RISK RABIES SPECIES WITH POTENTIAL HUMAN CONTACT OR HUMAN EXPOSURE, OR ANIMALS THAT HAVE BEEN BITTEN OR HAVE SCRATCHED SOMEONE.

THE PROPOSED AMENDMENT ALSO ADDS A PROVISION UNDER SECTION 4-465, ANIMALS IN PROTECTIVE CUSTODY, WHICH ESTABLISHES A TEN DAY HOLD FOR ANIMALS TAKEN IN DUE TO EMERGENCIES SUCH AS FIRES, HOSPITALIZATIONS OR ARRESTS.

FEES WILL BE WAIVED IN CERTAIN CASES, SUCH AS MEDICAL EMERGENCIES, HOSPITALIZATIONS, FIRES OR NATURAL DISASTERS.

BUT BOARDING FEES WILL APPLY AFTER 24 HOURS FOR ANIMALS IMPOUNDED DUE TO AN ARREST.

OWNERS OR AUTHORIZED INDIVIDUALS MAY RECLAIM THEIR PETS AT ANY TIME DURING THE WHOLE PERIOD. AND THIS AMENDMENT ALSO PROVIDES A PROVISION FOR THE CITY TO HAVE OPTIONS TO PLACE ANIMALS UP FOR ADOPTION, TRANSFER, OWNERSHIP, OR OTHERWISE DISPOSE OF AN ANIMAL IN A LAWFUL AND HUMANE MANNER WHEN THOSE ANIMALS REMAIN UNCLAIMED AFTER A CERTAIN PERIOD OF TIME. THIS PROPOSED ORDINANCE AND AMENDMENTS HAVE BEEN REVIEWED BY OUR CITY ATTORNEY AND THE EXISTING INTERLOCAL AGREEMENT FOR OUR COMBINED ANIMAL CONTROL AND SHELTER SERVICES FOR THE CITIES OF KELLER, SOUTHLAKE, AND COLLEYVILLE CONTAIN A PROVISION IN WHICH THE CITY OF SOUTHLAKE AGREES TO WORK WITH THE CITY OF KELLER TO ALIGN ITS ORDINANCES WITH THOSE OF KELLER AND COLLEYVILLE TO ENSURE ANIMAL CONTROL OFFICERS OPERATE UNDER A CONSISTENT AND UNIFORM REGULATORY FRAMEWORK.

IN CONCLUSION, STAFF RECOMMENDS APPROVAL OF ORDINANCE NUMBER 1069A, 2ND READING, AMENDING CHAPTER 4 OF THE SOUTHLAKE CITY CODE AS WRITTEN, AND THE REQUESTED ACTION ALIGNS WITH THE CITY'S STRATEGY MAP AS SHOWN ON THIS SLIDE.

SO MY SUGGESTION WITH THIS IS THE WAY THAT WE WORK THROUGH PRIORITIES AGAINST AVAILABLE FUNDING IS THROUGH COUNCIL DIRECTION, RIGHT? SO WE DO HAVE A SCHEDULED UPDATE FOR THE PARKS COMPREHENSIVE PLAN COMING UP, I THINK IN THE NEXT YEAR.

IS THAT NEXT YEAR, DANIEL? SO IN THE NEXT FISCAL YEAR AND WITH SOME RECOMMENDATIONS THAT ARE GOING TO BE COMING OUT OF THE TASK FORCE RELATED TO THIS, THE SSC PROJECT, AND THEN THE NEW LAND THAT WE PURCHASED, MY SUGGESTION WOULD BE THAT WE WORK THROUGH THAT IN THE FULL CONTEXT OF ALL THE COMPETING PRIORITIES FOR THAT FUNDING SOURCE. IT'S SOMETHING THAT MY SUGGESTION WOULD BE THAT THAT WE LOOK AT IT HOLISTICALLY WITHIN THE FUND CAPABILITY AND, AND ALSO WHAT COUNCIL WOULD LIKE TO DO AS FAR AS HOW FAR TO GO WITH THE FINISH OUT.

BUT THE PEOPLE WITH THE GRINDER PUMP DON'T GET ANY OF THAT.

WE GET A GRINDER PUMP, WHEN ELECTRICITY QUITS, WE HAVE TO GO TO A MOTEL OR A HOTEL.

OUR PROPERTY ABUTS JONES BRANCH, AND WE HAVE A 400 FOOT BY 15-FOOT SEWER EASEMENT ACROSS THE ENTIRE BACKYARD.

THERE HAVE BEEN SEVERAL PROPOSALS TO HELP THE PROBLEM OF EROSION IN THE JONES BRANCH CREEK, WHICH HAS A SEWER EASEMENT IN IT. AND THE FIRST ONE IS TO MOVE THE PIPE UPHILL INTO THE ADJOINING THE NEIGHBORING PROPERTY WHICH WOULD REQUIRE ANOTHER EASEMENT FROM THE CITY FROM THE HOMEOWNERS.

THIS PROPOSAL IS BAD, AS IT DOES NOTHING TO ABATE THE CONTINUING EROSION OF THE EASEMENT.

THE NEW EASEMENT. THIS PROPOSAL IS KICKING THE CAN DOWN THE ROAD SO THAT ANOTHER CITY COUNCIL WILL HAVE THE VERY SAME PROBLEM TO BE FIXED. SO BE RESPONSIBLE FOR YOUR EXISTING INFRASTRUCTURE.

ANOTHER PROPOSAL IS A COMPLETE WORKAROUND OF THE EXISTING SEWER PIPE.

THIS INVOLVES PLACING THE LIFT STATION IN THE CUL DE SAC UNDER THE CUL DE SAC OF SIMMONS COURT AND WITH ITS ATTENDANT POWER PANELS AND TOWER, AND THE NUISANCE OF HAVING A LIFT STATION IN THEIR FRONT YARD AND THE SMELL AND THE MAINTENANCE.

NO ONE WANTS A LIFT STATION IN THEIR FRONT YARD.

SO IN ADDITION TO LIFT STATION, THE LAST FOUR HOMES, THE BUDDING JONES BRANCH ARE REQUIRED TO MANAGE THEIR SEWAGE WITH GRINDER PUMPS.

GRINDER PUMPS ARE A STEP BACKWARDS IN SEWAGE HISTORY.

THE CITY WOULD INSTALL THE FIRST PUMP, AND THEN THE HOMEOWNER WOULD BE REQUIRED TO MAINTAIN TO SERVICE,
